This Tow Service Agreement (TSA) is between local San Luis Obispo tow companies and
the San Luis Obispo Police Department (SLOPD), to provide tow service to the City of San
Luis Obispo on a rotational basis. The above tow company agrees to comply with the City
of San Luis Obispo Tow Service Agreement in order to receive a rotation tow listing with
the San Luis Obispo Police Department. Participation in the SLOPD rotation tow program
is voluntary. Compliance with all of the terms and conditions of the SLOPD Tow Service
Agreement is mandatory. At no time is an operator or employee of an approved tow
operator acting as an agent for the City of San Luis Obispo or the San Luis Obispo Police
Department while perfonning tow duties under this agreement. Failure to comply with this
agreement will result in suspension or pelmanent removal from the SLOPD rotation tow list.
This Tow Service Agreement is in conjunction with the Califomia Highway Patrol (CHP)
Tow Service Agreement.
I. Rotation Lists
A. SLOPD shall establish and maintain two Rotation Tow lists:
l. Abatement Tow List
a. The Abatement Rotation Tow List will be utilized for response
to abandoned vehicles, or pafts thereof, and those being
removed by SLOPD under an abatement process.
2. General Rotation Tow List
a. The General Rotation Tow List will be utilized for all other
tows requested by SLOPD
B. Both tow lists shall operate independently and concurrently.
C. Participation on the Abatement Tow List shall be a requirement for
participation on the General Tow List. Inclusion on this list shall be from
luty. t, 2025,until December 31, 2026,unless otherwise suspended or
terminated as provided in this agreement.
II. Tow Truck Classification
A. Tow vehicles shall be rated at a minimum of one ton capacity'
B. All tow trucks shall be equipped and maintained in accordance with the
provisions set forth in California Vehicle Code Title 13 of the California
Code of Regulations, and in a manner consistent with industry standards and
practices.
C. All tow companies shall have trucks available with recovery capabilities,
wheel lift capabilities, boom capabilities, and trailer towing/fifth wheel
capabilities. Car carriers may be used in addition to wheel lift trucks and are
not required to have wheel lift capabilities. All tow trucks used shall be
inspected and approved by local CHP in accordance with CHP's
requirements.
Itr. Inspections
A. The tow company management shall arrange with CHP for the inspection of
new or replacement tow vehicles within teh working days of receipt and
provide SLOPD with such documentation.
B. During a 30 day period following each subsequent year of operation, a
representative of SLOPD may inspect all tow trucks, tow drivers' credentials;
and proof of insurance in compliance with 16500.5 VC.
C. Tow companies and drivers approved by the California Highway Patrol will
be accepted by SLOPD provided that a document ascertaining proof of CHP
acceptance is provided to SLOPD.
IV. Tow Truck Drivers
Tow truck drivers shall be properly licensed in accordance with 12500-15326
VC.
The tow company management and drivers shall be capable of ensuring the
safe and proper discharge of their service responsibilities.

Fees charged by the tow company shall be reasonable and not in excess of
those rates charged for similar services provided in response to service
requests initiated by any other public agency or private person and shall
conform to the requirements of CVC 22651.07 and other local, state and
federal laws regarding fees and the disclosure of fees.
In the event a vehicle is impounded/stored, and it is later determined that it be
lawfully released to an owner due to a legal oversight or mistake, the police
department will only be responsible for towing fees and the storage fee will
be waived.
VI. Response to Calls
The tow company shall respond to calls 24 hours a day, 7 days a week.
A maximum response time of 20 minutes shall be strictly adhered to.

