On October 15, 2025, City of San Luis Obispo Community Development Department staff noted the
following violations of the San Luis Obispo Municipal Code or other relevant codes at the above listed
address:
1. Standards for Fences Located Outside of Required Setback Areas (SLOMC 17.70.070[D])
“Fences, walls, and arbors may be placed outside the required setbacks, provided:
1. The maximum fence, wall, arbor or hedge height is eight feet.”
2. Permit Required (SLOMC 15.04.020[E])
“Work exempt from permit:
2. Fences not over 6 feet high constructed of conventional lightweight materials
including wood, vinyl, and wrought iron.”
A fence that is located towards the rear of the property has been constructed that is over the
allowed height and requires a permit. The fence consists of a six-foot-tall chain link fence with
an addition of four-foot-tall lattice. The total height of the fence is ten feet tall where eight feet is
allowed. The fence will either need to be brought down to six feet tall, or a permit obtained and
the total height reduced to eight feet.
Please note: This notice is provided as a correction to the notice dated September 10, 2025. That
notice is voided and is superseded by this notice.
We request that you voluntarily take action to correct the above noted violation(s) immediately. These
violations constitute a public nuisance and must be abated. Failure to correct the violation(s) will result in
the issuance of an Administrative Citation requiring payment of FINES in accordance with SLOMC
Chapter 1.24. For Municipal Code violations that remain uncorrected after issuance of an Administrative
Citation, the City may seek enforcement by other civil or criminal remedies.
Any person having a title interest in the property may request a Director’s review of this Notice by
completing the enclosed Request for Director’s Review Form and submitting it to the Community
Development Department, 919 Palm Street, San Luis Obispo, CA 93406, within five (5) days of the date
of this Notice. This Notice shall be deemed final unless you timely file a Request for Director’s Review.

On July 29, 2025, City of San Luis Obispo Community Development Department staff noted the following
violations of the San Luis Obispo Municipal Code or other relevant codes at the above listed address:
1. Permit Required (SLOMC 15.02.020, California Building Code 105.1)
“Any owner or owner’s authorized agent who intends to construct, enlarge, alter, repair, move,
demolish or change the occupancy of a building or structure, or to erect, install, enlarge, alter,
repair, remove, convert or replace any electrical, gas, mechanical or plumbing system, the
installation of which is regulated by this code, or to cause any such work to be performed, shall
first make application to the building official and obtain the required permit.”
2. Development Standards – Setback (SLOMC 17.18.020[B])
“The interior side and rear setback standards for the R-2 zone shall be as set forth in Table 2-
7.”
3. Fences, Walls, and Hedges (SLOMC 17.70.070[C][4])
“Fences, walls or hedges may be placed within required yards, provided they do not exceed
maximum height limitations and comply with the following standards:
4. Interior Side and Rear Setback Height: The maximum height of a fence, wall, or
hedge in any interior side or rear setback shall be six feet.”
A water tank has been installed, at the western portion of the property, without a permit and
within the required setback to the neighboring property. The tank shall be either removed from
the property or permitted and moved outside the setback.
A fence has been installed, at the western portion of the property, without a permit, within the
required setback, that is approximately eight feet tall. The fence shall be reduced to six feet or less,
or placed greater than 35 feet from the neighboring property lines. Any fence over seven feet high
will require a permit.
ALL REQUIRED WORK MUST BE COMPLETED WITHIN 90 DAYS OF PERMIT ISSUANCE.
We request that you voluntarily take action to correct the above noted violation(s) no later than October
10, 2025. These violations constitute a public nuisance and must be abated. Failure to correct the
violation(s) by the specified date will result in the issuance of an Administrative Citation requiring
payment of FINES in accordance with SLOMC Chapter 1.24. For Municipal Code violations that remain
uncorrected after issuance of an Administrative Citation, the City may seek enforcement by other civil or
criminal remedies.
Any person having a title interest in the property may request a Director’s review of this Notice by

10/30/2025 10/20/25 - spoke with the property owner had
the discussion with her that the fence would
only be allowed to be 8 feet tall. She plans on
talking to our Planning Department, in person,
to see if she can apply for a fence height
exception. I don’t suspect they will support
that, and I let her know that, but I encouraged
her to hear it from them since I don’t work in
that department.
From my understanding, talking with the
property owner, the lattice has been up for
around five years. So she did not think she
would need to find a solution this late far
down the road. I did let her know that a
violation, although it may not have been
reported, is still a violation. And once it is
brought to our attention we are tasked with
ensuring it gets resolved.
The owner does hope to have it resolved in a
timely manner, but I understand that can be
two different things to two different parties.
She let me know she would be reaching out
to the Planning Department and some
contractors or handy men and contact me
with an update in a week. I felt that was a fair
timeframe.

They spoke with Planning and it was
determined that a fence taller than the allowed
8 feet would not be supported. The owner
has had two contractors out to submit a bid
and are waiting for a third. They did state they
would have plans drawn and be in on
Thursday to apply for the permit.

provide a few minor details regarding
supports and connections. SM provided them,
via email, instructions on what would be
needed. They were given permission to
proceed with making corrections and are
planning to start lowering the height early next
week. I also provided her a copy of the new
NOV so I will not be sending it via mail.
