A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN LUIS
OBISPO, CALIFORNIA, AMENDING THE CITY’S COMPREHENSIVE
FEE SCHEDULE WITH UPDATES TO CERTAIN USER AND
REGULATORY FEES PREVIOUSLY ADOPTED BY THE CITY COUNCIL
ON JULY 2, 2024 AND AUTHORIZING STAFF TO ISSUE REFUNDS TO
CUSTOMERS FOR FEES PAID SINCE OCTOBER 1, 2024, WHERE THE
FEE IS RECOMMENDED TO BE REDUCED.
WHEREAS, it is the City’ s policy (City’s User Fee Cost Recovery Goals - Financial
Plan Section 2) to review and update service charges approximately every three years to
adjust to changes in the cost- of-living and changes in methods/ levels of service delivery;
and
WHEREAS, on June 23, 2015, the City Council adopted Resolution No. 10640
(2015 Series) authorizing the City Manager to update the City’s Comprehensive Fee
Schedule to reflect increases based on the annual change in the Consumer Price Index;
and
WHEREAS, a User and Regulatory Fee Study was prepared by MGT Consulting
Group dated May 17, 2024; and
WHEREAS, public outreach was conducted throughout the months of February
through June 2024 pursuant to the City’s Public Engagement and Noticing Manual, which
included several engagement meetings and an Open City Hall web page; and
WHEREAS, on July 2, 2024, the City Council held a public hearing to review the
Fee study and adopted Resolution No. 11507 to adopt the revised Citywide User and
Regulatory Fees; and
WHEREAS, the FY 2024-25 Comprehensive Fee Schedule went into effect on
October 1, 2024; and
WHEREAS, staff adjusted the Comprehensive Fee Schedule effective July 1, 2025,
based on the annual change in the Consumer Price Index, consistent with the authority
delegated to the City Manager in the City’s fiscal policy related to User Fee Cost Recovery,
Resolution No. 10640, and Resolution No. 11507; and
WHEREAS, staff has identified a need to amend the current Comprehensive Fee
Schedule; and

WHEREAS, staff has identified a need to not apply the ‘Outdoor Assembly Event
> 1,000 participants’ fee and the ‘Reserved Parking Space Program - Daily Per Space
Rate’ fee for events where the applicant/organizer is a designated 501c(3) nonprofit
organization in order to support the cultural vibrancy and economic vitality of the Cit y,
staff; and
WHEREAS, staff has determined that refunds for overbillings due to administrative
errors on the Comprehensive Fee Schedule should be made to customers who paid fees
beginning on October 1, 2024, where fees are recommended to decrease.
NOW, THEREFORE, BE IT RESOVLED by the City Council of the City of San Luis
Obispo as follows:
SECTION 1. Findings. The City Council makes the following findings:
1. That the above recitals are true and correct.
2. That the updated user and regulatory fees set forth in Exhibit 1 do not exceed
the estimated actual, reasonable cost of providing the service or performing
the activity for which the fee is imposed.
3. That the changes to the fees set forth in Exhibit 1 do not reflect an increase to
existing fees.
4. That the ‘Outdoor Assembly Event > 1,000 participants’ fee and the ‘Reserved
Parking Space Program – Daily Per Space Rate’ fee should not be applied to
events where the applicant/organizer is a designated 501c(3) nonprofit
organization in order to support the cultural vibrancy and economic vitality of
the City.
5. That refunds for overbillings due to administrative errors on the Comprehensive
Fee Schedule should be made to customers who paid fees beginning on
October 1, 2024, where fees are recommended to decrease.

SECTION 2. Action. The City Council amends the City’s Comprehensive Fee
Schedule to include changes to user and regulatory fees as provided in Exhibit 1 attached
hereto. All prior resolutions inconsistent herewith are hereby superseded. The updated fees
shall take effect October 8, 2025.

the following roll call vote:
AYES: Council Member Boswell, Francis, Marx, Vice Mayor Shoresman,
and Mayor Stewart