The tow company shall inform SLOPD at the time of notification if
they are either unable to respond or are unable to meet the minimum
response time.
If, after accepting the call, the tow company is unable to respond or
will be delayed, the tow company shall immediately notify SLOPD
Communications.
Tow companies that are qualified for each list are dispatched on a
rotational basis. The rotation occurs with the tow company at the top
of each list. After a tow company is dispatched to a tow request, that
company is rotated to the bottom of the list to await rotation back to
the original position. This rotation policy is to ensure fair dispatching
of tow companies. No preference of any company is given when
determining stored or impound tows.
A tow company that fails to answer its telephone, is unable to
respond, is unable to perform the required service, refuses to respond
or provide service, or is canceled due to excessive response time shall
be placed at the bottom of the rotation list. The tow company must
then wait through the rotation for the next service call. Failure to
respond or provide service may result in suspension from the rotation
list.
A tow company that fails to respond to an abatement tow request by
SLOPD will be held from the general tow list for a period of two
rotations.
If a request for a tow is canceled by SLOPD or the vehicle's owner
prior to the tow company taking possession of the vehicle, there shall
be no charge for the tow call. The tow company representative shall
contact the officer requesting the tow or dispatch directly and advise
them of the cancellation, The tow company requested shall be placed
back at the top of the rotation list.
In the event that an impound or abatement tow is required for a heavy
duty or oversized/overweight vehicle, and the tow company at the top
of the rotation list does not have an appropriate truck to tow that
vehicle, SLOPD may request the appropriate tow truck from a
different tow company to tow the oversized/overweight vehicle to the
tow yard of the company that was originally requested. The cost of
the tow will be bilted to the company that was originally requested by
the company performing the service.
Failwe to respond or to perform the required tow service, or two
failures to meet the maximum response time, may constitute a failure
to comply with theterms and conditions of this TSA, (Referto section
xrr. F).
The tow company agrees to be responsible for the safekeeping of any
property contained in towed or impounded vehicles.
Provisions shall be made by the tow company for adequate security of
vehicles and property at the place ofstorage.

1. At a minimum, a fenced or enclosed area shall be provided with
adequate security lighting during hours of darkness.
C. The tow company shall be responsible for any losses incuned while a vehicle
and any property therein are in the possession of the tow company.
D. Storage facilities shall provide for the timely release of vehicles and personal
property on a 24-hour a day, 7'day a week basis'
1. The tow company shall provide SLOPD with the addresses of all
storage facilities.
VIII. Business Records
A The tow company shall maintain records of all tow services fumished.
1. The records shall be maintained at the place of business.
2. Invoices shall, at a minimunr, include a description of each vehicle,
nature of service, start time, end time, location of call, itemized costs
of towing and storage, the tow truck driver's name, and truck used.
3. Such records may be inspected by SLOPD at any time.
IX. Demeanor and Conduct
While involved in a SLOPD rotation tow or related business, the tow
company and employees shall refrain from any acts of misconduct, including,
but not limited to, the following:
l. Rude or discourteous behavior
2. Lack of service, selective service or refusal to provide service which
the tow company is or should be capable of providing
3. Any act of sexual harassment or sexual impropriety
4. Unsafe driving practices
5. Use of alcohol andlor illegal drugs
a. If a tow truck driver appears at the scene of a tow request with
the odor of an alcoholic beverage on his/her breath, the driver
shall submit to a preliminary alcohol screening device (PAS)
upon the request of SLOPD.
b. Any violations of Califomia law to include DUI (driving
under the influence of any alcoholic beverage or drug) or any
alcohol related violations while performing the duties of a tow
service employee/driver shall be grounds for immediate driver
suspension. Upon review, the tow company may also be
suspended until the conclusion of the criminal investigation.
Any acts of misconduct will be grounds for suspension or removal from the
SLOPD rotation list.
Minor traffic violations by tow company drivers observed by any swom
officer may result in a verbal waming or traffic citation. Tow truck
equipment violations will be addressed with the driver to inform their
empioyer and/or citation. Any SLOPD swom officer may give verbal order
to remove any tow truck from service that is deemed unsafe for operation due
to an equipment violation upon observation of the violation. The tow

company may be allowed back in service only when the violation is
corrected.
AU SLOPD related tow service complaints received by SLOPD against the
tow company or tow company's employees will be investigated by SLOPD.
Investigations will be conducted in a fair and impartial manner. Results of
any investigation will be presented to the SLOPD Tiaffic Sergeant in
memorandum or report form, citing recommendations. The tow company in
question will be informed of the results of the investigation verbally or in
writing.
Any investigation that may result in the filing of criminal charges with the
District Attomey shall be investigated by SLOPD as assigned by the Traffic
Sergeant or Watch Commander. SLOPD may request the assistance of the
CHP and/or District Attomey's Office during any such investigation.

