8500 postcards were delivered to residences on the north end of the city with SEZ, party reg, SLMC info and
the non-emergency number for calling in noise issues
Public Affairs Mgr Wallace provided a WOW leader presentation on 9/14, a Fraternity Sorority Life presentation
to chapter presidents on 9/20. Wallace is scheduled for IFC, PHC and USFC presentations the first week of
October to cover noise, SEZ and other neighborhood civility topics
The safety enhancement zone for start of school began on Sept. 17 and concludes on Sept. 30.

Thank you for sending copies of the Notices of Violation and Advisory Letters. I am still going through them but
one glaring omission is the main Chapter house for Phi Sigma Kappa at 348 Hathway Avenue . This is one of
the worst offenders in our neighborhood, and it was the origination of St. Fratty's Day in 2009. It has already
started to have fraternity parties this school year. I am not sure how or why it was not included in the NOVs but I
am including information and documentation showing that these addresses are operating as fraternities in R-1
and R-2 zones.
The fraternity has published its rush schedule for Fall 2024 on Instagram (phisigslo) and the linktree in their bio
has the schedule, which is shown below, with events happening the first two weekends of October 2024. As you
can see, their "House Tour" is at the main Chapter house for the fraternity on 10/4/2024 at 348 Hathway Ave, an
R-2 zone. The fraternity's satellite house is at 1908 Loomis Street, an R-1 zone, and has an event scheduled for
10/5/2024. Would you please contact the property owner to stop these events from happening?
Also, please refer to the report I gave you on 11/8/2023 which has the AB 524 report showing these addresses,
social media posts showing events at these addresses, and photos of events at these addresses. (attached) I
have also sent numerous videos to the City of fraternity events at 348 Hathway. I have a video of a loud fraternity
party where they hosted the sorority Delta Gamma on 2/9/2024 as one example of events that have continued to
happen. Unfortunately, this party did not show up on SLOPD dispatch log even though I called. Phi Sigma Kappa

and Delta Gamma will probably show the event on 2/9/2024 in the AB 524 Report to be published on 10/1/2024,
though Cal Poly will not show the address. Still, the event can be inferred by the video (date/time stamped) and
listed events on 2/9/2024 for the Greek organizations.
I have spoken with the owner of the property at 348/350 Hathway Avenue, Gordon McCormick, who lives in San
Jose. (He went to Cal Poly with our daughter and son-in-law.) He acknowledged that he bought the property as
the main Chapter house for the fraternity and fixed it up for the fraternity guys. He thought the use as a fraternity
was "grandfathered in" since it had functioned as a fraternity for so long but I told him that it never had a permit
to operate at that location and the City's zoning regulations only allow fraternities in R-3 and R-4 zones. He has
not cooperated in ceasing operations at the location and the fraternity guys have continued to have fraternity
parties and have had over 20 noise citations in the past couple of years. This property is one of the worst
offenders (with 281 Hathway and 322 Hathway) so I trust you will issue a Notice of Violation with the information
that's been provided.

It is probably not a coincidence that other Cal Poly fraternities that received a NOV or Advisory Letter have not
provided address information related to rush events on their social media pages as they have always done in
previous years. It appears Cal Poly implemented a new policy for the Interfraternity Council (IFC), and potential
new members must register with the IFC ahead of time, and attend a mandatory meeting on Sunday 9/29/2024.
The addresses where rush events are taking place will likely be provided privately to potential new members
rather than publicly posted. This new method of rushing fraternities at Cal Poly may be an attempt to hide the
addresses of rush events from the public and the City, especially since the fraternities have always posted the
dates and times on social media until this year.

neighborhoods. These illegal fraternity operations have been distressing and disruptive to our lives, have kept us
from being able to sleep or enjoy our property, and have affected my husband's ability to go to work because he

We’re open for counter hours Monday and Wednesday from 1:00 pm – 4:00 pm or Tuesday and Thursday from 9:00
am – noon. Otherwise, please contact Stephanie or me to confirm availability. We will be able to sell the signs for
$1.00 each. You would need to fill them out and post them on delineators or barricades (the City only supplies the
cardboard signs, not anything to post the signs on). Please see the instructions below:
Post No Parking signs with: address, start and end date, start and end time, company name, contact information, and
reason for the posting. To create a legal tow-away zone, call the police dept. at 805-781-7312 in advance to have
them view and log the posting a full 24 hours prior to the start. No Parking signs must have these two codes for tow-
away to be enforceable: Municipal Code 10.36.040 and CVC 22651 (m).

