San Luis Obisoo Municioal Code 17.86.130Fraternities and sororities.A. Applicabitity. The provisions in this section shall apply to "fraternities and sororities," asdefined in Chapter 17.L55 (Land Use Definitions) and where permitted in Chapter 17.10 (UseRegulations). This section is intended to promote the quality of life in residential neighborhoodsby ensuring that dwelling units housing multiple persons who are members of a fraternity orsorority provide adequate support facilities for the intensity of associated use, and that such usesare operated in a manner that is not detrimental to the neighborhood in which they are locateddue to excessive noise, inadequate off-street parking, general property maintenance, and similarconditions. The following standard conditions shall apply to all fraternities and sororities.1. Occupancy shall be limited to not more than one resident per sixty square feet of buildingarea. The landlord shall allow the city to verify occupancy by allowing an inspection of the recordsor by a visual inspection of the premises. Any inspection shall be at a reasonable time and shall bepreceded by a twenty-four-hour notice to the residents.2. The maximum number of persons allowed on site for routine meetings and gatherings shallnot exceed the limit established by the applicable conditional use permit.3. The fraternity or sorority shall remain affiliated and in good standing with the lnterfraternityCouncil of Student Life and Leadership at California Polytechnic University, San Luis Obispo. lf thefraternity or sorority becomes unaffiliated or no longer held in good standing with CaliforniaPolytechnic University, the conditional use permit shall be revoked.4. The landlord shall provide names and telephone numbers of responsible persons to thecommunity development department and SLOPD neighborhood services manager on an annualbasis. The proliferation of fraternity houses in our R-1 and R-2 neighborhoods, especially the Alta Vista and MontereyHeights neighborhoods which border Cal Poly, has increased dramatically over the past decade and has had aseverely negative impact on the quality of life for the people who live there. Many long-term residents havebeen driven out of the neighborhood and sold their houses to get away from the problematic noise and otherissues associated primarily with the illegal fraternity houses. lnvestors have bought those homes and they havebecome student rentals. Many are illegal fraternity houses or "satellite fraternity houses", According to CalPoly's definition, "any'house that has more than 50% of members from one chapter living there and/oranywhere that the fraternity/sorority wants to host an official chapter event." (See attachment email fromElizabeth Aiello-Coppola. Assistant Director of Fraternitv and Sororitv Life at Cal Polv.) Below are some of theissues our neighborhoods have encountered as a direct result of the illegal fraternity houses:o Noisy parties with booming music and screaming people, especially on Thursday, Friday and Saturdaynights from 8 p.m. - 2 a.m., and during the day on Saturday and Sunday.r Noisy drinking games involving a 4' x8'table, including beer pong and various dice games such as "Die isLife" and a game that makes a distinctive loud popping sound like a firecracker as the die is slammedagainst the table repeatedly for the duration of the game. The participants cheer loudly throughout theduration of these drinking games, which can last for hours.. . Roving parades of college students traveling on foot throughout the neighborhood from one fraternityparty to another fraternity party until early morning hours. They often yell at one another and randomlyscream, especially late at night when they are intoxicated.. When students don't walk to the parties, they generally call an Uber or Lyft which has caused a seriousincrease in traffic as a non-stop stream of rideshare drivers stop in the middle of the street with hazardlights flashing to drop off people at fraternities to "pre-game" before going to other parties or to stay atthe fraternity to party; to pick up people leaving fraternity parties late at night; and to drop off fraternitymembers returning from other parties or bars downtown. At the later hours, guests are oftenintoxicated and yell loudly while waiting for their ride or being dropped off, which wakes up neighboringresidents.r Trash thrown in yards, especially empty beer cans, bottles and miniature bottles of hard liquor.: Y:il."i,t"i:lffi,*T il.i:l.fl:Tl[lo],0" ,.,.',,,.ors on vehicres parked on the street, objects takenfrom yard or porches and thrown into the street, fence boards kicked in and broken, etc.r Screeching tires from vehicles peeling out at all hours, day and night.o Lack of parking due to the increased occupancy of many college students in single-family homes.San Luis Obispo's municipal code defines fraternities as residences that have gatherings or meetings associatedwith a fraternity but does not classifo a "satellite fraternity house" as associated with the occupancy of greaterthan 50% of fraternity members, like Cal Poly does. Still, using the SLOMC definition of a fraternity, there areover 50 recognized fraternity houses that are illegally situated in our R-1 and R-2 neighborhoods.Zonins for Fraternities in GeneralIt is well-established that fraternities are a unique classification of housing that have an adverse effect onneighboring properties due to noise, increased traffic, and other issues, therefore cities have specific zoningregulations associated with their placement in a community. Courts have repeatedly upheld zoning regulationsthat prohibit fraternities in residential neighborhoods."The facts of life dictate that there is a vast difference between a boarding house or lodging house and afraternity house... The city council apparently was fully aware that college spirit contemplates frequentL
gatherings with attendant boisterous conduct on occasions. The rush parties, the dances, the rallies andother manifestations of the collegiate spirit are present in a fraternity house and frequently absent in aboarding hoLrse, a lodging house or an apartment." in City of Long Beach v. Alpha Alpha Chapter of Phi Beta PiThere is no doubt that fraternities present a host of problems to neighboring properties, including parties withloud music and screaming into the early morning hours. Conditional Use Permits for Cal Polv Fraternitiesln response to a public records request for all the conditional use permits for fraternities in the city of San LuisObispo, the City Clerk produced only seven conditional use permits, although there are 18 Cal Poly fraternitiesrecognized by the lnterfraternity Council. "Nomeetings or other gatherings involving persons other than fraternity members living on this site are allowedbetween the hours of 10 p.m. and 9 a.m." Amplified sound equipment is not allowed at the fraternity house."No hosted Greek events on the site shall be allowed (i.e., TG' s, rush events, little sisters, etc.)." The onlygathering allowed is "One parents' barbecue and one alumni barbecue may be held at the site each year. Notmore than 38 persons may be present at either event, including fraternity members."However, Sigma Nu regularly has large noisy parties at 1304 Foothill that extend into the front yard andsidewalk. SinceJanuary2. thev have received three noise citations. On LOl27l2O22, thev received a citationfor an "unrulv satherins". Sigma Nu also has several illegal fraternity houses in R-1 and R-2 neighborhoodsincluding at 301 Hathway, 250 Grand Ave, 1621 McCollum and 290 Chaplin. The location at 301 Hathway isespecially disruptive and has received ten citations in the past three years!2 190 Crandall is currently occupied by Kappa Sigma3 1292 Foothill is occupied by Sigma Nu.Lambda Chi Alpha operates att264 Foothill (among many other addresses)3

The terms of their permit state "No meetings, parties or other types of activitiesinvolving persons other than residents living on the site shall be allowed between the hours of 10:00 p.m. and9:00 a.m." But Alpha Sigma Pi regularly has large parties including a loud party last month (October 2023) withat least 150 party guests that spilled into the road behind the fraternity house on Hathway Avenue. !i3geOctober 2O22.thev have received at least five noise citations for loud parties after 10:00p.m. or during themorning of the 5t. Fratty's Day neighborhood takeover. They also have a non-permitted fraternity house nextdoor to their main house at 331 Hathway, which has been cited for noisy parties four times just this year in2023.Phi Kappa Psi at 1335 Foothill has had five noise citations for loud parties since June 2022. even though their usepermit states "No meetings, parties, or other types of fraternal activities that would exceed the residentialoccupancy of persons (11) may take place between the hours of 10 p'm. and 7 a.m'"Delta Upsilon at72O Foothill has had five noise citations for loud parties since June 2022. Their use permit statesthat a maximum of 21 persons are allowed on site for routine meetings and gatherings, and "No meetings,parties, or other types of similar activities that would violate City Noise Ordinances, or that would exceed themaximum 21 persons provision between the hours of 10 p'm. and 9 a'm"'Delta Chi at 1236 Monte Vista has had fivencitations for noisv oarties since November 2O21. Their usenrsepermit states '?5. No meetings, parties, or other types of similar activities involving persons other than residentsare allowed between the hours of 10 p.m. and 9 a.m." Also, "#7. Events, including meetings or parties on site,shall be limited to those listed on a meeting and activities schedule submitted to and approved by theCommunity Development Director in the fall of each Year."Lambda ChiAlpha operates atL264 Foothill. On Friday 70/27/2023, they had an enormous out-of-control partyduring "Halloweekend" (Cal Poly's annual three-night celebration on the Thursday, Friday and Saturday closestto Halloween) with several hundred college students. A SLOPD officer requested backup to help shut down theparty. Several police units and bicycle officers arrived on scene as the college students streamed from theproperty onto the sidewalk and street. The party was NOT CITED and there is no indication in the SLOPDdispatch log that there was a "noisy party" so there is no record of the occurrence, except for the entry in theSLOPD dispatch log for "Assistance Requested". The clearance code says, "No Report".4

To complicate matters, most Cal Poly fraternities do not have usepermits and are operating anyway to the detriment of their neighbors.Assemblv Bill 524: The Campus-Recognized Sororitv and Fraternity Transparencv ActAssembly Bill 524 went into effect in 2023 and requires that California colleges and universities publish online, apublicly accessible database that includes a wide variety of aspects of their fraternities and sororities includingthe location, date and time of any sanctioned event off campus during the previous academic year. The deadlinefor posting the information online was October t,2023.Cal Poly SLO posted the information online which led to the discovery of the addresses of fraternities in San LuisObispo. Most of the addresses were already known through the various fraternity's social media posts,advertising their rush activities at specific