Planner SUBJECT: Rezoning of property on Chorro Street south of Foothill Boulevard from low-density residential (R-1) to neighborhood commercial, and to add the special considerations zone (C-N-S) [R 13971. CAO RECOMMENDATION Give final passage to Ordinance No. 1127 as introduced to rezone the property. DISCUSSION Staff and the Planning Commission recommended approval of a general plan amendment and a zone change, to enlarge the site for a small, neighborhood commercial center which is being redeveloped in phases. Normally discouraged by city policies, the minor commercial zoning enlargement was favored to allow a safer driveway location. The council approved the general-plan amendment and introduced the ordinance to rezone on November 15. No significant impacts are expected. Attached: Ordinance to rezone Distributed previously: Vicinity map Resolution to amend general plan Planning Commission minutes, 9-28-88 and 10-12-88 Initial environmental study gml/gpl397 ORDINANCE NO. 1127 (1988 Series) AN ORDINANCE OF THE CITY OF SAN LUIS OBISPO REZONING PROPERTY ON CHORRO STREET AND FOOTHILL FROM R-1 AND C-N TO C-N-S (R 1397) WHEREAS, the Planning Commission and the City Council have held hearings to consider appropriate zoning on subject property in accordance with Section 65800 et. seq. of the Government Code; and WHEREAS, the City Council finds that the proposed zoning is consistent with the general plan; and WHEREAS, the rezoning has been evaluated in accordance with the California Environmental Quality Act and the city's Environmental Impact Guidelines, and a negative declaration has been granted by the city; and WHEREAS, the proposed zoning promotes the public health, safety, and general welfare; and WHEREAS, the special considerations zone is required to assure proper location of driveways; BE IT ORDAINED by the Council of the City of San Luis Obispo as follows: SECTION 1. After review and consideration, the determination of the Community Development Director to approve a negative declaration is hereby confirmed. SECTION 2- That the areas shown on the map attached hereto marked Exhibit "A" and included herein by reference, be reclassified from Low-density Residential (R-1) and Neighborhood Commercial (C-N) to Neighborhood Commercial with special considerations (C-N-S). SECTION 3. This ordinance, together with the votes for and against, shall be published once in full, at least three (3) days prior to its final passage, in the Telegram-Tribune, a newspaper published and circulated in this city, and this ordinance shall go into effect at the expiration of thirty (30) days after its final passage.