A. Call to Order
a. Ashleigh called the meeting to order at 3:10 p.m.
b. Silent roll call was taken and with 13 voting members in attendance, quorum was
met.
B. Approval of Meeting Minutes - #24-09, May 9, 2024
a. Minutes stand approved by consent.
C. Open Forum
a. Kathie and Steve Walker expressed their concerns with the significant noise in the
neighborhoods and stated that they are being targeted by fraternity members.
They urged Cal Poly to consider a “Greek Row”, and to monitor satellite fraternity
houses.
D. Reports
a. Chair/Vice Chair, Ashleigh Spragins, Lucia Landeros
1. Ashleigh introduced herself and stated that she has high hopes working
with this committee.
2. She reported that the ASI Executive Cabinet has two secretaries focusing
on civic engagement: Secretary of Civic Engagement and Secretary of
External Affairs.
3. Lucia introduced herself and shared events on the Cuesta campus including
welcome events, a basic needs campaign, alumni networking, and internship
opportunities. She reported that she attended a student trustee conference.
b. City Manager – Whitney McDonald
1. Whitney introduced herself and stated that she felt that SCLC work is
important for quality of life, to help solve problems, and grow connections.
2. She gave city updates including:
a. Transit system planning process improving route frequency, electric
busses, and examine rider impact.
b. Grand Avenue improvements.
c. Election season – two mayoral candidates, and five council member
candidates.
d. Presenting City 101 to the ASI Board of Directors in September.
c. Neighborhood Wellness Civility Report – Christine Wallace
i. Absent.
d. Residents for Quality Neighborhoods – Brett Cross
i. Brett mentioned the R1 and R2 satellite homes and the activities taking place.
He stated that Cal Poly is no longer maintaining the list of satellite houses. He
asked why this information is not shared with the city. Ashleigh stated that she
will follow up on the question.
e. Community Representatives Reports – Abe Lincoln & Mila Vujovich-LaBarre
i. Abe welcomed everyone back. He mentioned proposing funding for a
“Welcome back event” for students and permanent residents to encourage
starting the year off on the right foot. Members discussed possible
recommendations for “good neighbor” ideas, including welcome video, positive
messaging, simple introduction to neighbors.
ii. Mila applauded the Walkers for raising their concerns in their neighborhood.
The video shows harassment and being personally assaulted. She agreed with
the idea of a “Greek Row.”
iii. She encouraged members to share that the Sierra Club is encouraging
volunteer participation.

a. Overview of SCLC
i. Ashleigh read the mission of SCLC:
a. The mission of the Student Community Liaison Committee (SCLC) is to
serve as a mechanism for communication among Cal Poly State University,
Cuesta College, City and County of San Luis Obispo, and community
organizations and to proactively engage in discussion and actions to
promote positive relations, mutual respect, and improved quality of life for
all citizens of San Luis Obispo.
b. 2024-25 SCLC Meeting Schedule
i. Cuesta members shared that there could be a conflict with Cuesta senate
meetings and SCLC.
ii. Motion #1 (Crawford/Stewart) “Move to table Item B to the next meeting.”
iii. Motion passed unanimous vote.
c. 2024-25 Goal Setting
i. Members participated in a “sticky note” activity using the following prompts:
1. Personal goal for this year
2. Goal for committee as a group
3. Identify one initiative you would like to see completed this year.
4. Goal for the collective group
ii. Members shared ideas from the activity and Ashleigh stated she will compile
the results and bring to the next meeting