addresses. However, the information provided by Cal Poly on theirwebsite verifies the fraternity house locations within San Luis Obispo, and that they held "sanctioned events" atthose addresses. This meets the definition of a fraternity according to the SLOMC Land Use Definition (ChapterL7.156) as a "Residence for college or university students who are members of a social or educationalassociation that is affiliated and in good standing with the California Polytechnic State University and where suchan association also holds meetings or gatherings."Fraternities are Premised (No Warning List)Fraternities in San Luis Obispo are automatically premised with the San Luis Obispo Police Department, whichmeans they are not eligible for a Disturbance Advisement Card/DAC (an official warning) lf there is a noisecomplaint for a noisy party at a fraternity, a police officer responds and if the noise is verified, a citation iswritten which includes a fine. This policy was implemented to hold fraternities accountable for their impact onneighboring property as outlined in their use permit.lf a fraternity is not on the Premised List and a noise complaint is made to SLOPD between 7:30 p.m. - 2:30 a.m.,a SNAP (Student Neighborhood Assistance Program) officer is dispatched. A SNAP officer is a Cal Poly studentand does not have the ability to issue a citation but can issue a DAC at their discretion. By not being included onthe Premised List, a fraternity is able to escape accountability and receive a DAC instead of a citation.SLOPD released their Premised List of fraternities and sororities with their addresses. Partv RegistrationSan Luis Obispo implemented a Party Registration program in2Ot7 which became permanent in 2018. Theprogram allows students and residents to register parties with the San Luis Obispo Police Department to avoidparty-related noise fines. lf a resident calls the police with a noise complaint for a registered party, police willcall the host and allow 20 minutes for the noise to settle down before any fine is given. The program is designedto help students avoid fines for noise complaints. (See Attachment: The Mustana Doilv. "How students con ovoidportv-reloted fines with permonent citv-wide proaram", 70/3/20181Another issue related to the Party Registration program is that fraternities have been and are still allowed toregister their parties with the SLOPD for parties that last up until 2 a.m. This policy conflicts with the fraternity'suse permits which do not allow meetings, parties or other types of activities involving persons other than theresidents after 10:00 p.m. lt encourages and allows a fraternity to violate the terms of their use permit, whichdoes not make sense because it is inconsistent with the city's regulations. Somehow, the overall regulation offraternities through their use permits was overlooked when the Party Registration program was enacted.According to a fraternity's use permit, failure to comply with any of the conditions of the use permit, or coderequirements such as noise violations, is prohibited and could be grounds for revocation of the use permit.Here is a recent example: An 7O/28/2023, the Sigma Nu fraternity at 1304 Foothill had a large party with blaringmusic heard from a block away and party guests in the house and yard. At 9:35 p.m. a complaint was made toSLOPD for a loud party at 1304 Foothill but since Sigma Nu was allowed to register their party, there was nopolice response, and they were not cited. The call for a noisy party does not show on the SLOPD records, whichotherwise lists residents' calls to SLOPD for noisy parties.Meanwhile, Sigma Nu's use permit for 1304 Foothill states:r Occupancy of the site is limited to 19 residents.o The fraternity use is to be confined to the house only. The permit is for residential use only. Fraternities are bound by the terms of their use permits. The Party Registration allows fraternities to violatethe terms of their use permits, which goes against the regulations enacted by the planning commission andlorcity council, when they approved the terms of the fraternity's use permits.Therefore, the Party Registration program should be modified to remove fraternities from the program andallow them to operate consistent with their use permits.Another issue related to the Party Registration program is that a noise complaint call does not show up on theSLOPD dispatch log as a "noisy party" if a complaint comes in and the party is registered. For example, a publicrecords request was made to SLOPD for all noise complaints for certain addresses and SLOPD provided a listassociated with each address. The list does not include complaints for noisy parties that were "registeredparties". lt is impossible to ascertain the exact number of complaints made for each address because if the partywas registered, it does not show up on the SLOPD log as a noise complaint when a resident calls to complainabout the loud party.Here is a recent example: Theta Chi has a fraternity house at 191 Kentucky. Fraternities are the primary offenders of noisy parties and there should be arecord of each noise complaint for each address regardless of whether the party is registered.The only reprieve rr" been during summerbreak and Christmas break, when most students return to their hometowns and fraternities cease operations.This is evident by looking at the SLOPD response to noisy party calls. The calls typically begin at the start of theacademic year in September and slow down significantly when summer begins, and the students return to theirhometowns in June. However, Cal Poly announced they are increasing enrollment and will mitigate the impactof more stud€nts in the community