CAO RECOMMENDATION Give final passage to Ordinance No. 1188 (1991 Series) , rezoning the parcel from Service Commercial (C-S) to High-density residential - Special Considerations (R-4-S) . DISCUSSION The attached ordinance was passed to print on March 19, 1991, along with adoption of a resolution amending the General Plan Land Use Map. SIGNIFICANT IMPACTS A negative declaration of environmental impacts, with mitigation, was granted by the director. The change is expected to have impacts on mass transit and the creek habitat. CONSEQUENCES OF NOT TARING THE RECOMMENDED ACTION If the ordinance is not passed, the amendments will not be implemented. The General Plan and Official Zoning Map would be in conflict. ATTACHMENT: Ordinance No . 1188 I ORDINANCE .NO. 1188 _ (1990 SERIES) AN ORDINANCE OF THE CITY OF SAN LUIS OBISPO AMENDING THE ZONING REGULATIONS MAP TO DESIGNATE A LARGE LOT AT 1090 ORCUTT ROAD AS HIGH-DENSITY RESIDENTIAL, WITH A SPECIAL CONSIDERATIONS OVERLAY (R-4-S) (GP/R 1505) WHEREAS, the City Council has held a hearing to consider the zoning map amendment request GP/R 1505; and WHEREAS,. the City Council makes the following findings; Findings: 1. The proposed zoning map amendment will not adversely affect the health, safety, or welfare of persons living or working in the vicinity. 2 . The map amendment is appropriate at the proposed location and will be compatible with surrounding land uses. 3 . The map amendment conforms to the general plan and meets zoning ordinance requirements. 4 . The Community Development Director has determined that the proposed map amendment will not have a significant effect on the environment and has granted a negative declaration of environmental impact. 5. The "Special Considerations" overlay zone is to require Planning Commission review of impacts on the creek, protection from noise, and affordability of the apartments. BE IT ORDAINED by the Council of the City of San Luis Obispo as follows: SECTION 1. The Zoning map amendment GP/R .1505 is hereby approved. . SECTION 2 . This ordinance, together with the names of councilmembers voting for and against, shall be published once in full, at least (3) days prior to its final passage, in the Telegram-Tribune, a newspaper published and circulated in this city. This ordinance shall go into effect at the expiration of thirty (30) days after its final passage.
