Romero, Public Works Director SUBJECT: Environmental Enhancement and Mitigation Grant Program for Nipomo Street Bridge RECOMMENDATION: Adopt resolution directing staff to apply for grant in the amount of $450, 000 to assist in acquiring property and making improvements in order to extend Mission Plaza as a mitigation program for the Nipomo Street Bridge BACKGROUND: The California Transportation Commission, through their Resource Agency, established in 1989 a ten year Environmental Enhancement and Mitigation Program which allocates $10, 000, 000 annually for the funding of proposals which meet their requirements. Projects must fall into one of three categories: a) Highway Landscape and Urban Forestry; b) Roadside Recreation; and c) Resource Lands. To be eligible for consideration each project must be directly or indirectly related to an environmental impact of modifying an existing transportation facility or new transportation facility. Public Works, Community Development, and Administration staff have completed preliminary research to see if any of the City's Capital Improvement Projects would qualify for this grant. It appears that only two projects meet the requirements and are far enough along to be considered for a grant at this time. At a meeting with an Area Council representative (Caltrans' District 5 Environmental Planner, Gary Ringgerone) , these two projects were presented: Orcutt Road Expansion and the Nipomo Street Bridge Replacement. Both projects were considered acceptable for the grant, but the Orcutt Road project was too far in the future to have a viable chance (this project should be submitted when the project is closer to fruition) . The Nipomo Street Bridge project was judged highly by the representative. DISCUSSION Staff believes that mitigation of the Nipomo Street Bridge project could include a considerable amount of the property acquisition and improvements needed for development of the Mission Plaza Extension between Broad Street and Nipomo Street. For the grant submittal, staff is using the Taylor Plan (Attachment A) approved in principle by the City Council in 1980. ����i�»niiilvlllllllllll1°°°�I����II city of San Luis OBispo i COUNCIL AGENDA REPORT Grant Proposal Page Two The Nipomo Street Bridge Project (Attachment B) , as it relates to the grant program, would fall into the Resource Lands category. This category includes funds for "acquisition. restoration and enhancement of resource lands to mitigate the loss of, or detriment and resource lands lying within or near the right of way". "Resource lands include natural areas, wetlands, forest, streams and other areas containing fish or wildlife habitat". I This project was considered viable because it met the following evaluation criteria: I criterion 1. Would provide an opportunity to afford the greatest degree of mitigation or enhancement over and above that which may be required under the California Environmental Quality Act. Project Response The California Fish and Game Department is requiring the City to limit the grading of the creek channel and do additional planting on the proposed gabion walls. The enhancement opportunity will occur with the revegetation of the entire creek bed to Broad Street Bridge. This revegetation plan will consist of a diversified mixture of indigenous California plants suited to this riparian niche. The design will also incorporate public environmental education and be oriented toward public use. Criterion i 2 . Project shows the greatest degree of connection to an existing project which reinforces, complements, or fills a deficiency or need in a larger area, complex, or system. Project Response The Mission Plaza Extension will provide two connections to existing systems. The first will be the connections to the plaza. The second will be the creek itself. The revegetation plan will re-introduce a variety of native riparian plants, establishing an example of how impacts or developments along the creek should occur. Project Response The City currently designates $50, 000 annually to the Capital Outlay Fund for Mission Plaza improvements and expansions and has accumulated $200, 000 to date. This accumulated money could be used as matching funds for this extension of Mission Plaza. Alternatively, the possibility of receiving donations of labor and materials from private sources could be sought. i criterion 4. Project readiness to be started and completed. Project Response The bridge project is scheduled to be started in the spring of 1993 . For the past several years, the City has been negotiating with property owners along the extension of Mission Plaza for City purchase along the creek. The City has hired special counsel to conduct these negotiations. It is anticipated that the necessary property will be acquired by 1993 when the Nipomo Street Bridge project proceeds. I Criterion 5. Project ability to protect and enhance important resources. I Project Response I If the project can be designed as stated in Criteria #2, this will enhance this valuable resource (San Luis Obispo Creek) that the City is entrusted to preserve and protect. Criterion 6. Sustainable - assurance that the project will be maintained and protected. Project Response The City has an excellent track record of maintaining and protecting its capital projects. Other Public Benefits - does the project include benefits such as public access, interpretive and/or environmental education opportunities. Project Response The Mission Plaza Extension should introduce interpretive elements into the design which would relate to the revegetation of the creek and an explanation of its ecosystem. Because of the favorable response from the area representative, staff believes there is a good possibility of obtaining grant funds for acquisition and development of this portion of Mission Plaza as a mitigation for the Nipomo Street Bridge Project. Currently the City has accumulated $200, 000 in the Capital Outlay Fund for Mission Plaza acquisitions, improvements and expansions, which could be used for this purpose. The monies involved in this grant could be used for the acquisition of the land, development of plans and/or construction of the project. Listed below are eligible costs that can be included in the grant request: 1. Acquisition costs. Cost of acquiring real property and may include purchase price of land, appraisals, surveys, title reports, escrow fees and title insurance. Services of the City's staff who are directly engaged in the project. 3. Consultant costs. 4. Construction equipment. City equipment used in the project. 5. Construction cost to complete project from start to finish. With next budget years capital allocation of $50, 000, there will be a total of approximately $200,000 in the Mission Plaza account. An additional $50, 000 could be made available from funds set aside for open space acquisition. (SERIES 1991) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN LUIS OBISPO DIRECTING STAFF TO APPLY FOR A GRANT UNDER THE ENVIRONMENTAL ENHANCEMENT MITIGATION GRANT PROGRAM WHEREAS, for almost 30 years the City has had a master plan for development of Mission Plaza; and WHEREAS, during that time that portion of Mission Plaza between Chorro and Broad Street. .has been fully developed, and that portion between Broad and Nipomo Street has been partially developed; and WHEREAS, the City is anxious to complete development of the second phase of Mission Plaza; and WHEREAS, the City has master plans for this development and for many years has set aside $50, 000/year for acquisition and development of this area and has now accumulated over $200, 000; and WHEREAS, the City is proposing to reconstruct a major bridge at the Nipomo Street end of the Mission Plaza portion; and WHEREAS, the bridge project will require mitigation of San Luis Obispo Creek; and WHEREAS, the mitigation of the creek and the development of Mission Plaza can be carried out at one time and jointly beneficial to interests of all concerned, and the conditions of an Environmental Enhancement Mitigation Grant. NOW THEREFORE BE IT RESOLVED by the City Council of the City of San Luis Obispo that: 1. The City possesses legal authority to apply for a grant and to finance, acquire, and construct improvements. 2. The City will be able to maintain and operate the acquired property and the development in perpetuity. 3 . The City will give the State's authorized representative access and the right to examine all records, books, and papers related to the grant. 4. The City will be able to commence the project within -a reasonable time after receipt of notification from the State that funds have been approved and the City will be able to carry the project to completion with reasonable diligence. e-z-( Resolution No. (1991 Series) 5. The City will comply with all provisions of the California Environmental Quality Act, California Relocation Assistance Act, and any other State and local laws, rules, or regulations. 6. The City does hereby direct the Public Works Director as agent for the City of San Luis Obispo to apply for the grant and to conduct all negotiations, execute and submit all documents including, but not limited to, applications, agreements, amendments, payment requests as may be necessary to complete the project.
