CALL TO ORDER A Regular Meeting of the San Luis Obispo City Council was called to order on June 17, 2025 at 5:30 p.m. in the Council Chambers, 990 Palm Street, San Luis Obispo, by Mayor Stewart. 2. PLEDGE OF ALLEGIANCE Vice Mayor Shoresman led the Council in the Pledge of Allegiance. 3. PRESENTATIONS 3.a PRIDE MONTH PROCLAMATION Mayor Stewart presented a proclamation declaring the month of June as "Pride Month" to Linnea Valdivia on behalf of The Gala Pride and Diversity Center. 3.b CITY MANAGER REPORT City Manager Whitney McDonald provided a report on upcoming projects. 4. Ayes (5): Council Member Boswell, Council Member Francis, Council Member Marx, Vice Mayor Shoresman, and Mayor Stewart CARRIED (5 to 0) 5.a WAIVE READING IN FULL OF ALL RESOLUTIONS AND ORDINANCES Waive reading of all resolutions and ordinances as appropriate. 5.b MINUTES REVIEW - JUNE 03, 2025 COUNCIL MINUTES Approve the minutes of the City Council meeting held on June 3, 2025. 5.c AUTHORIZATION TO CONTINUE THE COLLECTION OF MULTI- DWELLING PROPERTY FIRE AND LIFE SAFETY INSPECTION FEES Adopt Resolution No. 11572 (2025 Series) entitled, “A Resolution of the City Council of the City of San Luis Obispo, California, authorizing the San Luis Obispo County Auditor to collect fees for 2025-26 Fire and Life Safety Inspections of Multi-Dwelling Properties containing three or more dwelling units on the Secured Property Tax Roll pursuant to California Government Code Section 54988, et seq.” 5.d ADOPT A DRAFT RESOLUTION TRANSFERING UNCLAIMED CHECK FUNDS FROM THEIR RESPECTIVE FUND(S) TO THE GENERAL FUND PURSUANT TO CALIFORNIA GOVERNMENT CODE SECTION 50050, et seq. Adopt Resolution No. 11573 (2025 Series) entitled “A Resolution of the City Council of the City of San Luis Obispo, California, Transferring Unclaimed Check Funds from their Respective Fund(s) to the General Fund Pursuant to California Government Code Section 50050, et seq.” 5.e AUTHORIZATION TO ADVERTISE THE MONITORING WELL DRILLING PROJECT, SPECIFICATION 2091506, AND AUTHORIZATION FOR 3 ADDITIONAL FUNDING FOR THE GROUNDWATER CONTAMINATION CHARACTERIZATION PROJECT 1. Approve the project plans and special provisions for the Monitoring Well Drilling Project, Specification Number 2091506; and 2. Authorize staff to advertise for bids; and 3. Authorize the City Manager to award the Construction Contract pursuant to Section 3.24.190 of the Municipal Code if the lowest responsive and responsible bid is within the available budget for the Monitoring Well Drilling Project; and 4. Authorize the City Engineer to approve Contract Change Orders up to the available project budget; and 5. Authorize the City Manager to approve contract amendments for the project, not to exceed a cumulative total of $8,925,379; and 6. Find the Monitoring Well Drilling Project consistent with the previously adopted Initial Study/Mitigated Negative Declaration and Mitigation, Monitoring, and Reporting Program. 5.f SURPLUS DESIGNATION OF FIRE FLEET ASSET BY SALE, AUCTION OR TRADE-IN Adopt Resolution No. 11574 (202 Series) entitled “A Resolution of the City Council of the City of San Luis Obispo, California, Authorizing the Surplus Designation of Fire Fleet Asset and its Sale, Auction or Trade-In” for the Fire Department’s Fleet Asset No.0607, a 2005 Ford Ranger pickup truck, in accordance with the City’s policies and procedures as prescribed in the Financial Management Manual Section 405-L and 480. 5.g SECOND READING AND ADOPTION OF ORDINANCE NO. 1747 (2025 SERIES) TO AMEND THE AIRPORT AREA SPECIFIC PLAN TO ALLOW MIXED-USE RESIDENTIAL DEVELOPMENT WITHIN THE SERVICE COMMERCIAL (C-S) AND MANUFACTURING (M) ZONES SUBJECT TO A MINOR OR CONDITIONAL USE PERMIT Adopt Ordinance No. 1747 (2025 Series) entitled “An Ordinance of the City Council of the City of San Luis Obispo, California, amending the Airport Area Specific Plan to allow mixed-use development in the Service Commercial (C-S) and Manufacturing (M) zones subject to a minor or conditional use permit where appropriate and consistent with the Airport Area Specific Plan, including adoption of an addendum to the Final 4 Environmental Impact Report for the Airport Area and Margarita Area specific plans and related facilities master plans.” 