SUBJECT:
Right-of-Way Acquisition and Improvement Plans for the South
Side of 'Orcutt Road - Bullock to Laurel, City Plan No. S-15B.
CAO RECOMMENDATION:
A. By motion, approve property acquisition agreement with Mrs.
Vivian L. Bullock and authorize the City Engineer to sign,
authorize the CAO to approve the final plans and
specifications for related improvements, and authorize the
CAO to award contract if lowest responsible bid is within
Engineer's Estimate. .
B. By motion authorize staff to include in the project pavement
modifications to allow bike lane and left turn lane at Laurel
Lane and authorize the transfer of $15, 000 from the Capital
Outlay Control Account.
DISCUSSION:
This property acquisition was identified in the 1991-92 Capital
Improvement Plan (E-8) . The property being acquired in this
agreement is on the South side of Orcutt Road at the intersection
of Laurel Lane. Additional right-of-way will be necessary in the
future at this location if and when the City chooses to construct
the railroad overcrossing for Orcutt Road. Last year the City
acquired the property to the west and has owned the property to
the east for many years. '
This agreement (Exhibit 1) calls for the City of San Luis Obispo
to pay Mrs. Bullock $19, 105, which is the appraised value, for
the land to be acquired. It also calls for the City of San Luis
Obispo to construct improvements (Exhibit 2) along the
property's frontage. These improvements are curb, gutter &
sidewalk, pavement, a block wall, driveway realignment and
landscaping. The estimated cost of these improvements is
$30, 000. The improvements have been discussed with Mrs. Bullock
and are those she has requested.
Staff proposes the project also to include a pavement transition
on the southerly side of Orcutt Road between the railroad and
this acquisition (Exhibit 5). The pavement transition will allow
a left-turn only lane for eastbound Orcutt Road traffic to turn
north on Laurel Lane, and an eastbound bicycle lane. The
estimated cost for this additional work is425, 000.
This project is compatible with the plans for medians on Orcutt
Road westerly of the railroad tracks as discussed with the
Council last year.
There is always a concern about the potential of hidden hazardous
materials when acquiring property. Staff has discussed with Mrs.

also asked about the potential of contamination of this property
from the former service station across the street. These
conversations lead staff to believe that we would not find
hazardous materials on this property if we conducted underground
exploration.
CONCURRENCES:
The city has processed a request for variance for wall height to
allow this wall and it was granted on January 3, 1992 by the
Community Development Department Zoning Hearing officer (Exhibit
3) . The Community Development Department has granted a negative
declaration of environmental report for the construction portion
of the project. (Exhibit 6) Architectural review has already been
completed and approved (Exhibit 4),.
FISCAL IMPACT:

The total estimated cost for the right of acquisition portion of
this project is $50, 000. The amount set aside for this in the
Capital Improvement Program is $60, 000 (Page E-8) . If the unused
portion of the amount budgeted is augmented by an estimated
$15, 000 from the Capital Outlay Control Account the additional
street improvements can be carried out which provide for the bike
lane, left turn lane to Laurel Lane and a smooth transition for
east bound traffic on Orcutt Road.
ALTERNATIVES:
1. Decline to proceed with the acquisition of the right-of-way
by not approving the agreement.
2. Decline to approve the agreement and direct staff to
negotiate further. Council should give staff direction if
this alternative is chosen.
3 . Approve the agreement but defer the improvements called for
in the agreement to a future date.

4. Approve the agreement and construct only those improvements
that relate directly to the agreement and defer any
improvements requiring the transfer of additional funds.

