SUBJECT: Consideration of a tent permit applicati n by the Chamber of Commerce for the "SLO EXPO" event in the Mission Plaza. CAO RECOMMENDATION: Adopt a resolution approving the tent permit request. DISCUSSION The Chamber of Commerce sponsors an annual "SLO EXPO" event in the Mission Plaza. the Chamber wants to use a tent to house food booths for this year's event, to make it easier to comply with Health Department requirements. The tent would be 20' by 40', located near the trellis structure across from the Mission steps. The event will occur on one day only, Saturday, September 21, 1991. A street closure permit and park facility use permit are also required for Plaza events, and have already been approved by appropriate staff. Chapter 15.24 of the Municipal Code (Buildings and Construction: Tents; attached) requires Council approval of a tent permit when a tent is to be used for an assembly involving ten or more people. The Council may approve a tent permit based on a finding that it "would not be detrimental to the public safety, interest or welfare". Otherwise, the permit shall be denied. The tent ordinance also requires inspection and approval of the tent by the Building Official, Fire Marshal and Health Officer. These officials have reviewed the tent plans, and support the application. ALTERNATIVES The council may deny the tent permit. The denial would result in the cancellation of food booths for this year's SLO EXPO. (1991 SERIES) RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO APPROVING TENT PERMIT 91-1 WHEREAS, the Chamber of Commerce applied to the City for authorization to erect a tent on city-owned property at Mission Plaza on September 21, 1991; said tent to be used for the "SLO EXPO" event, which would be open to the public; and WHEREAS, on September 17, 1991, the Council conducted a hearing to consider the Tent Permit Application 91-1, as provided in Section 15.24.050 of the Municipal Code. NOW, THEREFORE, the Council of the City of San Luis Obispo approves the Tent Permit Application based on the following findings: SECTION 1. Fin in : 1. Occupancy of the tent structure for assembly purposes will not constitute a fire hazard, if conducted in accordance with all provisions of the city's Fire Prevention Code. 2. The proposed tent will not be detrimental to public safety, interest, or welfare. SECTION 2. ConditiQna: 1. Tent may be erected on September 20, 1991, and shall be removed by September 22, 1991. 2. Applicant shall comply with all provisions of the Uniform Fire Code. The Chamber has met several times with Larry Tolson, Public Works Dept. and Ken McCool, Fire Dept. to discuss each of their requirements regarding use of a tent in Mission Plaza. The Chamber has met and agreed to all their specifications. FIRE DEPARTMENT: 1. Minimum 20 Ft. fire lanes. 2. tent certificate stating it is made of fire retardent material . 3 . Minimum of 3 ft. doors. 4 . only Sterno-burners allowed (no propane to be used) PUBLIC WORKS DEPT: 1. No stakes allowed in erecting the tent. 2. Location approved, no obstructions involved. STATEMENT OF PURPOSE: Due to the strict County health regulations for outside food service, it has been very difficult for the Chamber to get "food booths" to participate in their annual SLO EXPO event; therefore, we propose to house all food participants (12) under one tent who need to comply with the health regulations. F. LENGTH OF TIME: One day, Saturday, September 21st. 10: 00am to 4 :00pm G. See attached for dimensioned plot plan. H. PARKING: Marsh and Palm Street parking structures.
