To:Advisory Bodies Subject:Subject: Items 4a and 4b Dear Chairman and Planning Commission Members, Residents for Quality Neighborhoods (RQN) strongly recommends that the Conditional Use Permits (CUP) for Delta Chi and Sigma Nu be revoked. The parties/events these fraternities host disrupt residents ofnot onlythe neighborhood in which they are located, but also residents of adjacent neighborhoods. In addition to theloud music and “people noise” from the property, there isalso noise from loud conversations of groups of, sometimes inebriated, individuals walking to andfrom their parties. Both Delta Chi and Sigma Numembers have demonstrated over the years an unwillingness toabide by the city’scodes, violating both noise and property codes. They routinely show alack respect for their neighbors by hosting large, loud parties/events. Citations have been ineffective to control the noise and conduct. Even the March 19, 2025, Notice of Violation of their Conditional UsePermit did not remediate Delta Chi’sbehavior as evidenced by the April 18, 2025, noise citation they received. Nor did theApril 2, 2025, Notice of Violation of their Conditional Use Permit remediate Sigma Nu’sbehavior as evidenced by the May11, 2025, noise citation they received. For these reasons and based upon their years of noncompliance, wedo not anticipate that modifications to their Conditional Use Permits will result inany behavioral changes, thus our recommendation to revoke these permits. IF, however, you decide to retain and modify their Conditional Use Permits, westrongly recommend the following changes: 1. Reduce the number of citations required for automatic review in a 12-month period from three (3) to two (2). Fraternities do not receive Disturbance Advisement Cards (DAC’s) so the first citation is actually their official warning. In addition, SLOPD officers often issue verbal warnings. Oneofficial warning should be sufficient since most residents never receive a noise citation. 2. Include as aseparate sentence: "Ausepermit shall be reviewed within “x” number of months (add time-frame) ifany reasonable written citizen or Police orFire Department complaint isreceived bythe city." Atime-frame isneeded to ensure timely review of the complaint. 3. Add the following as aseparate condition: 'In accordance with paragraph 9-12-010 B. of the Municipal Code anoise violation isconsidered apublic nuisance."