Compliance with the Law
A. Each tow vehicle shall be maintained in compliance with the provisions of
' Vehicle Code sections24605,25253,27700, and any other Federal, State, or
Local laws or ordinances pertaining to the operation of such businesses.
B. The tow company shall maintain proper insurance in compliance with
16s00.5 vc.
C. The tow company shall comply with all City and County ordinances relevant
to licensing and zoning requirements.
D. The tow company shall comply with 10652 VC in reporting the storage of
vehicles over 30 days.
E. The tow company shall be able to properly conduct a lien sale as outlined in
SLO City Municipal Code, and Division 11, Chapter 10, Article 2, Section
22851,, et seq. of the Califomia Vehicle Code.
Compliance with the TSA
A. The tow company agrees, as a condition of inclusion on the Rotation Tow
List to comply with the terms and conditions of the TSA. Furthermore, the
tow company agrees that failure by the tow company or their agents to
comply with these terms and conditions shall be cause for written reprimand,
suspension, or termination from the SLOPD Rotation Tow List.
XII. Sanctions
The SLOPD, under the direction of the SLOPD Traffic Sergeant,
representing the Chief of Police for the San Luis Obispo Police Department,
shall investigate and recommend any sanctions against tow companies for
violations of law and/or the Tow Service Agreement.
A violation of this Tow Service Agreement, State, Federal, and local
ordinances shall be cause for suspension from the SLOPD rotation tow list.

be cause for suspension from the SLOPD rotation tow list.
Any safety violations, whether equipment neglect, use, or driver/employee
related in accordance with the vehicle code, or this Tow Service Agteement
shall be cause for suspension from the SLOPD rotation tow list.
The duration of the suspension shall be at the determination of the Traffic
Sergeant. Severe violations of any of the above or severe violations of law by
a tow company operator, drivero manager, and/or employee shall be cause for
permanent removal from the SLOPD rotation tow list.
Sanctions forminor violations of the terms and conditions of this Tow Service
Agreement and/or minor violations of law within a l2-month period may be
handled using the following as guidelines:

probationary period

4th Violation.........termination from SLOPD rotation tow list
The above disciplinary actions are guidelines only and can be overridden by
order of the Chief of Police. There is no 'ostatute of limitations" for any
violation which occurs underthis contract. Any violation may be sanctioned at
any time under this contact.
Written appeals of sanctions may be submitted to the Traffic Sergeant
requesting a hearing within five (5) working days of written notice of
sanction(s). If a hearing is requested, it shall be held as soon as possible. The
hearing is to be held by the Traffic Sergeant, The tow company representative
will be allowed to present all relevant facts and circumstances in support of the
tow company's position. The tow company representative shall be allowed to
present testimony of at least one (1) qualified person. The tow company wiil
be notified in writing of the results of the hearing within five (5) working days.
Appeals regarding the decision of that hearing will be heard by the
Administrative Lieutenant. The findings of theAdministrative Lieutenant will
be final.
Any sanctions implemented by theCHP forviolations of theCHP Tow Service
Agreement by a tow company on the SLOPD rotation tow list, will be reviewed
by SLOPD for possible suspension or removal from the SLOPD rotation tow
list, on a case-by-case basis.

XtrI. Advertising
The tow company shall not display any sign or engage in any advertisement
indicating an official or unofficial connection with SLOPD.
A.
XIV. Cancellation
A. Notwithstanding disciplinary actions described herein, this TSA may be
canceled by either party without cause by giving written notice to the other
party.
The undersigned, as a representative of the indicated tow company, agrees to comply with
all of the terms of this tow agreement as a condition of inclusion on the San Luis Obispo
Police Department's Rotation Tow Lists.
Furthermore, the undersigned agrees that any failure to comply with any of the terms of this
agreement by anyone acting as an agent of the tow company shall be cause for suspension or
removal of that company from the San Luis Obispo Police Department's Rotation Tow
Lists.
