I have not received a response from you, in a letter dated July 31 stating the City has accepted your
proposal of striping the iequired fire lane in front of the fire department connection and allowing for a
iouding zone at the rear of this address, and when you intend to paint these stripes.
As a result, this office has no alternative but to issue a due date of September 4 to complete this
project.

I am rn receipt of your Notice of Violation dated Augusl22,2002. You did not reccive a
confinnation from n1e because you "accepted" my proposal. I did not specifi'when the work
would be compieted trowever, it was my understanding lhat I'uvas to complete the stripirrg at rny
earliest convenience,
Given this situation has existed for over 100 years and my willingness to restrict the usage of my
property and pay for any modifications requested by the City, I feel your Notice of Violation is
excessive. In addition, I contacted my tenant, Aaron Brothers, regarding this issue and they were
in agreement subject to the loadingzone including the trash container as it currently exists. I told
them, per out discussion, the trash container and activities would be allowed in the loading areas.
I will contact a stripping company and contract to have the work completed as soon as possible.

Dear Mr. Andreson:
I received your letter dated July 19, 2002 outlining your concerns and solutions. I reviewed this letter
with the City Fire Marshal and he agrees to your proposal; painting a red stripe in front of the fire
department tonnection and painting a yellow stripo for a loading zone. I believe this is a fair
compromise for something ihut should have been addressed by our department in the plan check phase.
I have enclosed a copy of the San Luis Obispo City Municipal Code section ooncerning loading zones.
Please make rut *h"n painting the red stripe you include the words'Tire Lane -No Parking" in
white letters, and the yeilow stripe with the words'T-oading Zon€'in black letters-

10.44.030 Yellow loading zone-Time restrictions for loading and unloading.
A. No person shall stop, stand or park a vehicle in any yellow loading zone for any purpose other
than loading or unloading material for such time as is permitted in this section.
B. The loading or unloading of materials shall be allowed only for those deliveries made by
commercially registered and licensed vehicles or professionally signed passenger vehicles displaying an
authorized commercial loading zone permit that is used for commercial business deliveries; also, the
delivery or pickup of express and parcel post packages and United States mail. All other passenger
vehicles not meeting the sign and permit requirements may not use a loading zone for any purpose
except when the zone is not effective.
C. Permission herein granted to stop or stand a vehicle for the purpose of loading or unloading
materials shall not extend beyond the time necessary therefor, and in no event for more than thirty
minutes. Evidence that there was no activity involving the loading or unloading of materials into or from
a vehicle during any continuous period of time of eight minutes or longer shall constitute prima facie
evidence that the vehicle was parked longer than the time necessary for loading or unloading. (Ord' 1343

Dear John:
I am in receipt of your letters dated June 17,2002 and July 15^2A02 regarding the rear of the
above referenced property. I understand the Bureau of Fire Prevention's concerns regarding
access to the rear of the buildings in the 600 t'riock of }liguera Street. However, I am equally
concerne.d about my property and ltow your proposed striprng would aff'ect the use and value of
my property.
My property extends ten feet beyond the rear of the building. This area has always been used lbr
loading and employee parking. To now prohibit this area fiom uses it has historically been used
for is essentially a "taking" of a portion of my property. It is also my understanding, the City's
fire prevention plan calls for access to the rear of the buildings in the 600 block of Higuera Street
ttu'ough 668 Marsh Street. This access has been fenced and lock therefore forcing all emergency
access to the Nipomo alley.
I am concerned about the heaith and safety of my ienants and buij<iing, as weii as rny neighoors'
Therefole, to get the greatest access to the rear of 600 block buildings, I suggest gaining clear
access through 668 Marsh Street. In an effort to gain better access in the alley, I would be willing
to red stripe from the south corner of the property across the rear of the property in front of the
fire sprinkler connection. In addition, to allow for limited loading and trash storage, I would be
willing to yellow stripe the rest of the rear of my property as a loading zone'