1. Neighborhood Wellness. Can we expect to see this reintroduced?
In the past five years this choice has not been included in the biennial survey provided to residents prior to the City Council’s
establishment of Major City Goals. This choice provided residents an opportunity to propose solutions to problems that they
would like to have considered during the budget cycle.
[Neighborhood Wellness was a Major City Goal in budget years 2007-09 (#10), 2011-13 (#3) and 2013-15 (#2). It was an Other
Important Objective in 2015-17 (#1).]
2. Current and future impact of insufficient student housing on the Cal Poly campus. What is the city doing or intending to do to
prevent this tsunami of students looking for housing in our city?
a. Currently there is a dual impact. The most obvious are the effects on student-impacted neighborhoods: nocturnal noise,
traffic, parking, trash, vandalism, property condition, sometimes harassment, sometimes retribution. The other impact is the effect
on the cost of housing, both buying and renting - since they are based on the price that can be obtained by renting to multiple
students.
b. Future impacts are based on Cal Poly’s stated intention at an October 2023 City Council meeting to increase enrollment by
300-500 students per year before increasing on-campus housing - which is projected to take 10 years! Plus, the addition of a
summer quarter and year-round classes will have an added, detrimental, affect on both our neighborhoods and our housing since
these students will also need to be housed.
[Cal Poly is building a staff/faculty housing development on Slack Street because of the housing problem they created]
3. Illegal fraternities in R-1/2. What is being done, how can it be stopped and how long will it take?
The fraternity parties and events are destroying residential quality of life in parts of our city. There are fraternities and fraternity
satellite houses sprinkled all over the Alta Vista and parts of the Monterey Heights neighborhoods.
a. On Thursday through Sunday from 14 September - 17 December 2023 there were 544 party calls, which averages 38.8
calls each weekend. This includes the 120 parties held over Halloweekend. Of the calls that received a Citation or a Disturbance
Advisement Card (DAC) one reported 200 attendees, thirteen reported between 100 and 150, and twenty-eight reported between
50 and 80. These are the heavy party nights and does not include parties held on other nights.
b. On Thursday through Sunday from 11 January - 16 June 2024 there were 661 party calls, which averages 28.7 calls each
weekend. This includes the St Fratty’s Day parties. Of the calls that received a Citation or a Disturbance Advisement Card (DAC)
two reported 280-300 attendees, seventeen reported between 100 and 150, and thirty-four reported between 50 and 95. These
are the heavy party nights and does not include parties held on other nights.
4. St Fratty’s Day. We know this can’t be stopped overnight, but what is the plan to eventually stop it? And what does the city
think of the plan Cal Poly mentioned at SCLC to sanction St Fratty’s Day, but to hold the event in an area of the city’s (Alta Vista)
neighborhood?

We cannot allow neighborhoods to be inundated and vandalized every year by thousands of Cal Poly students and their
guests. This is a made-up event which was designed by students to circumvent the double fines that, at the time, were only in
effect on St. Patrick’s Day.
5. You have mentioned on a couple of occasions that you look forward to continuing/deepening relationships with community
members. What is your definition of a “community member?”
We seem not to be notified or invited to participate in areas where the outcome would affect residents.

A. Noise Disturbances Prohibited. No person shall make, continue or cause to be made or continued, or
permit or allow to be made or continued, any noise disturbance in such a manner as to be plainly audible
at a distance of fifty feet from the noisemaker; provided, nothing in this section shall be construed to
prohibit any noise which does not penetrate beyond the boundaries of the noisemaker’s own premises or
does not constitute an unreasonable disturbance to people lawfully on said premises.
B.1. a. Between the hours of 10pm and 7am in such a manner as to create a noise disturbance across a
residential or commercial real property line or at any time to violate the provisions of Section 9.12.060 of
this chapter, except for activities for which an exception has been issued by the noise control office.
B.2. Loudspeakers (Amplified Sound). Using or operating for any purpose any loudspeaker, loudspeaker
system or similar device between the hours of ten p.m. and seven a.m., such that the sound therefrom
creates a noise disturbance across a residential real property line, or at any time violates the provisions
of Section 9.12.060 of this chapter, except for any noncommercial public speaking, public assembly or
other activity for which an exception has been issued by the noise control office.

