" RECOMMENDATION: Approve plans and specifications, authorize staff to advertise for bids, and authorize CAO to award contract if bids are within engineer's estimate. BACKGROUND: The existing sewer line in the Laurel-Orcutt easement is in a deteriorated condition and requires frequent periodic maintenance. This project will replace the existing 10" sewer main with a 12" main. The project is listed in the Capital Improvement Plan on page E-7. This project has been given an EIR clearance by the Planning Department. Status: Mitigated Negative Declaration (see attachment) . This project requires removal of 2 large eucalyptus trees. This removal has been approved by the Tree Committee. SIGNIFICANT IMPACT: Base Bid: $37, 000 Contingencies: 4 . 000 Total: $41, 000 This project is part of the Sewer Collection Main Replacement listed on page E-7 of the 1989/91 Financial Plan CIP. CONSEQUENCE OF NOT TARING ACTION: The substandard condition will remain and costs may be higher at a later date. The Housing Authority has recently received approval to develop the property. If the sewer main is replaced after construction of housing on the site, disruption to the residents will be substantial and construction costs will greatly increase. ACTION RECOMMENDED: Approve plans and specifications, authorize staff to advertise for bids, and authorize CAO to award the contract if bids are within the Engineer's Estimate. My action was to file a mitigated negative declaration. That means that I determined the project will cause no significant harm to the environment, and no further environmental study will be required because of the changes you have agreed to make in your original proposal. The declaration is issued for the amended project. The changes are listed on the attached sheet. Please sign,the original and return to my office as soon as possible. Please contact me immediately if this doesn't coincide with your understanding of the changes. A negative declaration could be reversed later, either on appeal or by automatic review by a decision-making body. Appeals may be filed by anyone, either now or shortly before your project is reviewed by the Architectural Review Commission, Planning Commission, or City Council. With or without an appeal, a negative declaration is automatically reviewed by the Planning Commission and council -- and sometimes the ARC -- when they review the project itself. As part of our environmental review, we have determined that this project may affect wildlife resources. In compliance with new state law that went into effect on January 1, 1991, at the time your project is approved, you will be required to pay a $1 ,250. fee. This fee is to support the State Department of Fish and Game's involvement in environmental review. Your check should be made out to the County Clerk's office. Description of project and environmental setting The project is the replacement of an old sewerline with a new one. The old line is located along the northerly property line of a city-owned lot that extends from the easterly side of Laurel lane to the northerly side of Orcutt Road. A 383 '-long section of the existing 10" sewer line extending from Laurel Lane easterly to an existing manhole is to be replaced with a 15" PVC sewer line, that is to be located parallel to and 7 'south of the existing line. Connections with existing lines will be made by bending the new pipe where it begins in Laurel lane and again near the manhole on the property line. The existing pipe is to be plugged at both ends and left in place. City plan no. P-59R more fully describes the project and is a part of this project description. II. Potential impacts PLANT AND ANIMAL LIFE The project involves the removal of two eucalyptus trees: 30" and 36" in diameter, plus a 6" tree and some cactus. Other trees live near the construction location, including a pepper tree growing approximately on top of the old sewer line. The project also crosses a creek, and will involve excavation within the creek bed. However, the section of the creek that will be affected will primarily be the end of a concrete-lined swale that directs drainage from an underground pipe on the neighboring property, into the natural creek on the site. No significant vegetation lives in this location. Eucalyptus trees are not native to California. They are of value primarily to Monarch butterflies, which use these trees during migration. The number of eucalyptus trees on the site is not large enough to attract Monarchs, however. The eucalyptus trees to be removed are healthy and attractive, and provide shade and some cover for some small animals and birds. By nature, though, the eucalyptus crowds out other species of plants. This has started to occur here, especially on the westerly bank of the creek. Compared to native riparian trees, the eucalyptus provides little food value and discourages the creation of an understory. The loss of*these trees will eliminate the shading-that now exists, but should have little impact otherwise on wildlife. Other trees on the site that are near the sewer line should be protected during grading. The pepper in particular is a native ER 23-91: 1090 Orcutt Road - sewer line replacement Page 2 plant that is slow-growing, lives a long time and provides food, shelter and shade for wildlife. The plans contain a note that "contractor shall use caution not to damage trees adjacent to work areas". This note may not provide sufficient protection. Conclusion: May be significant. Recommended mitigation: The trees near the excavation site shall be protected by methods to be approved by the City Arborist. Monitoring: The Community Development Department will contact the City Arborist, and request that s/he review tree protection plans developed by the Public Works Department for this project. ARCHAEOLOGICAL OR HISTORICAL RESOURCES A creek runs through the site. The creek appears to be wet most of the year by the existence of significant riparian vegetation on its banks, and the observance of wet earth during dry months. Early native peoples' typically lived near creeks, and archaeological sites have been found within a mile of the property. Therefore, an archeological surface survey and records search was conducted for the site. The letter reporting the results of that survey is attached to this report. The surface survey and records search revealed no evidence of any cultural resources, either prehistoric or historic. Conclusion: Less than significant. RECOMMENDATION Grant a negative declaration of environmental impact, subject to the following mitigation measure: I. The trees near the excavation site shall be protected by methods to be approved by the City Arborist. Monitoring: The Community Development Department will contact the City Arborist, and request that s/he review tree protection plans developed by the Public Works Department for this project.
