Dear Property Owner,
On February 6, 2024, City of San Luis Obispo Community Development Department staff noted the following
violations of the San Luis Obispo Municipal Code or other relevant codes at the above listed address:
1. The rear exterior foundation wall has failed and is not capable of supporting the building directly above
the wall. While a foundation repair permit was issued in 2017, it did not address the foundational supports
required for the lower-level staircase area.
SLOMC 15.02.130, International Property Maintenance Code 304.1.1:
Exterior Structure – General - Unsafe conditions. The following conditions shall be determined as unsafe
and shall be repaired or replaced to comply with the California Building Code or the California Existing
Building Code as required for existing buildings:
5. Structural members that have evidence of deterioration or that are not capable of safely supporting
all nominal loads and load effects.
6. Foundation systems that are not firmly supported by footings, are not plumb and free from open
cracks and breaks, are not properly anchored or are not capable of supporting all nominal loads
and resisting all load effects.
7. Exterior walls that are not anchored to supporting and supported elements or are not plumb and
free of holes, cracks or breaks and loose or rotting materials, are not properly anchored or are
not capable of supporting all nominal loads and resisting all load effects.
Corrective Action: A licensed structural engineer is required to evaluate the rear foundation wall. Please
submit a report from the engineer with their evaluation and any recommendation for remediation. Repair
of the wall will require the submission of an application and associated plans to obtain a building permit
prior to work occurring. Plans may be required to be prepared by a qualified design and/or engineering
professional. Please contact city Planning and Building Departments to determine the required steps for
submittal and if each structure and/or alteration in its current location can be permitted to meet current
zoning regulations and building codes.

2. Evidence of a rodent infestation and a termite infestation was observed on site.
SLO Municipal Code § 15.02.130, International Property Maintenance Code § 309.1:
Infestation. The property owner or authorized agent shall maintain all structures and premises on the
property free from insect, rodent and vermin infestation. Upon visual confirmation of an insect, rodent or
vermin infestation, the Code Official may require the owner or agent having charge or control of the
building, lot or premise to hire a licensed pest control operator or other qualified professional to inspect
the building, lot or premise and provide a written report verifying the presence and severity of such
infestation including in the report, a recommendation for proper extermination of the infestation.
Infestation may also be verified without a visual inspection upon receiving a recent written report from a
qualified pest control operator verifying the presence of an infestation. All structures in which insect,
rodent or vermin infestations are found shall be promptly exterminated by approved processes that will
not be injurious to human health. After the extermination of the infestation is complete, the Code Official
may request a written notice from the licensed exterminator or other qualified professional attesting to the
completion and success of the recommended extermination procedures. After the infestation is eliminated,
proper precautions shall be taken to prevent re-infestation. Tenants that contribute to pest related health
or sanitation nuisances may also be subject to the penalties found in Section 109.4 of this code.
Corrective Action: An inspection from a licensed, qualified pest control operator is required. Please
submit an inspection report and invoice showing all deficiencies listed in the report have been addressed.
We request that you voluntarily take action to correct the above noted violation(s) no later than May 18, 2024.
These violations constitute a public nuisance and must be abated. Failure to correct the violation(s) by the
specified date will result in the issuance of an Administrative Citation requiring payment of FINES in
accordance with SLOMC Chapter 1.24. For Municipal Code violations that remain uncorrected after issuance
of an Administrative Citation, the City may seek enforcement by other civil or criminal remedies.
Any person having a title interest in the property may request a Director’s review of this Notice by completing
the enclosed Request for Director’s Review Form and submitting it to the Community Development
Department via email at code@slocity.org or to 919 Palm Street, San Luis Obispo, CA 93406, within five (5)
days of the date of this Notice. This Notice shall be deemed final unless you timely file a Request for Director’s
Review.

discovered safety violation in the dilatated
rear wall. Upon returning to headquarters, I
consulted with John Mezzapesa about the
property. He informed me that a code case
was opened in 2017.

the case and addressed his safety concerns
in regards to the rear exterior wall.

(California-West Property manager). I
requested a professional inspection of the
foundation. I also requested that a pest
control company be hired abate termites and
rodents infestation.

to rectify the structural integrity of the rear

occupants inside the building, time frames and
anticipated longevity of the project, and
exchange of previous plans of the building
from 2017 finaled permit for foundational work
that was done at the time.
