ITEM NO. 81-77 - Use permit request for temporary Christmas tree sales lot,
591 Higuera Street, C-R zone, William Callaway, applicant.
The assistant planner gave a description of the site and the requested use. He
noted curb -side parking is available at the frontage of the site and some parking
on site may be possible. Mr. William Callaway, applicant was present.
On motion by Mr. Johnasen, seconded by Mr. Kenny and unanimously carried, temporary
use permit was approved subject to the following conditions:
1. The use permit shall expire on December 28, 1977.
2. The use permit is for the sale of Christmas trees and related assessory items
only.
3. There shall be no sidewalk display of trees allowed, no display or signs allowed
in public right-of-way, no living quarters, and no loud speakers operated.
4. Maximum sign area on site shall not exceed 32 square feet, no bunting strips,
banners, flags, whirlygigs, or other attention getting devices shall be displayed
on site.
5. The applicant shall post a refundable deposit of $100.00 with the City Clerk
for clean-up of the lot, if necessary.
6. A 2A rated fire extinguisher shall be provided on site. Any trees sold for
use in public facilities shall be flame -proofed with a state fire marshal
approved material.
7. The applicant shall obtain a city business license.
ITEM NO. 82-77 - Use permit request for temporary Christmas tree sales lot, 110
Higuera Street, M zone, Robert Fiechter, applicant.
Mr. Robert Fiechter, applicant was present and explained his request noting the
trees would be at the rear of the site behind the existing structure and would only

1. Permitted use shall be incidental to residential use. No employees other
than residents of the dwelling.
2. No outdoor storage or work shall be permitted on the premises.
3. No vehicle larger than a 3/4-ton truck shall be used in connection with home
occupation. Said vehicle shall not park on the street.
4. No signs shall be permitted on the premises.
5. Any advertising shall b e by telephone number and/or post office box, not
residence address.
6. Use permit shall be subject to review, modification or revocation, if any
compliant is received.
7. Use shall not interfere with the peace, quiet and enjoyment of the neighbor-
hood.
8. Applicant shall obtain a city business license.
ITEM NO. 85-77 - Use permit request for home occupation (construction and remodeling),
260 Cerro Romauldo, R-1 zone, Gregg Cassebarth, applicant.
Mr. Gregg Cassebarth, applicant was present and explained his request. He noted
most of his equipment would be stored in a 3/4-ton pick-up which parks in the
garage. Some equipment may be stored in the storage building located at the
rear of the site. He has a small operation building houses and doing remodel work.
On motion by Mr. Johansen, seconded by Mr. Kenny and unanimously carried, use
permit was approved subject to the following conditions:

ITEM NO. V 0641 - Request for a variance to reduce required street yard setback,
884 Broad Street R-4 zone, Jonathan Lindenthaler, applicant.

Mr. Jonathan Lindenthaler, applicant was present. The assistant planner gave a
description of the site noting it is a lot of record with a width of 40 feet.
The request involves several variances which are: (1) street yard setback to
10 feet; (2) reduce required 20 feet needed for a carport facing a street to 15
feet; and (3) reduce required open space per unit to 150 square feet.
Mr. Bruce reminded the board they must make the following findings in granting a
variance:
