Walter, Director of Public Work s Prepared By :Peggy Mandeville, Principal Transportation Planne r SUBJECT :ORDINANCE AMENDING CHAPTER 10 .40 .010 (TIMED PARKING)OF THE SAN LUIS OBISPO MUNICIPAL COD E EXPANDING TIMED PARKING TO INCLUDE SUNDAY RECOMMENDATIO N Introduce an ordinance amending Chapter 10 .40 .010 (Timed Parking) of the San Luis Obispo Municipal Code to reference other pertinent sections of the Municipal Code already amended t o include Sunday parking . DISCUSSIO N On July 5, 2011 the City Council approved several changes to the City's Municipal Code to expan d parking services to include Sunday from 1 :00 pm to 6 :00 pm . Staff recently identified one Municipal Code section that was inadvertently overlooked when amendments were adopted an d will need to be amended to include Sunday parking restrictions . Municipal Code Section 10 .40 .01 0 (Timed Parking) regulates timed parking zones (such as two-hour zones). To be consistent with th e new regulations regarding Sunday parking and enable enforcement of timed parking on Sundays , this ordinance section will need to be amended . Moreover, this ordinance will simply reference th e other relevant Municipal Code Section (section 10 .52 .030). This will adopt the existing parkin g restrictions by reference and should the specifics ever change in the future no further change to thi s section will be required . This simplification should alleviate a similar oversight in the future . Parking signs required to enforce Sunday parking are scheduled to be installed in mid-May 2012 . Prior to enforcing Sunday parking, staff will work with the Downtown Association on a publi c outreach campaign to raise awareness of new Sunday parking regulations . CONCURRENCE S The Downtown Association Parking & Access Committee and the Downtown Association Board of Directors voted to support Sunday parking . ALTERNATIV E Do not change the Municipal Code Section .This is not recommended as the City will not be abl e to enforce timed parking restrictions on Sundays without approval of the Municipal Cod e amendment . (2012 Series ) AN ORDINANCE OF THE CITY OF SAN LUIS OBISPO AMENDING SECTIO N 10 .40.010 (TIMED PARKING) OF THE SAN LUIS OBISPO MUNICIPAL COD E EXPANDING TIMED PARKING TO INCLUDE SUNDA Y WHEREAS, the parking program needs to continue to be self-sufficient for its financia l commitments ; and WHEREAS,the City needs to financially support the operation and debt service of th e next City parking structure ; and WHEREAS,the Council has considered parking revenue enhancements which included charging for parking on April 5, 2011 and directed staff to return with enabling ordinances ; and WHEREAS, the Council approved ordinance changes that expand parking operations t o include Sunday at a public meeting on July 5, 2011, an d WHEREAS, staff identified Municipal Code Section 10 .40 .010 as also needing to b e amended in order to expand timed parking operations to include Sunday . NOW, THEREFORE, BE IT ORDAINED by the Council of the City of San Lui s Obispo as follows : SECTION 1 . Section 10.40 .010 (Timed Parking) of the San Luis Obispo Municipa l Code is hereby amended to read as follows : 0 C4-2 When authorized signs, parking meters or curb markings have been determined by the city traffi c engineer to be necessary and are in place giving notice thereof, no operator of any vehicle shal l stop, stand or park said vehicle between the hours established by Section 10 .52 .030, for a perio d of time longer than designated time posted by sign, parking meter or curb marking . Green cur b markings shall mean no standing or parking of time longer than ten minutes up to one hour . All other time designations shall be from one hour up to ten hours . Vehicle must move a minimum of one hundred fifty meters once designated time at occupied space has elapsed . (Ord . 1331 § 2 , 1998 : prior code § 3210) Ordinance No . The provisions of this chapter relating to the operation of parking meters shall b e effective between the hours of nine a .m . and six p .m. every Monday to Saturday and on e p .m . to six p .m . every Sunday ; provided, that for good cause and upon a finding that suc h action will not jeopardize meter revenues as a necessary source of revenue for payment o f outstanding bonded indebtedness, the council by resolution may temporarily suspend th e parking meter operating provisions of this chapter for any or all of the city's parkin g meters .