by having students attend classes year-round.Presumably, year-round operations of regular classes with a fully enrolled student body will cause noisy partiesto occur year-round. The warmer weather in summer and longer days will likely contribute to increased partiesduring this time. Therefore, it is imperative that a solution is found to address the fraternity noise in ourneighborhoods and illegal fraternity houses in R-1 and R-2 neighborhoods must be eliminated."St. Fratty's Day'' and "Halloweekend"Most fraternities at Cal Poly are in the Alta Vista neighborhood. Historically, there have been some annual 'events that have been extremely problematic for the neighborhood because they are hijacked by fraternities fora reason to party. Thousands of students converge into the neighborhood, with fraternity parties at the hub ofthe disturbances. Poly Royal and Mardi Gras are examples of events that led to riots in the neighborhood andwere ultimately canceled by the city of San Luis Obispo and/or Cal Poly.ln 2009, the fraternity house at 348 Hathway had a party that began the tradition of "St. Fratty's Day" which hasa St. Patrick's Day theme but is a stand-alone event held outside the safety enhancement zone period of St.Patrick's Day. St. Fratty's Day takes place on the Saturday before winter finals at Cal Poly, whereas St. Patrick'sDay is always on March 17. Since 2009, St. Fratty's Day has gained traction and has become a completeneighborhood takeover that begins at 4:I7 am, with fireworks being set off, thousands of students blocking thestreets around Hathway, Bond, Fredericks and Kentucky. Music blares from the fraternity houses, people are onrooftops and yards, openly drinking, chanting and screaming for hours. SLOPD has been overwhelmed by thesheer volume of people and generally stand on the outskirts of the party until it fizzles out at around 10:00 am,six hours after it began. On Saturday night, the fraternity parties start up again into the early morning hours."Halloweekend" is a three-night party nearest Halloween, on Thursday, Friday and Saturday nights. lt is centeredaround fraternity parties in the Monterey Heights and Alta Vista neighborhoods (mostly Alta Vista). Parades ofstudents travel from one fraternity party to the next, screaming while they walk down the sidewalks and in themiddle of the streets. The noise starts at about 7100 pm and lasts until2:00 am or later.During "Halloweekend" this year, SLOPD leadership said they added four officers to patrol the neighborhood toaddress the loud parties. However, there were many, many parties that were listed on the SLOPD log as"Negative Violation" even though video documentation shows a loud party was taking place. Most calls werehandled by Cal Poly student SNAP officers. On one occasion, two SNAP officers were standing in the middle ofAlbert Drive attempting to cite a party and were surrounded by fraternity guys who were intimidating andarguing with them. ln other instances, SNAP officers shut down obviously loud parties that were called in, suchas a Sigma Nu fraternity party at 290 Chaplin with hundreds of college students, and they did not cite the party.10

As of one week later, tU7/2023, there has been no response to thequestions.Both "St. Fratty's Day'' and "Halloweekend" events are listed in the spreadsheets provided online by Cal Poly, asrequired under the Transparency Act, as "!.9-nctioned events' for numerous fraternities in the R-1 and R-2neighborhoods. ln some cases, fraternities do not list the events on the spreadsheet, but there are videosposted online that show fraternities in the neighborhood having parties anyway.One aspect of these fraternity events that is intolerable is the constant screaming of college studentsthroughout the night while they walk from fraternity party to fraternity party. lf fraternities were no longerallowed to operate in R-1and R-2 neighborhoods, it would significantly decrease the disruption of the "St.Fratty's Day" and "Halloweekend" because those events are centered around the fraternity parties being hostedby fraternities in the neighborhood. lt would also decrease other loud disruptive parties that take place in theneighborhood throughout the academic year.Overall, there is a general complacency associated with enforcement of noise violations in the neighborhoodsnear Cal Poly, which are primarily held by fraternities. lt is reminiscent of the boiling frog syndrome which is ametaphor for the inability or unwillingness of people to react or to be aware of threats that arise graduallyrather than suddenly. lf the fraternities and their associated problems with loud parties and other disruptions,were present in the Sinsheimer neighborhood, or San Luis Drive, or Ferini Heights, they would not be tolerated.Unfortunately, it was allowed to happen, as shown in this report, and it has increased exponentially over the 'past decade. lt has changed the fabric ofthe neighborhood to such an extent that permanent residents havehad to move away because they can no longer handle the problems, which is a travesty. Now, fraternity housesare beginning to pop up in other neighborhoods further from the Cal Poly campus as enrollment increases, andso willthe illegal fraternity houses.Pioposed SolutionsRemove fraternities from R-land R-2 neighborhoods.o Contact property owners for each of the fraternities operating in R-1 and R-2 neighborhoods and requirethat they cease operations.o Monitor noise complaints and social media to ensure that they do not continue to operate illegally.o lf fraternities continue to operate illegally, issue a Notice of Violation with fines.Communicate with Cal Poly regarding SLOMC and Zoning Regulations'1T