The Gommission suggested that if the fraternity received four violations of the Gity's noise
ordinance or property maintenance regulations within 12 months, the CUP would automatically
be reviewed by the Planning Gommission. This was recommended in public correspondence,
and a similar condition (#10) was included in the previous GUP for this property. City Staff Tyler
Corey said that condition is already covered in the GUP in Condition #3. However, there is a
distinct difference between Condition #3 and the condition proposed by the Commission.
Condition #3 requires a written complaint from any citizen, whereas the condition suggested by
the Gommission would be an automatic trigger for review when a certain threshold of code
and/or noise violations is met. The difference is that many residents do not feel comfortable
signing their name to a complaint for fear of retaliation - which they are aware that some
residents have experienced.
Even so, in February 2024 a wriften complaint was filed regarding noise violations of a different
fraternity's CUP. ln this case there were six noise citations, including two unruly gatherings, in
10 months. To date there has been no action taken to bring this to the Planning Commission.
Since that submission said fraternity has had five additional noise violations, most with parties
of 100 people. A second complaint against the fraternity's CUP was filed in June 2024 included
those additional five noise complaints.
Without enforcement of the conditions, a GUP is meaningless. As the Gommission said during
the hearing, the GUP needs to have teeth.
The Commission also suggested violations should accumulate against the parcel (APN #052-
071-030) instead of separately against the six individual addresses on the parcel since it is one
parcel, one owner, one CUP and the property is occupied exclusively by Lamda ChiAlpha. This
was also suggested in written and oral comments. Staff said this already happens. However, it
does not appear that it does happen, or will unless there is a condition that so states.
There are six separate addresses on the same parcel under this CUP. Potentially, each address
could be issued a "first citation" for $350 before the fines increase. Since there is one CUP for
Lamda ChiAlpha that covers all six addresses it seems reasonable that a citation against any of
them would be counted as a citation against the one property, the one CUR and not treated
separately. lt is, in fact, one entity - the fraternity - that occupies each of the addresses on a
single parcel. This condition would have held the fraternity collectively responsible for code
and/or noise violations.
A condition included in most of the existing fraternity CUPs, as well as in the property's former
GUP and recommended in public correspondence, but not discussed or included is as follows:
Failure to comply with any of the above conditions or code requirements, or the conduct of the
use so as to constitute a violation of Federal, State, or local law, or so as to constitute a public
nuisance or so as to cause adverce impacts on the health, safety, or welfare of persons in the
vicinity of this use is prohibited and may constitute grounds for the revocation of this permit."
Our aim with this appeal is in concert with the provisions of Land Use Element Policy 2.1,
Neighborhood Focus which states: "The Gityr shall preserve, protect and enhance the City's
neighborhoods and strive to preserve and enhance their identity and promote a higher quality
of life within each neighborhood," This is about the quality of life for those living or working in
the Alta Vista neighborhood.

APPROVING A USE FERMIT TO ALLOW A FRATERNITY AT
PROPERTY LOCATED ON FOOTHILL BOULEVARD BETWEEN
CALIFORNIA AND CRANDALL WAY;

WHEREAS, the Planning Commission of the City of San Luis Obispo conducted
a public hearing in the Council Chamber of City Hall, 990 Palm Street, San Luis Obispo,
California, on October 10, 2001, for the purpose of considering Application U 86-01,
Use Permit to allow a fraternity at 1264 and 1264 Yz Footltill Boulevard; and
WHEREAS, notices of said public hearing were made at the time and in the
manner required by law; and
WHEREAS, the Planning Commission has duly considered all evidence,
including the testimony of the applicant, interested parties, and the evaluation and
recommendations by staff, presented at said hearing.
NOW THEREFORE, BE lT RESOLVED by the Planning Commission of the City
of San Luis Obispo as follows:
Section 1. Findings. Based upon all the evidence, the Commission makes the
following findings:
The proposed use, as conditioned, will not be detrintental to the health, safety and
welfare of persons living or working in the area, because limits on hours for events
and numbers of persons allowed on site will restrict activities and limit disturbances
to neighbors.
The subject use is appropriate at the proposed location, and will be compatible with
surrounding land uses provided that the fraternity complies with all conditions at all
times.
3. The proposed use conforms to the general plan because it is a group housing use,
which the general plan says is appropriate for High-Density Residential areas.
4. The proposed use meets zoning ordinance requirements because it is a fraternity in
a High-Density Residential (R-4) zone, where fraternities are allowed with approval
of a Planning Commission use permit.
S. The proposed use is exempt from environrnental review requirements because it is a
residentlal use similar to the existing uses on the property (Class 1, Existing
Facilities, Section 15301 of the CEQA Guidelines)'
Section 2. Action. The Planning Commission approved Use Permit, U 8&01,
subject to the following conditions:

Conditions
1. No more than five persons shall reside at the site at any time. The applicant shall
allow the City to verify occupancy by allowing an inspection of the records or. by a
visual inspection of the premises. Any inspection shall be at a reasonable time and
shall be preceded by aZ{-hour notice to the residents.
2. A minimum of six on-site parking spaces to city standards shall be provided and
maintained at all times for the intended use. ,
3. The applicants shall improve the existing parking lot to meet the City standards for
parking space and driveway dimensions, aisle widths, striping and wheel stops prior
to establishing the fraternity use, to the approval of the Community Development
Director.
The property shall be maintained in a clean and orderly manner. All plant materials
shall be maintained and replaced as necessary.
The maximum number of persons allowed on the site for routine meetings an
gatherings is 18, except as specifically approved by the Community Development
Director for special events. For such special events, the applicant shall also submit a
parking and transportation plan.
No meetings, parties, or other types of similar activities involving persons otherthan
residents are allowed between the hours of 10 p.m. and 9 a.m., except as approVed
by the Community Development Director.
The applicant shall institute and maintain a neighborhood relations program. This
plan shall include at least the following elements:

Submission of names and telephone numbers of responsible persons, including
the alumni president and chief financial officer, to the Community Development
Department and to the neighbors within two blocks of the house. Responsible

Evidence of implementation of said plan shall be submitted to ihe director for review
each year. Failure to exercise reasonable efforts to implement said plan may be
grounds for revocation of this permit.
8. Events, including meetings or parties, on site, shall be limited to those listed on a
meeting and aJtivities slhedule, submitted to and approved by the Community
Development Director in the fall of each year. The Community Development Director

9. There shall be no freestanding signs on the premises. Signs shall be limited to signs
located on building faces or fences.
10. Use permit shall be reviewed if the City receives any reasonable written citizen or
Police or Fire Department complaints, or if two convictions are received for violations
of the City's noise or property maintenance regulations within a six-month period. ln
review of the use permit, the Planning Commission may add, delete or modify
conditions of approval, or revoke the use permit. The Planning Commission may
consider adding a condition requiring fraternity officers to perform a community
service project in the neighborhood.
11.|f California Polytechnic State University revokes the fraternity's charter, thp City
shall review the use permit. ln review of the use permit, the Planning Commission
may add, delete or modify conditions of approval, or revoke the use permit.
12. The Community Development-Building Division and Fire Department shall inspect
the property and house for compliance with City Building and Safety Standards. The
use permit shall not become effective until the premise has been determined to be in
cornpliance with all applicable City standards.
13. Failure to comply with any of the above conditions or code requirements, or the
conduct of the use so as to constitute a violation of Federal, State, or local law, or so
as to constitute a public nuisance or so as to cause adverse impacts on the health,
safety, or welfare of persons in the vicinity of this use is prohibited and may
constitute grounds for revocation of this permit.

WHEREAS, the Planning Commission of the City of San Luis Obispo has duly
considered all evidence, including recommendations by staff, presented at said hearing;
and
WHEREAS, notices of said public hearings were made at the time and in the
manner required by law; and
NOW, THEREFORE, BE lT RESOLVED by the Planning Commission of the City
of San Luis Obispo as follows:
SECTION 1. Findings. The Planning Commission hereby grants final approval for
the project (USE-0331-2A23r, based on the following findings:
Conditional Use Permit / Fraternity Use '
1. The project is consistent with the General Plan because the proposed fraternity is
an allowable use as dense group housing in the High Density Residential (HDR)
land use designation. ln addition, the project would facilitate Land Use Element
Policy 2"6.5 and Housing Element Policy 8.6 by locating a fraternity in proximity to
the Cal Poly SLO campus and other student-oriented uses and housing.
2. The proposed fraternity is conditionally allowed within the High-Density Residential
R-4) zone. As conditioned, the project complies with applicable provisions of the
Zoning Regulations because (a) the maximum number of 24 residents complies
with the group housing maximum occupancy limits and (b) the revised parking
configuration would provide 1B required spaces for 24 residents and comply with
the City's Parking and Driveway Standards to improve the property.

