SUBJECT: Confirmation of costs for sidewalk construction
conducted under the 1911 Act - Cote property at
521 Funston
RECOMMENDATION: Adopt resolution confirming costs
BACKGROUND:
At its December 4, 1990 meeting, the City Council considered
confirmation of costs for several properties where curb, gutter and
sidewalk improvements have been installed under the 1911 Act. Marcel
Cote had several questions regarding the basis of costs assessed
against him, therefore, action on his item was deferred until
January 2, 1991 to enable staff and Mr. Cote to resolve their
differences.
On December 5, staff and Mr. Cote met to discuss costs assigned against
the property. The bid summary sheet (attached) was presented to Mr.
Cote for his review. These bid items reflect actual costs assessed
against the property and are obviously lower than the second and third
bids. One additional item is included in Mr. Cote's assessment, the
relocation of a sewer lateral in the amount of $2,110. It was
necessary to relocate the lateral to clear the new curb, gutter and
sidewalk and retaining wall, and sewer laterals are the responsibility
of the property owner.
Mr. Cote is now satisfied that the bill is fair and represents a proper
charge for the work. He has indicated that he is unable to make
payments at this time and therefore wishes the costs to become a lien
against the property, collectable with the taxes.
RECOMMENDATION:
Staff recommends that Council adopt the attached resolution regarding
confirmation of costs for the Cote property at 521 Funston.

RESOLUTION NO. (1991. SERIES)
A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN
LUIS OBISPO CONFIRMING COSTS OF CURB, GUTTER AND
SIDEWALKS CONSTRUCTED UNDER THE 1911 ACT
BE IT RESOLVED by the Council of the City of San Luis Obispo as
follows:
SECTION I. That pursuant to public hearings duly held, the
Council hereby determines that it has addressed objections or
protests to the costs of construction submitted by the Pubiic
Works Director and hereby confirms said costs as submitted as set
forth hereafter.
SECTION 2. That the hereinafter listed construction costs
shall be paid within five (5) days after the date hereof and any
such costs remaining unpaid thereafter shall be turned over to
the City Tax Collector to be placed as a lien against the
property and collected with the city taxes, and subject to the
same penalties and costs if not paid on the first installment.
The property owners, addresses and construction costs are shown
on Exhibit
SECTION 3. If the assessment is $1,000 or more payment may be
made in three annual installments at seven percent (7$) interest
subject to all the curative clauses and powers of the 1911 Act.
The property owners addresses and construction costs are shown in
Exhibit "B ".

SUBJ: Pending Election Matters
In order to facilitate taking action on the four election issues pending at the 1/2/91 meeting
(Items No. 2, 3, 4 & 5), the following is a suggested outline of the recommendations
needed. Although none of these issues is required to be held as a public hearing, it is
suggested that public testimony be accepted after the staff report is given. Each issue
should be addressed separately, with Council consensus provided on each. The last action
to be taken will be adoption of the two resolutions included in Item No. 2 (if the election
date is to be moved) identifying which measures (A through D) should be included.
An outline of the issues and recommendations are listed below:
MOVING ELECTION DATE
1) By motion, receive report (Agenda Item #2), and, by general consensus, determine that
the City's Regular Election should be retained in November of the odd- numbered years;
or
2) By motion, determine that it would be preferable to move the City's Regular Election
date to the even - numbered years. If so, then:
A) Determine if the election should be in June or November of the even years; or
B) Direct staff to prepare the necessary Charter Amendment for consideration by
the voters through either:
a) A Special Election in (month to be determined); or
b) As part of the November 1991 election.
STATE WATER
By general consensus, receive the staff report (Agenda Item #3) and determine if
the State Water issue should be included on a Special Election ballot or deferred
to the next Regular Election, as either an advisory or binding measure.

By general consensus, receive the staff report (Agenda Item #4) and determine if
the Water Initiative should be included on a Special Election ballot or the next
Regular Election ballot.
By general consensus, receive the report (Agenda Item #5) and determine if the
Referendum on Tract 1750 (Edna- Islay) should be repealed, included on a Special
Election ballot or the next Regular Election ballot.
IF A SPECIAL ELECTION IS TO BE HELD:
A) Adopt a resolution giving notice of holding a Special Election for issues as
determined (Measures A through D); and
B) Adopt a resolution requesting that the Board of Supervisors render specified
services to the City relating to the conduct of a Special Municipal Election for issues
as determined (Measures A through D).
