Tow Service Agreement
July 1 ,2025 to December 31 ,2026
This Tow Service Agreement (TSA) is between local San Luis Obispo tow companies and
the San Luis Obispo Police Department (SLOPD), to provide tow service to the City of San
Luis Obispe on a rotational basis. The above tow cornpany agrees to comply with the City
of San Luis Obispo Tow Service Agreernent in order to receive a rotation tow listing with
the San Luis Obispo Police Department. Participation in the SLOPD rotation tow program
is voluntary, Compliance with alL of the terms and conditions of the SLOPD Tow Service
Agreement is mandatory. At no time is an operator or employee of an approved tow
operator acting as an agent for the City of San Luis Obispo or the San Luis Obispo Police
Department while performing tow duties under this agreement. Failure to comply.with this
agreement will result in suspension or pennanent removai from the,SLOPD rotation tow list

I. RotationLists i,'.,
I
A. SLOPD shall establish and maintain two Rotation Tow lists:
l. Abatement Tow List
a. The Abatement Rotation Tow List will be utilized for respbnse
to abandoned vehicles, or parts thereof, and those being
removed by SLOPD under an abatementprocess.
2. General Rotation Tow List
a, The General Rotation Tow List will be utilized for all other
tows reque$ted by SLOPD
B. Both tow lists shall opetate independently and concurrently.
C. Participation on the Abatement Tow List shall,be a requirement for
participation on the General Tow List.Inclusion on this list shall be from
iuly. 1, 2025, until Decemb er 3 L, 2026, unle-ss.Qthegyise suspended or
terminated as provided in this agreement.

II. Tow Truck Classification
A. Tow vehicles shall be rated at a minimum of one ton capacity.
B. All tow kucks shall be equipped and maintained in accordance with the
provisions set forth in California Vehicle Code Title .13 of the California
Code of Regulations, and in a manncr consistent with industry standards and
practices. ,. i . ,,-,, ,C. Alt tow companies shall have trucks available with recovery capabilities,
wheel Iift capabilities, boom capabilities, and trailer towing/fifth wheel
capabilities. Car carriers may be used in addition to whecl lift tucks and are
not required to have wheel lift capabilities. All tow kucks used shall be
inspected and approved by local CHP in accordance with CFIP's
requirements.
UI. Inspections
A. The tow company management shall anange with CFIP for the inspection of
new or replacement tow vehicles within ten working days of receipt and
provide SLOPD with such documentation.
B. During a 30 day period following each subsequent year of operation, a
representative of SLOPD may inspect all tow truckf , !or,v drivers' oredentials;

C. Tow companies and drivers approved by the Califoriia Highway Patol will
be accepted by SLOPD provided that a documpnt ascertaining proof of CHF

Fees charged by the tow company shall be reasonable and not in excess of
those rates charged for similar services provided.in r€sponse to service
requests initiated by any other public agency or privqte person and shall

In the event a vehicle is impounded/stored, and it is later determined that it be
Iawfully released to an owner due to a legal otersight or mistake, the police
department rvill onty be responsible for towiqg fbrjs and the storage fee will
be waived.
VI. Response to Calls

they are either unable to respond or arc rinable to meet the minimum
response time. :
2. If, after accepting the call, the tow company is unabls to respond or
will be delayed, the tow company shall immediately notify SLOPD
Comrnunications.
3. Tow companies that are qualified for each list are dispatched on a
rotational basis. The rotation occurs with the tow company at the top
of each list. After a tow company is dispatched to a tow request, that
company is rotated to the bottom of the list to await rotation back to
the original position. This rotation policy is to ensure fair dispatching
of tow companies. No preference of any company is given when
determining stored or impound tows. ' ,
4. A tow company that fails to answer its telephone, is unable to
respond, is unable to perform the requitred sgrvice,.refuses to respond
or provide service, or is canceled due, tp rixcegsiveresponse time shall
be placed at the bottom of the rotatiouliSt. The-,tow compa4ymust.
then wait through the rotation for the next;service call. Failure to ;
respond or provide service may result in suspension from the rotation
list.
5. A tow company that fails to respond to an abatement tow request by
SLOPD will be held from the general tow list for a period of two
rotations.
6. If a request for a tow is canceled by SLOPD or the vehicle's owner
prior to the tow company taking possession of the vehicle, there shall
be no charge for the tow call. The tow company representative shall
contact the offrcer requesting the tow or dispatch directly and advise
them of the cancellation. The tow company requested sha[ be placed
back at the top of the rotation list.
7. In the event that an irnpound or abatempnt lglv is required for a heavy
the company performing the service.8. Failure to respond or to perform the required tow service, or hvo
failures to meet the maximum response time, may constitute a failure
to comply with the terms and conditions of this TSA, (Refer to section
xll. F).

