Subject:Item 7d, Appeal of Conditional Use Permit Revocation
Dear Mayor Stewart and Members of the Council,
Recommend you uphold staff’s recommendation to deny Appellant’s appeal and uphold the Planning
Commission’s revocation of their Conditional Use Permit (CUP).
First and foremost 1236 Monte Vista Place is in a residential neighborhood where members of a fraternity
are allowed to reside. Unfortunately, the Appellant has taken this to mean that they can host large, noisy
parties during the day and at night without regard to how they affect other residents of the neighborhood
- both student and permanent residents.
The Appellants knew their appeal would go before the City Council some time this academic year, yet they
held a party on September 11th that disturbed neighbors enough to call SLOPD, and another on October
4th for which they received a citation. One would think with an appeal pending they would be extra
careful not to disturb their neighbors.
Appellants appear to think they can use their residence as an event location and, as long as they keep
their noise citations below three, continue to hold large, noisy parties. They suggested a modification to
Condition 2 of the Draft CUP that, after two citations within 12 months, they would develop/submit a plan
on how they will prevent future violations. If they really intended to “mend their ways” they 1) would not
have hosted parties this academic year until after their appeal was heard, and 2) they would already have
developed said plan.
Appellants also suggested a new condition that they “shall have a community service program with no less
than three such events per year.” Presumably no Special Use Permit from the Community Development
Department would be required if this condition were to be added. Also it appears they intend to hold
these events in the neighborhood, otherwise this condition would not be needed. Community service
events is a very broad term which could include on-site charity events as opposed to “gather here to leave
for a beach clean-up event.” Charity events have been held in the neighborhood during the day -
with individuals buying tickets and profits going to the designated charity. Such events can include live
bands, a water slide and other disruptive, noise-producing activities.
It is time that Cal Poly fraternities began using third-party venues to hold their events, and using their
dwellings as a place to reside.
For the reasons provided to the Planning Commission verbally and in writing as well as staff’s
recommendation and the comments provided above, recommend Appellant’s appeal be denied, thus
upholding the Planning Commission’s decision to revoke Appellant’s CUP.