3. The design, location, size, and operating characteristics of the project will be
compatible with the existing and future land uses in the vicinity because the
proposed fraternity would (a) be established in proximity to other dense group
housing (i.e., other fraternities, sororities, multi-family, etc.), (b) located within
walking distance (i.e., less than 0.25-mile) of the Cal Poly campus, and (c) utilize
an existing developed property with minor site improvements (i.e., parking and
landscaping improvements).
4. The site is physically suitable in terms of (a) its design, Iocation, shape, size, and
operating characteristics of the project; (b) traffic generation and the provision of
public and emergency vehicle (e.9., fire and medical) access; (c) Public protection
services (e.9., fire protection, police protection, etc.); and (d) the provision of
utilities (e.g., potable water, schools, solid waste collection and disposal, storm
drainage,'wastewater collection, treatment, and disposal, etc.). The project is
surrounded by other developed properties with compatible dense housing uses,
has access to the City's circulation system, and would be served by City utilities.
The project utilizes an existing developed property and does not include activities
that would generate service or utility demands beyond those anticipated with uses
permitted in the vicinity.
5. As conditioned, the project will not be detrimental to the health, safety, and welfare
of persons living or working at the site or in the vicinity because conditions have
been included that place limits on the number of persons allowed on site, restrict
activities, provide adequate parking, and limit potentialdisturbances to neighboring
properties. The project will be compatible with the eiisting site constraints antJ the
character of the neighborhood.
6. As conditioned, the establishment and subsequent operation or conduct of the
project will not, because of the circumstances a;rd conditions applied in the
particular case, be detrimental to the health, safety or welfare of the general public
or persons residing or working in the neighborhood of the use, or be detrimental
or injurious to property or improvements in the vicinity of the use because the
project includes conditions that (a) place limits on the number of persons allowed
on site, (b) restrict activities, (c) provide adequate parking, and (d) limit potential
disturbances to neighboring properties. The project would be compatible with the
existing site constraints and the character of the neighborhood.
SECTION 2. Environmental Review. The project is exempt from environmental
review under Section 15301. (Existing Facilities) of the CEQA Guidelines because it
includes the operation, maintenance, permitting, licensing, and minor alteration of an
existing residential development. The fraternity would continue the residential use with
minor site improvements related to parking (e.9., parking space restriping, installation of
wheel stops, etc.) and landscaping (e.9., pruning, maintenance, etc.). The project does
not include construction of a new building or additional building square foofage.
Therefore, the project involves no expansion of the former residential use.

SECTION 3, Action. The Planning Commission hereby grants final approval to the
project with incorporation of the following conditions: '
Planning Division - Community Develapment Department
1. Plans submitted forthe building and/orsite improvements permit(s) (i.e^, parking
lot improvements)shall be in subsiantial conformance with the project description
and plans represented in the Staff Report dated June 12,2A24.
2. The Conditional Use Permit shall be reviewed by the Community Development
Director for compliance with the conditions of approval, or to determine whether a
modification of the Ccinditional Use Permit is necessary upon significant change
to the project as represented in the Staff Report dated June 12, 2024, or in the
event of a change in ownership which may result in deviation frorn the project
description or approved plans.
3. The Conditional Use Permit shall be reviewed by the Planning Commission if the
City receives substantiated written complaints from any citizen, Code
Enforcement Officer, Fire Department or Police Department employee, which
contains information and/or evidence supporting a conclusion that a violation of
this Conditional Use Perrnit, or of City Ordinances, regulations, or Police
Department resources (e.g.,.calls for service) applicable to the fraternity use has
occurred. At the time of the Conditional Use Permit review, to ensure ongoing
compatibility with nearby uses, the conditions of approval may be added, modified,
and/or removed, or the Conditional Use Permit may be revoked.
4. The fraternity shall be limited to a maximum of 24 residents for the property. The
property owner shall allow the City to verify the maximum occupancy by allowing
an inspection of records or visual inspection of the premises. Any inspection shall
be scheduled at a reasonable time with at least 24-hour notice to the residents.
5. Routine meetings and gatherings for the fraternity shall be limited to a maximum
of 48 people (32 people x 1.5), except as othenruise approved by the Community
Development Director for special events. lf the fraternity hosts special events
involving more than 48 people, a transportation management plan to reduce
impacts to the surrounding neighborhood shall be submitted to the Comrnunity
Development Department, at least 30 days prior to the event taking place, for
review and approval.
6" For the life of the organization, the fraternity shall remain affiliated and in good
standing with the lnterfraternity Council of Stud'ent Life and Leadership at
California Polytechnic University, San Luis Obispo. lf the fraternity becomes
unaffiliated or is no longer in good standing, the Conditional Use Permit shall be
revoked.