VII. Storage Facility
The tow company agrees to be responsible for the safekeeping of any
property contained in towed or irnpounded vehicles.
Provisions shall be made by the tow company for adequate security of
vebicles and property at the place of storage.
l. At a minimum, a fenced or enclosed area shall be provided with
adequate security lighting during hours of darkness.
The tow company shall be responsible for any losses incurred while a vehicle
and any property therein are in the possession of the tow company.
Storage facilities shall provide for the timely release of vehicles and personal
properly on a 24-hour a day, 7-day a week basis.
1. Thc tow comparry shall provide SLOPD with the addresses of all
storage facilities.
VI[. Business Records
The tow company shall maintain records of all tow servioes furnished.
l. Tlie records shall be maintained at the place of business.
2. Invoices shall, at a minimum, include a description of each vehicle,
nature of service, start time, end time, location of call, itemized costs
of towing and storage, the tow tnrck driver's name, and kuck used.
3. Such records may be inspected by SLOPD at any time.
IX. Demeanor and Corrduct
While involved in a SLOPD rotation tow or related business, the tow
company and employees shall refrain from any acts of misconduct, including,
but not limited to, the following:
l. Rude or discourteous behavior
2. Lack of service, selective seruice or refusal to provide service which
the tow company is or should be capable of providing
3. Any act of sexual harassment or sexual impropriefy :
4. Unsafe driving practices
;5. Use of alcohol and/or illegal drugs
a. If a tow truck driver appears at the scene of a tow request with
the odor of an alcoholic beverage on his/her breath, the driver
shall submit to a preliminary alcohol screening device (PAS)
upon the requesc of SLOPD.
b. Any violations of California law to include DIII (driving
under the influence of any alcoholis beverage or drug) or any
alcohol related violations while performing the duties of a tow
service employee/driver shall pe grornds for immediate driver
suspension. Upon review, the,toyco,ryrpany may also be
suspended until the conclusion of the criminal investigation.
Any acts of misconductwill be grounds for suspension or removal from the

C.Minor traffrc violations by tow company drivers observed by any swom
officer may result in a verbal waming ortraffic citation. Tow truck
equipment violations will be addressed with the driver to inform their
employer and,/or citation. Any SLOPD sworn officer rnay give verbal order
to removc any tow truck from service that is decmed unsafe for operatiorr due
to an equipment violation upon observation oT'the violation. The tow
company may be allowed back in scrvice only when the violation is
corrected.
All SLOPD related tow service complaints received by SLOPD against the
tow company or tow company's employees will bc investigated by SLOPD.
Investigations rvill be conducted in a fair and impartial manner. Results of
any inv-estigation will be preserrted to the SLOPD Traffic Sergeant in
memorandum or report form, citing recommendations. The tow company in
question will be informed of the results of the investigation verbally or in
writing.
Any investigation that may result in the filing of criminal charges with the
District Attorney shall be investigated by SLOPD as assigned by the Traffrrc
Sergeant or Watch Comnrander, SLOPD may request the assistance of the
CHP and/or District Attomey's Office during any such investigation.