PROPERTY ACQUISITION AGREEMENT
This agreement between Vivian Lucille Bullock and the city of
San Luis Obispo, California is for the acquisition of a portion of
property known as 1049 Orcutt Road, San Luis Obispo (APN 053-071-
003) . The portion of property to be acquired by the City is
described in the attached Exhibit A.
The terms of the agreement have been discussed between Mrs.
Bullock and Wayne Peterson, City Engineer of the City of San Luis
Obispo, and are fully described below.
Purpose of Acquisition:
The City wishes to acquire the property described in Exhibit
A* at this time to allow for the widening of Orcutt Road and the
realignment of Bullock Lane. All of the costs related to the
street widening and other improvements are the responsibility of
the City.
Agreement
1. The City agrees to immediately open an escrow account for the
acquisition of the property described in Exhibit A at First
American Title Company, 899 Pacific Street, San Luis Obispo.
2 . The City agrees to place in escrow $19, 105 which is the full
purchase price of the property described in Exhibit A.
3 . The City agrees to allow Mrs. Bullock to use the property
being purchased as her own until the City is able to begin
construction of the proposed street improvements, provided
City shall not be liable for any damage to or removal of
property within the area being purchased used by Mrs. Bullock
after the close of escrow.
4 . The City agrees to construct the street improvements in a
manner similar to that shown on the attached Exhibit B. Said
improvements will include curb, gutter, sidewalk, pave out,
fence repair, and noise mitigation measures in the form of a
solid wall located at the back of the sidewalk to screen her
home from vehicle head lights and noise.
5. Mrs. Bullock agrees to sign documents prepared by the title
company named above to transfer the property described in
Exhibit A to the City.
6. The City agrees to construct a new driveway of similar
material (all-weather) as the existing drive out to the future
alignment of Bullock Lane and then along Bullock Lane to
Exhibit 1 C•3-.S
Orcutt Road. When Bullock Lane is constructed, vehicular
access will continue to be allowed.
7. Mrs. Bullock agrees not to object to the street widening
project proposed for construction as a result of this property
acquisition providing her concerns for screening are met.
Screening shall not be limited to the block wall (Item 4 ,
above) , but shall include landscape materials, the purpose of
which is to ameliorate the effect of the block wall upon the
Bullock property. The placement, size and type of landscaping
materials to be mutually determined by Mrs. Bullock and the
City of San Luis Obispo
8. Both parties agree to expedite the process so that escrow may
close within 90 days of the date it is opened.
9. The City agrees to be responsible for all escrow costs.
10. The City agrees that when it constructs Bullock Lane along the
Westerly side of the Bullock Property to connect at the
intersection of Orcutt Road and Laurel Lane, that it will
construct a 6-foot high wooden fence along the Bullock
property line, beginning at the Southerly end of the block
wall at Orcutt Road and continuing South to the North edge of
the Bullock driveway.
11. Mrs. Bullock agrees to maintain her driveway constructed by
City (see item 6) to Orcutt Road until Bullock Lane is
constructed, and then to Bullock Lane.
12. . Both parties agree that future vehicular and pedestrian access
rights are not being purchased or in any way restricted beyond
that which might be conditioned as a result of City approval
of a future project on the Bullock property.
13 . The City will own and maintain the block sound wall along
Orcutt Road., and Mrs. Bullock will maintain the curb, gutter
and sidewalk along her property's frontage as is customary of
property owners in the City.

Dear Wayne:
On Friday, January 3 , 1992 , I conducted a public hearing on your
request to allow a 6-foot high wall in the street yard setback, at
the subject location.
After reviewing the information presented, I approved your request,
based on the following findings and subject to the following
conditions:
Findings
1. The proposed wall and fence will not adversely affect the
health, safety and welfare of persons living or working at the
site or in the vicinity.
2. No public purpose will be served by strict compliance with the
height limit for this wall and fence.
3 . The proposed use is exempt from environmental review. ,
conditions
1. The wall shall be constructed of split-face concrete block,
to allow vines to grow on it more easily, and to create a more
attractive appearance.
2. A gated pedestrian access shall be provided toward the
easterly end of the block wall on the Orcutt Road frontage,
with design and location subject to the approval of the
Community Development Director and property owner.
My decision_ is final unless appealed to the Planning Commission
within ten days of the action. An appeal may be filed by any
person aggrieved by the decision.

