Item 9 . Tract 2010 : Consideration of a vesting map creating
a 15-unit residential planned development and condo-
minium; 3360 Rockview Place; R-2-S zone; John & Kelly
Mitchell, subdividers .

Greg Smith presented the staff report .and recommended approval of
Tract 2010 subject to findings, mitigation measures, and
conditions.

Commr . Schmidt was concerned about the amount of culverting as the
1983 Flood Management Plan prohibits culverting unless there is
no feasible alternative . He believed requests for culverting
should gb to the City Council .
Commr . Kourakis said she contacted Michael Cannon by telephone
with questions about his calculations . She felt that alternatives
to culverting had not been adequately explored. She was also
concerned about adjusting the requirement for solar heating, and
asked Cindy Clemens to clarify the requirements .
Cindy Clemens explained the Municipal Code Section 17 . 82 . 150 sets
out the findings that need to be made to make exceptions to
property improvement standards for condominiums . The findings are :
1 . There are circumstances at the site such as size, shape or
topography distinct from land in the same zoning where compliance
would not be practical because of the location of site design, 2 .
The variance would not constitute a grant of special privilege and
entitlement inconsistent with the limitations upon other property
in the vicinity with the same zoning, and that 3 . No feasible
alternative to authorizing the exception would satisfy the intent
of City policies or regulations . She added these findings are
included for approval .
Commr . Kourakis said she did not understand why the applicant does
not want to use solar water heaters .
Commr . Karleskint was concerned with the wording requiring trees
and plants remain where feasible because often developers do not
think it is feasible for trees to remain.
Chairman Hoffman opened the public hearing .
John Mitchell, 1012 Pacific Street, applicant, said solar panels
on roofs are not an esthetic solution and he can reach the same
level of energy conservation, BTU loss, by using certain building
materials such as more insulation and higher efficiency furnaces .
He said the proposed culverted area has been designed according to
suggestions of the City Engineering Department . He added extending
the culvert will still be visually appealing because of land-
scaping and an added bridge .
Chairman Hoffman closed the public hearing.
Commr . Gurnee said he liked the improvements of the drainage swale
making it a design feature of the project . He suggested adding a
finding 4 under condition 9 stating the applicant has incorporated
energy conservation measures that are equal to or exceed the
energy conservation requirements associated with solar water
heating.
Commr . Peterson agreed with Commr . Gurnee . He added his solar
water heater was not very efficient .
Commr . Kourakis disagreed and said her solar water heater is
efficient and one of the purposes of this requirement is to save
renters money on energy bills . She added she had concerns about

culverting .
Commr . Schmidt said it did not make landscaping sense to have
water on one side of a bridge and a grassy area on the other . He
suggested a condition that would require the applicant to inform
future residents of the four lower buildings that the creek has
been redirected and it is unknown exactly where the creek
originally flowed .
Commr . Gurnee moved to approve Tract 210 based on the findings and
conditions in the staff report with the addition of a finding D
under condition 9 stating the applicant has incorporated
energy conservation measures that are equal to or exceed the
energy conservation requirements associated with solar water
heating above and beyond Title 24 requirements .
Commr . Peterson seconded the motion.
Commr . Schmidt requested a condition be added that only minimal
culverting needed to get the water flow in a straight be included .
Commr . Gurnee declined Commr . Schmidt 's suggestion, saying he was
comfortable with the project the way it is designed .
Commr . Hoffman requested that the new condition state the energy
savings are above and beyond the Title 24 requirements calculated
without solar panels .
Commrs. Gurnee and Peterson agreed to Commr . Hoffman 's request .
Commr . Karleskint said he had some problems with the culverting
but could support the project because it is very imaginative for
the site .
VOTING: AYES - Commrs . Gurnee, Peterson, Karleskint, Williams,
and Hoffman.
NOES - Commrs . Kourakis and Schmidt.
ABSENT - None .
The motion passed .
Commr . Gurnee left due to an early commitment the following
morning .

SUBJECT: Agenda Item 2 - 3360 Rockview Place
The Public Works Department has no objection and, in fact, feels
it is desirable that the drainage channel lying between Lots 7
& 8 of this tract be culverted. This recommendation is in
keeping with Exhibit B, recommended by the Waterways Planning
Board and adopted in 1973.- that recommended this particular
drainage way could be culverted. The majority of the drainage
channel upstream of this point is culverted.
