The city's ordinance is factually distinguishable r he San ZDi ordinance and is legally defensible. He described noise ordinance violation s noted graduated fines can be studied. 3. 1236 Monte Vista: U 106-98: Request to use an existing apartment as a fraternity residence; R-4 Zone; Kappa Sigma Housing Corporation, applicant. Associate Planner Ricci presented the staff report and recommend approving the use .permit based on findings, conditions, and code requirements. Commissioner Ewan asked if the use permit would continue with the land if the fraternity were to move. Associate Planner Ricci stated the use permit runs with the land. There were no further questions/comments the public comment session was opened. PUBLIC COMMENTS: Mat Ceppi, assist. alumnus advisor, described Kappa Sigma's commendable history and civic and academic awards. He explained the renovations completed at the 1716 Osos St. house. They have had no responses from the police dept. during the 97-97 school year. They have a neighbor relations program already in place. They have addressed the concerns of RQN and have mitigated any foreseen problems. He requested use permit approval. Commissioner Jeffrey asked for comment on landscaping. a0C`03 Draft Planning Commission Minutes August 12, 1998 Page 6 Mr. Ceppi stated the chapter has cleared out the backyard, designed front walkways, planted vegetation, painted the front staircase, and hired a gardener for landscape upkeep. Chairman Senn asked if all proposed conditions are acceptable. Mr. Ceppi replied yes. Commissioner Jeffrey asked for comment on Condition #4 which limits the maximum number on site to 53. Mr. Ceppi stated their membership is 69. They currently hold and will continue to hold all meetings on campus. The only event which would draw a crowd over 53 would be rush events, which they have requested four per year. Commissioner Marx asked if community service projects have been discussed with staff. Mr. Ceppi replied no, but described the chapter's good neighbor day and other community service and charitable activities. He added that they are excited to be moving closer to campus and look forward to working with the neighbors. Commissioner Ready asked if the two additional conditions proposed by staff regarding landscaping and a trash receptacle are acceptable. Mr. Ceppi replied yes. He stated they are looking into having the fire lanes restriped and noted the occupancy was higher with the previous tenants. Jim Murphy, Kappa Sigma Housing Corporation dir., stated the conditions are acceptable and renovation/improvements are in progress. Commissioner Whittlesey asked if the corp. is going to buy this property. Mr. Murphy stated their intent is a five-year lease with a possible purchase. A goal of the corp. is to provide housing for their undergraduates. Andy Carbasis (Inaudible), Kappa Sigma Fraternity president, stated Kappa Sigma is dedicated to making the changes happen and is supportive of community services. Seeing no further speakers come forward, the public comment session was closed. COMMISSION COMMENTS: o�ceLi�+ • Draft Planning Commission Minutes August 12, 1998 Page 7 Commissioner Ready moved to approve the use permit based on the findings and subject to the conditions outlined in the staff reportincluding two additional conditions addressing landscaping and trash containment/recycling amending Finding #5 to replace "hostel" with "student housing that has existing at the site for numerous years", and amending Condition #2 to replace "twelve" with "thirty-two." The motion was seconded by Commissioner Marx. AYES: Commissioner Ready, Marx, Ewan, Whittlesey, Jeffrey, and Chairman Senn NOES: None REFRAIN: None The motion carried 6-0. Commissioner Ashbaugh was absent. COMMENT AND DISCUSSION: 4. Staff - Agenda Forecast: August 26, 1998 -- Sports field lighting at Mission College Prep DeVaul Ranch EIR September 9, 1998 -- Interfaith Coalition request to expand mtg. facilities at the Prado Day Center. September 23, 1998 -- Zoning text amendments October 14, 1998 -- Kelly Gerhardt El Capitan project Rezoning request of property between Marsh, Higuera, Santa Rosa and Torro Development Review Manager Whisenand noted there's a half -day public art seminar at 11:30 on September 10, 1998 at The Forum. Anyone interested should contact staff for registration. 5. Commission: Commissioner Marx noted she will be absent Aug. 26. Staff will include her written comments on the DeVaul Ranch EIR in their report. Commissioner Whittlesey noted having difficulties finding comment responses in the DeVaul EIR. 000005