X. Conrpliance with the Law

.A. Each tow rrehicle shall be maintained in comp,liance;pith the provisions of
Vehicle Code sections 24605, 25253,27700, and any other Federal, State, or
Local laws or ordinances pertaining to the opgq4tion'of su-ch businesses. :B. The tow company shall maintain proper insur.4nce in,,compliance with
r6s00.5 vc. . :C. The tow company shall comply with all City and County ordinances relevant
to licensing and zoning requirements.
D. The tow company shall comply with 10652 VC in reporting the storage of
vehicles over 30 days.
E. The tow conpany shall be able to properly conduct a lien sale as outlined in
SLO City Municipal Code, and Division 11, Chapter 10, Article 2, Section
22851, et seq. of the Califomia Vehicle Code.
XL Compliance with the TSA
A.The tow company agrees, as a condition of iriclusion,on the Rotation Tow
List to comply with the terms and conditions of !he. TSA. Furthermore, the
tow company agrees that failure by the tow cogrpany,or their agents to
comply with these terms and conditions shall be cauSe for rwitten reprimand,
suspension, or termination ftom the SLOPD Rotation Tow List.
XII. Sanctions
A,The SLOPD, under the direction of the SLOPD',Traf{ic $ergeant,
representing the Chicf of Police for the San Luls Obispo Police Departmcnt,
shall investigate and recommend any sanctiond.against tow cornpanies for ..:i.
violations of law and./or the Tow Scrvice Agreot.I}en{j i
B A violation of this Tow Service Agreement, State, Federal, and local
ordinances shall be cause for suspension fronr the SLOPD rotation tow list.
Any misconduct, unprofessional behavior or on-duty alcohol violations shall
be cause for suspension ftom the SLOPD rotation tow list.
Any safety violations, whether equipment neglect, use, or driver/employee
related in accordance with the vehicle code, or this Tow Service Agreement
shall be cause for suspension from the SLOPD rotation tow list.
The duration of the suspcnsion shall be at the determination of the Traffic
Sergeant. Severe violations of any of the ab.q,v or;:severe violations of law
by a tow company operator, driver, manager,. anil..Q.{,employee shalt be cause
for permanent removal from the SLOPD rotaJlpptowJist., ,. ; ;

Sanctions for minor violations of the terms and conditions of this Tow
Service Agreetnent anilor minor violations of law within a l2-month period
may be handled using the following as guidelines:

The above disciplinary actions are guidelineB only gnd can be overridden by
order of the Chief of Police. There is no {'Sfatute ,of limitations" for any

Written appeals of sanctions may be suUrr,ritted to the Traffrc Serge.4pt
requesting a hearing within five (5) workiSrg days of written notice of
sanction(s). If a hearing is requested, it shall be held as soon as possible.
The hearing is to be held by the Traffrc sergeant. The tow company
representative will be allowed to present all relevant facts and circumstances
in support of the tow company's position. The tow company representative
shall be allowed to present testimony of at least one (1) qualified person. The
tow company will be rrotified in writing of the results of the hearing within
five (5) working days. Appeals regarding the decision of that hearing will be
heard by the Administrative Lieutenant. The frndings of the Adminishative

H.Any sanctions implerncnted by the CHP for violations of the CHP Tow
Service Agreement by a tow company on the SLOPD rotation tow list, will
be reviewed by SLOPD for possible suspension or removal from the SLOPD
rotation tow list, on a case-by-case basis.
Xm. Advertising
The tow company shall not display any sign or engage in any advertisement
indicating an official or unofficial connection with SLOPD.
XIV. Cancellation
Notwithstanding disciplinary actions described herein, this TSA may be
canceled by either party without cause by giving writtcn notice to the otherparty. | :
The undersigned, as a representative of the indicated tow company, agrees to comply with
all of the terms of this tow agreement as a condition of inclusion on the San Luis Obispo
Police Department's Rotation Tow Lists.
Furthermore, the undersigned agrees that any failure to comply with any of the terms ofthis
agreement by anyone acting as an agent of the tow company shall be cause for suspension or
rernoval of that compauy from the San Luis Obispo Police Departnrent's Rotation Tow
Lists.