7. For the life of the organization, the fraternity shall provide the name and contact
information (i.e., phone number and email address) of all responsible parties to
the Community Development Department and Neighborhood Services Manager
of the Police Department on an annual basis. lf there is a change to the name
and/or contact information of any responsible parties, the Community
Development Depadment and Neighborhood Services Manager shall be notified
immediately.
B. For the life of the organization, the property shall be maintained in a clean and
orderly manner. All landscaping shall be maintained (e.9., trimmed, pruned,
replaced as needed, etc.) to the satisfaction of the Community Development
Director.
L A site improvement permit is required for parking area improvements to create a
minimum of 1B parking spaces that comply with the City's Parking and Driveway
Standards (i.e., parking space and driveway dimensions, aisle widths, striping,
wheel stops, etc.). These parking spaces shall be inspected to verify compliance
with City standards prior to establishing the fraternity.
10. Bicycle parking spaces shall be provided as required per Table 3-6 (Required
Bicycle Parking) of the Zoning Regulations. For a total of 24 beds for the fraternity,
the property owner and residents shall maintain a rninimum of 18 long-term bicycle
spaces and a minimum of six (6) short-terrn bicycle spaces. All required long-term
bicycle parking shall be provided in an interior space, and required short-term
bicycle spaces shall be consistent with the City Active Transportation Plan Design
Guidelines and feature "hi-low style" campus racks (such as "Peak Racks"). These
bicycle spaces shall be inspected to verify compliance with City standards prior to
establishing the fraternity, to the satisfaction of the Public Works and Community
Development Directors.
11.A minimum of 18 parking spaces shall be provided and maintained at all times.
These spaces shall remain available to residents of the fraternity and not
designated for any individuals not residing on the property.
12.A building permit is required for proposed signage identifying the fraternity house.
Any signage must be consistent with Chapter 15.40 (Sign Regulations) of the
Municipal Code and compatible with the existing neighborhood to the satisfaction
of the Community Development Director. ,
13.As part of the parking area improvements, the existing two-car garage far 1264 lz
East Foothill (labeled as Building B on the project plans) shall be a one-car garage
in order to accommodate the revised surface parking layout. The area adjacent to
the parking space within the proposed one-car garage is permitted as storage.
Further review shall be required if any improvements (e.9., change in use and/or
new construction) are proposed for this area.

14.The fraternity use shall comply with Table 1 (Exterior Noise Limits) of Section
9.12.060 (Exterior Noise Limits) between the extended hours of 10:00 pm and
9:00 am, except as approved in writing as a special event by the Community
Development Director.
15.Prior to a special event approved by the Community Development Director
pursuant to Condition No. 5, the fraternity shall provide written notification of the
event to occupants within 300 feet of the site. The written notification shall include
the date, hours, and contact information for the responsible party for the special
event.
16.Live entertainment, bands, and/or amplified sounds are prohibited, unless
othenruise approved through a special event by the Community Development
Department.
Engineering Division - Community Develapment / Public Works Departments
17.A building permit and/or site improvements permit is required forthe proposed
changes to establish the required parking spaces. Plans submitted for review shall
show and note compliance with the City's Parking and Driveway Standards. The
plans shall show required dimensions and information for parking space, bay,
aisle widths, striping, parallel space markings (i.e., T's and L's), and any existing
or proposed wheel stops.
18. Plans submitted for review shall show and reference the floor plans forthe existing
garages to remain. The existing two-car garage proposed to accommodate only
one car shall be included and noted on the plans. The plans shall clarify that
garage door operation will not be affected by the proposed adjacent surface
parking space. The plans shall clarify that the remaining garage space is to remain
as garage storage/shop.
lndemnification
19.The applicant shall defend, indemnify, and hold harmless the City and/or its
agents, officers and employees from any claim, action or proceeding against the
City and/or its agents, officers, or employees to attack, set aside, void or annul,
the approval by the City of this project, and all actions relating thereto, including
but not limited to environmental review ("lndemnified Claims"). The City shall
promptly notify the applicant of any lndemnified Claim upon being presented with
the lndemnified Claim and the City shallfully cooperate in the defense against an
lndemnified Claim.

