Dear Property Owner,
City of San Luis Obispo Community Development Department staff has been made aware of violations
of the San Luis Obispo Municipal Code located at 1688 Mill St. Within the City of San Luis Obispo, a
fraternity or sorority requires a use permit when within the R-3 & R-4 zones and is not allowed within the
R-1 & R-2 zones as described in section 17.10.020 of the San Luis Obispo Municipal Code. The city
defines a Fraternity/Sorority as:
Residence for college or university students who are members of a social or educational association
that is affiliated and in good standing with the California Polytechnic State University and where such
an association also holds meetings or gatherings. (SLOMC 17.156.014).
In summary, a location meets the definition of a fraternity or sorority when it houses fraternity/sorority
members AND holds a meeting or gathering hosted by a social or educational association.
On November 21, 2024, City of San Luis Obispo Community Development Department staff (Rami Salem
& Juan Padilla) went to the subject property address, identified ourselves as city employees, and spoke
with a tenant at the dwelling. Upon staff inquiring about the property, the tenant stated that the residents
of the dwelling are members of the fraternity “D-Sig” short for (Delta Sigma Phi). Staff asked if the tenant
can show us around the property. The tenant showed us a metal shed with the lettering on it (Δ Σ Φ). The
tenant informed us that the dwelling is a “Satellite house”. Additionally, staff observed trash receptacles
left out on the street in front of the subject address. Staff observed an accumulation of trash around the
property. Staff noted the following violations of the San Luis Obispo Municipal Code or other relevant
codes at the above listed address:
1. Use regulations by zone (SLO MC §17.10.020):
A. Allowed Uses: Uses within zones shall be regulated as set forth in Table 2-1; Uses
Allowed by Zone, subject to subsections B through F of this section and additional
regulations specified in the Specific Use Regulations Column of Table 2-1. Land uses are
defined in Chapter 17.156 (Land Use Definitions). In Table 2-1, symbols shall have these
meanings:
A The use is allowed as matter of right
MUP The use requires a minor use permit approved by the director, as provided in
Section 17.110.030 (Procedure-Minor Use Permit).
CUP The use requires a conditional use permit approved by the planning
commission, as provided in Section 17.110.030 (Procedure-Minor Use Permit).
M/A The use is allowed above the ground floor only. Subject to minor use permit
review, the use may be established on the ground floor.
2. Accumulation of Rubbish or Garbage (SLOMC 15.02.010, IPMC 308.1)
“Exterior property and premises, and the interior of every structure, shall be free from any
accumulation of rubbish or garbage.”
3. Trash Receptacles (SLOMC 17.76.060 B)
“Trash, green waste, and recycling receptacles shall not be within the front yard (see
definition of ‘front yard’ in section 17.158.016 – F Definitions) area except as provided in
Chapter 8.04, which states: Trash and garbage containers shall not be placed adjacent to
the street for pickup more than 24 hours before pickup time, and such containers shall be
removed within the 12-hour period following pickup. Trash and recycling containers shall
not be placed adjacent to the street for pickup before 5:00 PM or the close of business on
the day preceding pickup, whichever is later. Such containers shall be removed before
10:00 AM following pickup. Trash, green waste, and recycling receptacles shall be
completely screened from public view from the public right of-way that abuts the front yard
by a fence, landscaping, or wall that is otherwise allowed by zoning and building codes.
Multi-unit residential developments that are approved for individual waste wheelers shall
remove waste wheelers from the common area visible from the public right-of-way-in
compliance with this Section. Multi-unit residential developments with shared bin service
shall utilize approved enclosure locations consistent with project approvals.”
Corrective Action:
1. Stop all fraternal gatherings, meetings, or activities at this property.
2. Remove any and all fraternal identifying markers from the property such as painted
letters, brandings, or any item(s) similar to that in nature.
3. Remove or screen properly all accumulation of rubbish around the that can be seen
from the public right of way.
4. Remove the trash receptacles within the 12-hour period following pickup by the trash
company.
We request that you voluntarily take action to correct the above noted violation(s) no later than
12/16/2024. These violations constitute a public nuisance and must be abated. Failure to correct the
violation(s) by the specified date will result in the issuance of an Administrative Citation requiring
payment of FINES in accordance with SLOMC Chapter 1.24. For Municipal Code violations that remain
uncorrected after issuance of an Administrative Citation, the City may seek enforcement by other civil or
criminal remedies.
Any person having a title interest in the property may request a Director’s review of this Notice by
completing the enclosed Request for Director’s Review Form and submitting it to the Community
Development Department via email at code@slocity.org or to 919 Palm Street, San Luis Obispo, CA
93401, within five (5) days of the date of this Notice. This Notice shall be deemed final unless you timely
file a Request for Director’s Review.
