yOU ARE HEREBY NOTIFIED THAT YOU ARE IN VIOLATION OF: 1) Facility has been
generating hazardous waste without obtaining a CUPA Hazardous Waste Generator Permit from
San Luis Obispo City Fire. This is in violation of California Code of Regulations Title 22, section
66262.12; 2) Used motor oiVtransmission fluids were not managed as a hazardous waste in
violation of California Health and Safety Code, section 25250.4 (includes proper labeling' storage,
etc.); 3) Facitity illegally discharged waste motor oiUtransmission fluid to the curb, gutter, and drop
inlet rather than being transported by a licensed hazardous waste transporter to a facility with an
EPA ID Number and permit, in violation of California Health and Safety Code section 25189.5,
and California Code of Regulationso Title 22 section 66262.12;4) Unauthorized release of waste
motor oifftransmission fluid was not immediately reported as required by California Health and
Safety Code section 25507;5) Facility does not conduct appropriate employee training or maintain
documentation of employee training as per California Code of Regulations Title 19, section 2732 &
Title 22,section 66265.16.
YOU ARE, HEREBY ORDERED TO CORRECT ALL VIOLATIONS IMMEDIATELY.
FURTHER ENFORCEMENT ACTION MAY BE PURSUED SHOULD AI\IY OUTSTANDING
VIOLATIONS NOT BE CORRECTED. ALL RELATED PAPERWORK DISPOSAL
RECORDS, EMPLOYEE TRAINING RECORDS, AND PERMITS WILL BE FORWARDED
TO SAN LUIS OBISPO CITY FIRE AS SOON AS THEY ARE AVAILABLE. DAILY

SUBJECT: PETROLEUM PRODUCT CONTAMINATION IN UNDERGROUND TANK EXCAVATION
AT 1371 MONTEREY STREET, SAN LUIS OBISPO
On June 6, 1986, you met with Boand staff to discuss the::esuJ-ts of gnound
waten analyses fnom your 1371 Monteney Stneet property in the City of SanLuis obispo. The wate:: samples wene taken May g, 1986, du::ing::emoval- of
th::ee unde::gnound tanks
Boand staff was present at the site on May 9. and noted floating pnoduct in
ground watel- which had seeped into the excavation. Staff al-so noted an
impnoperly dnained p::oduct line which had l-eaked an undetenmined amount of
fnee p::oduct into the cavity aften it was disconnected.
A soil contamination investigation by Pacific Geoscience, Inc., on October 7,
1985' indicated low l-evels of contaminat.ion (.from 4 to.10 times t'action
levelsttfor. Benzene, Toluene, and Xylene) at 5 feet, but insignificant
Ievel-s at 10-15 feet. Fu::thermone, visual inspection of,. the excavation by
Board staff tended to :.einforce the soil- boning data. It appeaned to staff
that visibl-e soil discol-o::ation, indicative of the contamination, was limitedprimarily to shaLlow zones adjaeent to pnoduct pipes
Howeven, the laboratony analyses you submitted on June 6, indicated that
levels of Benzene, Toluene, and Xylene, exceeded Department of Heal-th Servicestrraction level-str fon gnound water.. unfo::tunately, the spilling of fnee pro-
duct into the excavation complicated the evaluation of long-term g::ound
waten contamination.
What is not clear from these data, then, is whethen they t:ruly r"epnesent
a long-term degnadation of ground water:, or possibly only:refl_ect the
spilled free pnoduct int::oduced du:ring tank :removal_. The::efore, you alre
::equested by the Board to obtain waten samples fon labonatony analysis
fnom the necovery welJ-s al::eady in place and to neport the r.esul-ts to the
Boand no later than July 15, 1986. You ane reminded that the Cal-ifo::nia
Waten Code allows the Regional Boa::d to assess civil liabilities of up to
$trOOO pen day fon each day such a repo::t is overdue.

to say thanks io yon for your letter and knowing bhal someone cares what is
trappening elsewhere olher than in their own Lown means alot.
f found your leLter very interesting in bhe similarity as to bhe gasoline
and what was done to find the source.
To bring you up-to-CaLe as to what was done and how we are handling itr is
as follow!. Irirst let me explain the area in which the gasoline was found is
surrounded by abouf I!+ sourees where gasoline could be folnd.
Our first step was to send. a sample of lhe gasoline found and a sample from
each serviee slatlon of each bank. We received resulbs bhal ib was a ConLinental
gil Conpany product. At that time, we thoughb we had it naffowed down to two
possiblL sturces. We ordered pressure tesl,s of both sources which showed us
that on" statj.on had Lhree tanks Leaking and the other had none. After
removing bhe tanks our problern still was increasing'
We then ordered a pressure tesL of all slaLions in the immediabe &rs&r We
dug tesf holes in all directions from ihe source for a Lwo block area to see
if we could" Lrace which dj-rection the source was coming from. The gasoline
only showed in the area of the sourcoo
We then covered an area of four blocks on each side of the source with exploso-
meters checking all nanholes, water tine shut offs and any other place where
a hole went inio Lhe ground. llle found again reading only on one street for
a distance of only four bloeks on either side of the source, mainly in lhe
telephone duct workr