If the use or . structure authorized by this use permit is not
established within one year of the date of approval or such longer
time as may. be stipulated as a condition of approval, the use

Orcutt Road Widening
PROJECT DESCRIPTION AND ENVIRONMENTAL SETTING
The project is the widening of Orcutt Road on the southerly side
only, from Bullock Lane to Laurel Lane. To make room for the new
pavement, twelve trees are proposed to be removed. Replacement
planting is the installation of three fifteen-gallon Chinese
evergreen elms near the intersection of Orcutt and Laurel, plus two
five-gallon pyracantha bushes and eight five-gallon India Hawthorne
shrubs.
The widening is the first phase of a more extensive project. Later
development includes the realignment of Bullock Lane to intersect
with Laurel Lane. Because of future changes, a sidewalk is not
proposed along the south side of orcutt Road, between Bullock and
Laurel Lane. For the same reason, additional tree planting in the
affected area is not proposed. The exact dates for the more
extensive work are not yet known, but it likely to be several
years.
In this phase, the road will be widened as much as possible within
existing rights-of-way, resulting in the narrowest portion being
near Bullock Lane, and the widest portion where the the new
pavement connects with the existing four-lane section at the
easterly end of the project. A new driveway will be created on
Orcutt Road, at the southerly end of Laurel Lane, providing access
to a garage behind an existing house. A six-foot-high block wall
will be installed along the frontage of that same property, turning
the corner at the west side of the house and continuing in a
southwesterly direction. The wall is for noise reduction and
safety. The alignment of the wall on the west side is to
accommodate future realignment of Bullock Lane, which will
ultimately run parallel to the wall.
POTENTIAL IMPACTS
Community Plans and Goals
Transportation and Circulation
Orcutt Road, within the city limits, is classified as an arterial
street in the City's adopted Circulation Element (1982) . According
to that plan, arterial streets "provide circulation between major
activity centers and residential areas in the city" , and are
intended to have from two to four travel lanes, and a right-of-
way width of 64 ' to 841 . Among the street projects proposed in the
element is the "Orcutt Road Overpass" . This project is the
construction of an overpass over the existing train tracks that
cross Orcutt Road, just west of Bullock Lane. Construction of the
overpass is dependent upon obtaining necessary funding. The
present project is consistent with the ultimate design of Orcutt
Road, as anticipated in the Circulation Element.

Traffic on Orcutt Road and Laurel Lane has increased significantly
over the last several years, as a result of commuter traffic from
and to southerly cities, additional development on the south end
of the city, and a general trend of city-dwellers to have more
automobiles and drive more. Traffic counts for April 1989 indicate
there were about 14, 000 trips daily on Orcutt Road west of Laurel
Lane. A large percentage of these trips, especially in the peak
hours, are left turns onto Laurel Lane. The two existing lanes on
Orcutt Road are often blocked by turning movements, both north- and
south-bound. The level of service along Orcutt Road, east of
Laurel Lane, is currently D.
The street widening will result in a paved width of about 421 , from
the northerly curb (existing) to the edge of a 5 ' -wide shoulder,
and a right-of-way width of about 52 ' through this transitional
area, increasing to the existing 74 ' right-of-way east of the
project. The widening will allow for creation of a left-turn lane
heading northeast from Orcutt Road to Laurel Lane, along with one
driving lane in each direction. These changes should improve the
level of service and the safety of the Laurel Lane-Orcutt Road
intersection.
Plant life.
Twelve trees are proposed to be removed from the south side of
Orcutt Road. All but a large elm are various types of fruit trees.
Fruit trees tend to have relatively short lives and do not grow
very large. Removal of . the fruit trees would not have a
significant impact on the environment.
The elm is the only large tree in the vicinity. It is well-shaped
and attractive. It would be beneficial to the appearance of the
neighborhood to retain this tree. However, it is not a native and
does not provide significant benefit to the natural environment.
The plans include planting of three 15-gallon elms as replacements
for this one tree.
Conclusion: The tree removals are not environmentally significant,
given proposed replacement planting.
RECOMMENDATION
Grant a Negative Declaration of environmental impact.
