COUNCIL AGENDA REPORT ITEM NUMBER: FROM: Ren Hampian, Assistant City Administrative Officer Prepared By: Deb Hossli, Administrative Analystl SUBJECT: Request to accept a $20,000 grant from the California Healthy Cities Project to analyze the impact of the Smoking Ordinance on the business community (particularly bars and restaurants) and adopt a resolution supporting the goals of the California Healthy Cities Project CAO RECOMMENDATION: Adopt a resolution supporting the goals of the California Healthy Cities Project and authorize the City Administrative Officer to execute a contract with the California Healthy Cities Project DISCUSSION: Staff recently received notification from the California Healthy Cities Project that the City has received a $20, 000 grant to analyze the impact of the Smoking Ordinance on our business community. As the Council is well aware, the City' s Smoking Ordinance remains the strongest in the United States. The City regularly receives calls from other municipalities throughout the nation requesting information on our Ordinance, with most commonly asked questions relating to economic impact. Based on the success of the implementation process, staff is confident that a study of this nature will confirm that the Smoking Ordinance has not had a significant impact on our business community. Conducting a formal economic analysis, however, will provide the City with conclusive evidence of this. This type of information will greatly aid other municipalities attempts to enact more comprehensive smoking ordinances. In requesting the funds, staff committed to creating a partnership between the City, Cal Poly, and the Chamber of Commerce to carry out the project. This approach will allow the City to keep the costs of the study to a minimum, take advantage of an under- utilized community resource (Cal Poly faculty and students) , and provide Cal Poly students with practical experience by having them conduct the analysis. In addition, Chamber involvement in study design and implementation will help to insure business community acceptance of the results. With respect to study design, it would be staff's intention to use a combination of strategies ranging from a review of historical trends in sales tax receipts (for San Luis Obispo and throughout the State) to interviewing key business people or randomly polling citizens. Final project design and implementation will be left to the partnership, with staff providing the Council with periodic progress reports. No additional City monies will be needed. CONCURRENCES: Cal Poly and the Chamber of Commerce have agreed to participate in the project. (1992 SERIES) RESOLUTION SUPPORTING THE GOALS OF THE CALIFORNIA HEALTHY CITIES PROJECT AND INDICATING THE INTENT TO PARTICIPATE IN A PROJECT TO ANALYZE THE ECONOMIC IMPACT OF OUR SMOKING ORDINANCE ON OUR BUSINESS COMMUNITY, PARTICULARLY BARS AND RESTAURANTS WHEREAS, the City of San Luis Obispo is committed to the goals of the California Healthy Cities Project; and WHEREAS, the City has demonstrated its commitment to these goals by enacting the strongest Smoking Ordinance in the United States; and WHEREAS, the City's Smoking Ordinance has been in effect for over a year and a half and considered to be a tremendous success; and WHEREAS, the City is committed to sharing our success with other municipalities in an effort to encourage wide-spread adoption. of comprehensive smoking ordinances; NOW, THEREFORE, BE IT RESOLVED, that the City Council intends to participate in the California Smoke Free Cities Mini-Grant Program by accepting a grant of $20, 000 for the purpose of analyzing the impact the Smoking Ordinance on the business community as this type of information will greatly aid other municipalities efforts to adopt more comprehensive smoking ordinances. Mayor Ron Dunin ATTEST: Pam Voges, City Clerk APPROVED: Ci ALdin1hislErative Officer 't tt n \smoke20 AGREEMENT NO. 32-09 GRANT AGREEMENT BETWEEN THE WESTERN CONSORTIUM FOR PUBLIC HEALTH CALIFORNIA SMOKE FREE CITIES AND THE CITY OF SAN LUIS OBISPO The Western Consortium for Public Health, California Smoke-Free Cities, hereinafter WCPH/CSFC and the City of San Luis Obispo, hereinafter CITY, agree as follows, effective on the subscribed date: PURPOSE OF GRANT. City agrees to use the funds provided by this grant exclusively for the purpose of conducting the project activities described in its California Smoke-Free Cities Mini-Grant application, which is incorporated herein by reference. TERM: The term of this grant shall be from the effective date through the date of completion of the project or September 30, 1992, whichever is earlier. PAYMENT: Upon receipt of afully-executed grant agreement from CITY, WCPH/CSFC shall pay CITY $10,000. The additional balance of$10,000 shall be paid upon submission of acceptable interim progress report.Project expenditures shall be in accordance with the attached Exhibit A (Budget). City may modify the budget with prior notification to WCPH/CSFC. PROGRESS AND FISCAL REPORTING: CITY shall provide an interim progress report on March 31, 1992 and a final progress report on or before September 30, 1992. The final report shall include an iluation of the project's impact on the community. CITY shall provide a final fiscal report detailing its expenditures on or before November 30, 1992. CITY shall promptly return the unexpended balance, if any, of funds awarded under this grant agreement. AUDIT: CITY agrees to maintain and preserve until December 31, 1995, and to permit WCPH/CSFC and the State or any of its duly authorized representatives to have access to and examine and audit, any pertinent books, documents, papers, and records of CITY. ACKNOWLEDGEMENT: CITY shall acknowledge the financial support of Proposition 99 funds in any publications or materials produced with grant support as follows: 'This was made possible by funds received from Proposition 99, the 1988 Tobacco Tax Initiative. STATE USE OF MATERIALS: The State of California shall have the right to use, reproduce, and authorize others to use and reproduce, anymaterials produced pursuant to this grant.
