RECOMMENDATIO N
1.Adopt a Resolution calling for, and giving notice of, a General Municipal Election o n
Tuesday, November 6, 2012, and adopting regulations pertaining to candidates '
statements .
2.Adopt a Resolution requesting that the San Luis Obispo County Board of Supervisor s
consolidate the November 6, 2012, General Municipal Election with the Statewid e
General Election to be held on that date .
DISCUSSIO N
Backgroun d
Pursuant to Section 302 of the City Charter, the City's General Municipal Election to fill electiv e
offices shall be held on the first Tuesday, after the first Monday, in November of even-numbere d
years . California Election Code establishes procedures and requirements for conducting a Genera l
Municipal Election . In addition, State Elections Code § 13307 contain provisions related to th e
printing, distribution and estimated costs of candidates' statements in the ballot pamphlet .
Resolution s
Two resolutions are necessary to facilitate the City's November 6, 2012, General Municipa l
Election .
1.Calling the Election .The resolution calling the election includes provisions related t o
candidates' statements . In particular, Section 2 of the resolution allows for the filing of up to a 200 -
word candidate's statement and Section 3 of the resolution includes language requiring that
candidates pay for the inclusion of their candidate's statement in the ballot pamphlet . The County's
estimate for printing candidate statements in the ballot pamphlet is $389 for English and $489 fo r
Spanish statements.
2.Requesting Consolidation .The resolution requesting consolidation allows the City t o
combine its election with the statewide election and avoid duplication of printing and mailing o f
sample ballots, computer tabulation, precinct workers and canvassing results . Other requirements ,
including additional advertising by the City as called for in the City's Election Campaign
Regulations, will be performed by the City Clerk . All filings, including Candidates' Statements o f
Qualifications, Statements of Economic Interests, and Campaign Disclosure Statements,will be

processed through the City Clerk's Office .
FISCAL IMPAC T
The cost of the election will be influenced by the number of candidates filing for elected office .
The County Clerk provided the City with a cost estimate of $41,115 which includes the cost fo r
mail-in ballots that now have to be covered by the cities and the potential costs of adding up to tw o
ballot measures . The City Clerk budget currently has $37,500 available to cover the election cos t
and the Financial Plan Supplement includes a Significant Operating Change request of $6,000 t o
cover the new cost to the City that used to be paid for by the State of California .

CITY OF SAN LUIS OBISPO CALLING AND GIVING NOTICE OF TH E
HOLDING OF A GENERAL MUNICIPAL ELECTION TO BE HEL D
TUESDAY, NOVEMBER 6, 2012, FOR THE ELECTION OF CERTAI N
OFFICERS AS REQUIRED BY THE PROVISIONS OF THE CITY CHARTE R
AND ADOPTING REGULATIONS FOR CANDIDATES' STATEMENT S
WHEREAS,under the provisions of the San Luis Obispo City Charter Section 302,a
General Municipal Election shall be held on Tuesday, November 6, 2012, for the election o f
Municipal Officers ;
NOW, THEREFORE, BE IT RESOLVED that the Council of the City of San Lui s
Obispo does declare, determine and order as follows :
SECTION 1 .Pursuant to Section 302 of the City Charter, a General Municipal Electio n
shall be held Tuesday, November 6, 2012, for the purpose of electing a Mayor for the full term o f
two years and two Council Members for the full term of four years each .
SECTION 2 .Pursuant to Election Code Section 13307, each candidate may submit wit h
the nomination papers a Statement of Qualifications of the candidate of no more than 200 words ,
which statement will be printed and mailed out with the sample ballot .
SECTION 3 .The candidate shall be required to pay for the cost of printing the candidate's
statement in the voters' pamphlet . The City Clerk shall estimate the total cost of printing, handling ,
and mailing the candidates' statements filed pursuant to this section, and require each candidat e
filing a statement to pay in advance to the City his or her estimated pro rata share as a condition o f
his or her statement in the voters' pamphlet . Accordingly, the City Clerk is not bound by th e
estimate and may, on a pro rata basis, bill the candidate for any additional actual expense or refund
any excess amount paid depending on the final actual cost . Said amount will include the cost for th e
translation and printing in the voters' pamphlet the statement in Spanish, if requested by the
candidate . In the event of overpayment, the Clerk shall prorate the excess amount among th e
candidates and refund the excess amount paid within 30 days following notification by the Registra r
of Voters office of the exact cost .
SECTION 4 .That the ballots to be used at the election shall be in form and content a s
required by law .
SECTION 5 .That the polls shall be open at seven o'clock a .m. of the day of the electio n
and shall remain open continuously from that time until eight o'clock p .m . of the same day when
the polls shall be closed, except as provided in Section 14401 of the Elections Code of the Stat e
of California .
SECTION 6 .That the City Clerk shall certify to the passage and adoption of thi s
resolution .

COUNTY BOARD OF SUPERVISORS TO CONSOLIDATE TH E
GENERAL MUNICIPAL ELECTION ON TUESDAY,
NOVEMBER 6, 2012, WITH THE STATEWIDE GENERA L
ELECTION TO BE HELD ON THAT DAT E
WHEREAS,the City Council of the City of San Luis Obispo has called a Genera l
Municipal Election to be held on November 6, 2012, for the purpose of the election of a Mayor and
two Members of the City Council ; an d
WHEREAS,Section 302 of the City Charter establishes November of even-numbere d
years as the date for conducting the City's General Municipal Election; and
WHEREAS,it is desirable that the General Municipal Election be consolidated with th e
Statewide General Election to be held on the same date and that within the City the precincts ,
polling places and election officers of the two elections be the same, and that the County Electio n
Department of the County of San Luis Obispo canvass the returns of the General Municipa l
Election and that the election be held in all respects as if there were only one election ;
NOW, THEREFORE, BE IT RESOLVED that the Council of the City of San Lui s
Obispo does declare, determine and order as follows :
SECTION 1 .Pursuant to the requirements of the Section 10403 of the Elections Code, th e
Board of Supervisors of the County of San Luis Obispo is hereby requested to consent to and orde r
the consolidation of the General Municipal Election with the Statewide General Election to be hel d
on Tuesday, November 6, 2012 for the purpose of the election of a Mayor and two Members of th e
City Council .
SECTION 2 . The Board of Supervisors is requested to certify the results of the canvass o f
the returns of the General Municipal Election to the Council of the City of San Luis Obispo,which
shall thereupon declare the results thereof .
SECTION 3 .The Board of Supervisors is hereby requested to issue instructions to th e
County Clerk and Registrar of Voters to take any and all steps necessary for the holding of sai d
General Municipal Election . The City will pay its pro rata share of extra costs incurred by th e
County in consolidating the elections pursuant to Section 51350 of the Government Code .
SECTION 4 .The City Clerk is hereby directed to file certified copies of this resolutio n
with the Board of Supervisors, the County Clerk and the Registrar of Voters of the County of Sa n
Luis Obispo.
