SUBJECT: Approval of the Business Improvement Association's
Revised Thursday Night Activities Rules and Regulations and Fee
Schedule
CAO RECOMMENDATION: Adopt two resolutions; one approving the
Business Improvement Association's Revised Thursday Night
Activities Rules and Regulations and one approving a Revised Fee
Schedule.
DISCUSSION:
Rules and Regulations
The San Luis Obispo Downtown Business Improvement Association (BIA)
has submitted a copy of revised Rules and Regulations for Thursday
Night Activities to the City Council for approval (see Attachment
11311) . This represents the first revision to the Rules and
Regulations for over two years. Staff from all affected
departments have reviewed the proposed revisions, determined that
they are appropriate, and therefore recommend approval.
The majority of the revisions are technical in nature and have been
proposed to better clarify the intent of the Rules and Regulations.
Explanations for the notable proposed revisions have been
summarized below:
* Page 3 Flow-Chart for event participation has been modified.
An extra step had been added to the appeal process for those
organizations or individuals that have been denied permission
by the Thursday Night Committee to participate in the event.
In the past, an appeal of an application denial went straight
to the BIA Board of Directors and then on. to the City Council
if the appellant was not satisfied with the Board of
Director's decision.
The BIA is now proposing that appeals first be heard by the
Thursday Night Committee. Because the initial decision for
allowing or not allowing participation in the event is based
on the Thursday Night Committee's review of a written
application, the proposed revision would provide the appellant
with an opportunity to make a verbal presentation to the
Committee. This revision is hoped to decrease the number of
appeals heard by the Board of Directors and further reduce the
chances of an appeal reaching the City Council.

* Items B & C under "Non-Member Business Participation” (on
pages 4 & 5) have been modified.
Item "B" has been modified to include a statement that non-
competing outside businesses permitted to participate in
Thursday Night Activities "will be subject to non-member fees
($50 to $100) ": (It is important to note that non-members
cannot engage in direct sales during the event. ) This does
not represent a change in policy, but merely clarifies non-
member fees in the Rules and Regulations. The practice of
charging non-member fees has been in place for over three
years. However, the only notation of the fee has been on the
BIA's fee schedule for Thursday Night Activities.

i Item C has been deleted. This section stated that "All non-
member organizations that wish to sell merchandise or food
must have a seller' s permit from the California State Board
of Equalization made out to the applicant's organization. "
This item should have been deleted as part of a prior
revision, but due to an oversight was not. THe BIA has not
allowed non-member organizations to participate in any type
of direct sales on Thursday Nights since the inception of the
event.
* Item E under Political Religious and Other Informational_
Groups (on pages 6 & 7) has been added.
Item E states that "Banners, pictures, posters, tapes, movies,
slides, etc. , which show explicit or graphic material may not
be displayed. " This addition has been proposed to provide the
BIA with the ability to restrict displays that are not in j
keeping with the family oriented nature of Thursday nights. j
* Item C under Entertainment (on pages 7 & 8) has been modified.
Item C has been modified to include a statement that
"entertainers may be subject to fees" . Because a growing i
number of performers on Thursday Night are "for profit"
entertainers that use the event as an opportunity for self
promotion (e.g. , a dance studio or vocal artist) , the BIA
feels it is appropriate to charge these types of entertainers
nominal fees ($5) . The BIA will continue its policy of not
charging non-profit entertainers appearing on Thursday Nights.
* Item G under Applications Permits and Space Allocations (on
pages 8 & 91 has been added.
Item G sets space requirements for each type of booth (direct
sales, food, barbecues, informational, etc. ) offered on
Thursday Nights. This does not representany change in
policy, but rather defines booth space allocations in the

Rules and Regulations. Prior to this, booth space allocations
were only noted on the BIA's fee schedule for Thursday Night
i Activities.
I * Item 9 under Street Closure (page 9) has been modified.
The City will now begin removing street closure barricades at
9:15 p.m. as opposed to 9: 30 p.m. Because a majority of the
Thursday night participants close down their operations by
9:00 p.m. , the BIA is proposing to have the City remove the
barricades a little earlier in an effort to clear the streets
for the public's use.

Fee Schedule

The BIA has also submitted a revised fee schedule for Thursday
Night Activities (see Attachment 11411) . These represent the fees
that businesses or organizations are charged for participating in '
Thursday Night Activities. The fee schedule has been reviewed and
approved by the Thursday Night Committee and Thursday Night
participants are fully aware of the proposed changes.
The most significant change to the fee schedule relates to the way
in which fees will be calculated for food vendor, direct sales, and
non-competing business participants. In the past, these groups have
been charged flat rates. Under the revised fee schedule, the fees
will be based on booth size. It is important to note, however,
that these fees are nominal to BIA members (between $5 and $30 per
week) and will remain the same if the standard 10 X 10 ' booth
space is used.
CONCURRENCES:

The proposed revisions have been forwarded by the BIA Board of
Directors to the City for approval. The BIA staff has reviewed and
concurs with this report. City staff review of revisions has
included Public Works, Police, Fire and Finance.
FISCAL IMPACT:
I
Approval of the BIA's Thursday Night Activities Rules and
Regulations and fee schedule will not have any significant fiscal
impact on the City.

All fees are based on a per night basis, and must be paid in

Ongoing permits will be billed on a quarterly basis, and will be

I have just learned that the SLO Business Improvement Association has
proposed that signs displayed at Farmer's Market be required to comply
with a set of regulations established by them. I cannot come to tonight's
meeting but want to communicate my strong disapproval of such
restrictions. Like some of them, I, too, am offended by some of the graphic
signs I have seen. But unlike them, I believe that offense is a small price to
pay to avoid the prior censorship proposed by the BIA over all materials. I
do not want them or anyone else to decide what I should or should not see,
or what I should or should not do to express my deeply felt views on issues
of public interest. This would set a very unfortunate precedent in two ways.
First, I do not want to allow the BIA to dictate aesthetic or political taste for
everyone in this city. And second, I resent that the BIA believes that it
alone has the right to decide what shall appear and go on at the downtown
Farmer's Market. The Farmer's Market has always been more than a
gimmick to drum up business for downtown merchants. It is also a
community gathering place, a place for the free exchange of ideas. The
downtown belongs to all of us, and issues promoted on our streets represent
the views of different segments of our community. As long as no one
actively promotes violence or illegal acts, those views should be tolerated, if
not supported. I am appalled that a group of business operators apparently
have so little respect for the right of Americans to state and promote their
views in public that they would bring this proposal to you. Please reject it as
the inappropriate attempt at censorship that it is.