5.h APPROPRIATE GRANT FUNDS TO TRANSIT PROGRAM CAPITAL PROJECTS Adopt Resolution No. 11575 (2025 Series) entitled, “A Resolution by the City Council of the City of San Luis Obispo, California, approving the appropriation of federal and state grant funds to Transit program capital projects.” 5.i AUTHORIZATION TO APPLY FOR GRANT FUNDING THROUGH THE SAFE STREETS AND ROADS FOR ALL (SS4A) GRANT PROGRAM TO SUPPORT THE FOOTHILL COMPLETE STREETS PROJECT Adopt Resolution No. 11576 (2025 Series) entitled, “A Resolution of the City Council of the City of San Luis Obispo, California, approving the application for grant funding from the Federal Safe Streets and Roads for All (SS4A) program for the Foothill Complete Street Project” authorizing: 1. Staff to prepare and submit an application for the SS4A grant program of up to $800,000 for the Foothill Complete Streets Project; 2. The use of up to $258,090 of funding previously approved and/or planned for the Foothill Complete Streets Project in the 2025-27 Financial Plan as matching funds for this grant; 3. The City Manager to appropriate grant funds and approve a budget amendment to reflect received grant funds, if awarded; 4. The appointment of the City Manager, or their designee, as agent to conduct all negotiations, execute and submit all grant documents including, but not limited to, applications, agreements, and payment requests which may be necessary for the completion of the aforementioned project. 5.j AMEND THE PARKING PENALTY SCHEDULE FOR VIOLATIONS OF CALIFORNIA VEHICLE CODE SECTIONS 22500(N)(1)(A) AND 22511.1(A) AND DESIGNATE ELECTRIC VEHICLE CHARGING PARKING SPACES 1. Adopt Resolution No. 11577 (2025 Series) entitled, “A Resolution of the City Council of the City of San Luis Obispo, California, amending the Parking Penalty Schedule”. 5 2. Adopt Resolution No. 11578 (2025 Series) entitled, “A Resolution of the City Council of the City of San Luis Obispo, California, to Designate Electric Vehicle Parking Spaces for the Exclusive Purpose of Charging Electric Vehicles”. 5.k SUCCESSOR RESOLUTIONS FOR THE SAN LUIS OBISPO CITY EMPLOYEES’ ASSOCIATION AND UNREPRESENTED MANAGEMENT AND CONFIDENTIAL EMPLOYEE GROUPS 1. Adopt Resolution No. 11579 (2025 Series) entitled, “A Resolution of the City Council of the City of San Luis Obispo, California, adopting and ratifying the Memorandum of Understanding between the City of San Luis Obispo and the San Luis Obispo City Employees’ Association for The Period of July 1, 2025, to June 30, 2028”; and 2. Adopt Resolution No. 11580 (2025 Series) entitled, “A Resolution of the City Council of the City of San Luis Obispo, California, Amending Management Compensation for Appointed Officials, Department Heads, and Management Employees and Superseding Previous Resolutions in Conflict”; and 3. Adopt Resolution No. 11581 (2025 Series) entitled, “A Resolution of the City Council of the City of San Luis Obispo, California, Regarding Compensation for the Unrepresented Confidential Employees and Superseding Previous Resolutions in Conflict”; and 4. Adopt Regular and Temporary Employee Salary Schedules effective July 3, 2025, as required by California Public Employees Retirement System. 5.l SECOND READING AND ADOPTION OF ORDINANCE NO. 1748 (2025 SERIES) ADOPTING THE CALFIRE LOCAL RESPONSIBILITY AREA FIRE HAZARD SEVERITY ZONE MAPS AS REQUIRED BY GOVERNMENT CODE 51178 Adopt Ordinance No. 1748 (2025 Series) entitled “An Ordinance of the City of San Luis Obispo, California, designating the Fire Hazard Severity Zones as identified by the State Fire Marshal,” as introduced on June 3, 2025. 6. Adopt Resolution No. 11583 (2025 Series) entitled “A Resolution of the City Council of the City of San Luis Obispo, California, to Amend the City of San Luis Obispo Low Income Assistance Program for City Residents”; and 4. Find the action statutorily exempt from the California Environmental Quality Act (CEQA) under Public Resources Code 21083 and 21080(b)(8) and State CEQA Guidelines Section 15273 (Rates, Tolls, Fares, and Charges).
