CLOSED SESSION (5:00 PM to 5:30 PM) 1.a CALL TO ORDER Mayor Erica A. Stewart called the Closed Session of the San Luis Obispo City Council to order at 5:00 p.m. in the Council Hearing Room at City Hall,990 Palm Street, San Luis Obispo with all members present. 1.b CONFERENCE WITH REAL PROPERTY NEGOTIATORS ACTION: City Attorney Christine Dietrick indicated the Council provided staff with negotiating parameters, but no further reportable action was taken. 1.c ADJOURNMENT Closed Session was adjourned at 5:26 PM. 2. CALL TO ORDER A Regular Meeting of the San Luis Obispo City Council was called to order on November 18, 2025 at 5:30 p.m. in the Council Chambers, 990 Palm Street, San Luis Obispo, by Mayor Stewart with all Council Members present. 3. PLEDGE OF ALLEGIANCE Council Member Marx led the Council in the Pledge of Allegiance. 4. PRESENTATIONS Mayor Stewart presented a proclamation declaring November 16 through November 22, 2025 as Restorative Justice Week to Sister Theresa.Harpin. Ayes (5): Council Member Boswell, Council Member Francis, Council Member Marx, Vice Mayor Shoresman, and Mayor Stewart CARRIED (5 to 0) 6.a WAIVE READING IN FULL OF ALL RESOLUTIONS AND ORDINANCES Waive reading of all resolutions and ordinances as appropriate. 6.b MINUTES REVIEW - OCTOBER 28, 2025 AND NOVEMBER 4, 2025 COUNCIL MINUTES Page 16 of 764 3 Approve the minutes of the City Council meeting held on October 28, 2025 and November 4, 2025. 6.c SECOND READING AND ADOPTION OF ORDINANCE NO. 1750 (2025 Series) AMENDING TITLE 17 OF THE CITY’S MUNICIPAL CODE (ZONING REGULATIONS) SECTION 17.02.020 TO INCLUDE AN APPLICABILITY SUBSECTION AND TO EXEMPT CERTAIN PUBLIC SAFETY FEATURES IN CITY PROJECTS FROM Adopt Ordinance No. 1750 (2025 Series) entitled “An Ordinance of the City Council of the City of San Luis Obispo, California, amending Title 17 of the City’s Municipal Code (Zoning Regulations) Section 17.02.020, “Purpose and Authority of the Zoning Regulations” to include an “applicability” subsection and to exempt certain public safety features in City projects from the Zoning Regulations.” 6.d ADVISORY BODY APPOINTMENT FOR AN UNSCHEDULED VACANCY ON THE AREA AGENCY ON AGING COMMISSION Confirm the appointment of Corene Canaan to the Area Agency on Aging Commission (AAA) for the remainder of the vacated term expiring June 30, 2026, and a consecutive 2-year term expiring June 30, 2028. 6.e AUTHORIZATION TO CREATE A NEW CAPITAL IMPROVEMENT PROJECT AND APPROPRIATE SENATE BILL (SB) 125 FUNDS FOR THE OPEN-LOOP PAYMENT SYSTEM PROJECT Adopt Resolution No. 11609 (2025 Series) of the City Council of the City of San Luis Obispo, California, to: 1. Approve the creation of a new Capital Improvement Project for the Open-Loop Payment System (Project Number 2000406); and 2. Authorize the Finance Director to appropriate $271,000 in Senate Bill (SB) 125 grant funds to the Open-Loop Payment System Project Account (Project Number 2000406). 6.f CONSOLIDATION OF THE PUBLIC WORKS AND UTILITIES DEPARTMENTS AND ESTABLISHMENT OF NEW DIRECTOR POSITION Adopt Resolution No. 11610 (2025 Series): 1. Combining the Public Works Department and the Utilities Department into a single Department of Public Works and Utilities. Page 17 of 764 4 2. Establishing a new Director of Public Works and Utilities classification to oversee the City’s Public Works and Utilities functions; and 3. Reclassifying the existing Public Works Director and Utilities Director positions into Assistant Director positions, one overseeing the Public Works operational branch and one overseeing the Utilities operational branch; and 4. Confirming that the Director of Public Works and Utilities shall assume all responsibilities and authorities individually referenced in the San Luis Obispo Municipal Code for the Public Works Director, Utilities Director, and department head; and 5. Establishing an updated regular employee salary schedule effective November 20, 2025, as required by California Public Employees’ Retirement System. 6.g AUTHORIZATION TO ADVERTISE REQUEST FOR PROPOSALS FOR TRANSIT OPERATION AND MAINTENANCE SERVICES Authorize advertisement of a Requests for Proposals (RFP) for qualified vendors to provide transit operation and maintenance services for San Luis Obispo (SLO) Transit. 6.h FISCAL YEAR 2024-25 DEVELOPMENT IMPACT FEE ANNUAL REPORT (AB1600) Adopt Resolution No. 11611 (2025 Series) entitled, “A Resolution of the City Council of the City of San Luis Obispo, California, accepting the Fiscal Year 2024-25 Annual Report on Development Impact Fees and make findings related to Development Impact Fees held longer than five years.” 7. PUBLIC HEARING AND BUSINESS ITEMS 7.a INTRODUCE TWO ORDINANCES TO ADOPT BY REFERENCE THE 2025 CALIFORNIA BUILDING AND FIRE CODES WITH LOCAL AMENDMENTS (60 MINUTES) Community Development Director Timmi Tway and Fire Marshall Josh Daniels provided an in-depth staff report and responded to Council questions. Introduce Ordinance No 1751 (2025) entitled, “An Ordinance of the City Council of the City of San Luis Obispo, California, Amending Title 15 of the Municipal Code to adopt by reference and amend the latest edition of the California Building Standards Code and adopting findings of fact to support the amendments” (Attachment A) amending Chapters 15.02 and 15.04 of the Municipal Code adopting, by reference, the 2025 editions of the California Code of Regulations Title 24, the 1997 editions of the Uniform Housing Code and the Uniform Code for the Abatement of Dangerous Buildings, and the 2024 edition of the International Property Maintenance Code, with amendments. This Ordinance also includes adoption of the Wildland Urban Interface (WUI) Code. 2. Introduce Ordinance No. 1752 (2025 Series) entitled, “An Ordinance of the City Council of the City of San Luis Obispo, California, Adopting Local Amendments to Part 6 of the Building Construction and Fire Prevention Code, 2026” (Attachment B) providing local energy efficiency amendments to the California Energy Code.
