Cox, Streets 'f4anager Tony Heller, Sidewa�Ck Inspector SUBJECT: Curb, gutter and si walk improvements where more than 50% of the blo .kk is already improved CAO RECOMMENDATION: By motion, after making modifications desired, direct staff to proceed I. BACKGROUND: Resolution No. 6031 (1986 Series) cabs for the staff to bring to Council attention those properties where more than 50% of the frontage of a block has been improved, thereby meeting 1911 Act criteria for completion of improvements within a block. Provisions of the 1911 Act call for a public hearing when the legislative body will=hear and pass on objections or protests raised by tlie., property owner or other interested parties. At the public hearing, the Council may make those adjustments it feels are appropriate. A staff survey of sidewalk improvementp. within the community resulted in the list shown on Exhibit "A" and I%bnt footage calculations as shown on Exhibit "B". In 1977, staff requested that properti®s at 662 and 670 •0sos Street be installed under a Public Convenience and Necessity requirement for that block (Exhibit C) . The City Council, by Resolution No. 3257 (1977 Series) , determined that these properties ". : .be exempted. only from the requirements to construct sidewalks for- an indefinite •pei-iod". This is now the only block of uncompleted sidewalk in the area, and staff is bringing the matter back to the CounciV--hue to a citizen request. PISCAL IMPACT: Estimated costs to property owners rang from. $594•=ten$$:,923, depending on the extent of work required. If the roperty:owner does not complete the required improvements withth the time':alloged by the 1911 Act, the City will contract for the work-and assess theeproperty owner, who may reimburse the City in full or iii three .annuaf. installments. If the property owner does not pay in cash or opt for--a.-I,year payment, the assessment becomes a lien against the property.,cellectible with property taxes. Because past reimbursements will pay for abdut=$60;0Q0eof new work each year, staff tries to limit the cost of annual reimbutkable sidewalk work to that amount. For this project the .total -astimated cost is $55,707, which in turn is the potential maximum amaantbwhich might be paid in installments. Because about 70ypereent :ofapsoperty owners usually either perform the work themselves or--pay.-their assessments in full, the actual amount financed for in1;ta11ment_pa1mbsts will probably be about $16,700, well within the $60, 000 limit. These costs will be paid from the sidewalk repair account in the streets/general program. PetersoS(Z' RE: Osos Street between Peach and Walnut As we discussed several weeks ago, the Traffic Committee has requested that we do all that we- can to increase the available travel width of Osos Street in this block. I have reviewed the block and found that the biggest problem occurs at 662 Osos and 670 Osos. At this location there appears to be a wall at the edge of pavement and a very steep bank which forces cars to park out in the street more than they normally would. Is there a possibility that you could enforce the installation of sidewalks in front of these two residences during your next program. Such an installation would help the problem considerably. If not, we will have to consider restricting parking at least in front of the two residences. WAP:js cc-Chief Rodgers RESOLUTION NO. 3257 (1977 Series) A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO DETERMINING .THAT PUBLIC CON- VENIENCE AND NECESSITY REQUIRE CONSTRUCTION OF CERTAIN IMPROVEMENTS . BE IT RESOLVED by the Council of. the City of San Luis Obispo as follows: Section 1. Pursuant to hearings duly held, the Council of.. the City of San Luis Obispo hereby finds and determines that the public convenience and necessity require the construction and installation of curbs, gutters, sidewalks and driveway ramp improvements on those portions of streets within the City of San Luis Obispo as set forth on Exhibit "A" attached hereto and incorporated by reference, and determines that the Special Assess- went, Investigation, Limitation and Majority Protest Act of 1931 shall not apply to these proceedings. r Section 2. The Council has considered the request of Castle Naumu that property located at 761 Morro Street be exempted from the requirement to construct sidewalk and driveway ramp and has determined that said requirement may be delayed fora one-year period and has further determined that property located at 662 and 670 Osos Street be exempted only from the requirement to construct sidewalks for an indefinite period. Section 3. The Superintendent of Streets shall proceed with the required notification and construction as set forth in Section 7350.1(f) of the San Luis Obispo Municipal Code. Section 4 . The costs of any such work done by the City, after hearings duly held, shall become a lien upon said parcels.