a. Kathie and Steve Walker expressed their concerns with the significant noise in the
neighborhoods and stated that they are being targeted by fraternity members.
They urged Cal Poly to consider a “Greek Row”, and to monitor satellite fraternity
houses.

a. Chair/Vice Chair, Ashleigh Spragins, Lucia Landeros
1. Ashleigh introduced herself and stated that she has high hopes working
with this committee.
2. She reported that the ASI Executive Cabinet has two secretaries focusing
on civic engagement: Secretary of Civic Engagement and Secretary of
External Affairs.
3. Lucia introduced herself and shared events on the Cuesta campus including
welcome events, a basic needs campaign, alumni networking, and internship
opportunities. She reported that she attended a student trustee conference.
b. City Manager – Whitney McDonald
1. Whitney introduced herself and stated that she felt that SCLC work is
important for quality of life, to help solve problems, and grow connections.
2. She gave city updates including:
a. Transit system planning process improving route frequency, electric
busses, and examine rider impact.
b. Grand Avenue improvements.
c. Election season – two mayoral candidates, and five council member
candidates.
d. Presenting City 101 to the ASI Board of Directors in September.
c. Neighborhood Wellness Civility Report – Christine Wallace
i. Absent.
d. Residents for Quality Neighborhoods – Brett Cross
i. Brett mentioned the R1 and R2 satellite homes and the activities taking place.
He stated that Cal Poly is no longer maintaining the list of satellite houses. He
asked why this information is not shared with the city. Ashleigh stated that she
will follow up on the question.
e. Community Representatives Reports – Abe Lincoln & Mila Vujovich-LaBarre
i. Abe welcomed everyone back. He mentioned proposing funding for a
“Welcome back event” for students and permanent residents to encourage
starting the year off on the right foot. Members discussed possible
recommendations for “good neighbor” ideas, including welcome video, positive
messaging, simple introduction to neighbors.
ii. Mila applauded the Walkers for raising their concerns in their neighborhood.
The video shows harassment and being personally assaulted. She agreed with
the idea of a “Greek Row.”
iii. She encouraged members to share that the Sierra Club is encouraging
volunteer participation.

a. Overview of SCLC
i. Ashleigh read the mission of SCLC:
a. The mission of the Student Community Liaison Committee (SCLC) is to
serve as a mechanism for communication among Cal Poly State University,
Cuesta College, City and County of San Luis Obispo, and community
organizations and to proactively engage in discussion and actions to
promote positive relations, mutual respect, and improved quality of life for
all citizens of San Luis Obispo.
b. 2024-25 SCLC Meeting Schedule
i. Cuesta members shared that there could be a conflict with Cuesta senate
meetings and SCLC.
ii. Motion #1 (Crawford/Stewart) “Move to table Item B to the next meeting.”
iii. Motion passed unanimous vote.

Your first email said that Cal Poly removed the addresses of the sanctioned events from its AB 524 Reports

statement about other CSUs not publishing the address of their sanctioned events is not true. In my response, I
pointed out that the CSU system created a template that specifically says "Address On/Off Campus" in the
column heading for each sanctioned event. It does not say "City" in the heading, yet Cal Poly replaced every
address with "San : Luis Obispo."
Your latest email says: "Cal Poly originally understood that none of the CSUs published addresses of event
locations. We investigated further and found that you are correct about some other CSUs sharing the addresses. It is true
that the majority do not."
Again, your statement that the majority of the 23 CSUs do not publish the exact address is not true. I have
looked at their reports and more than half, which is the majority, DO publish the addresses for their sanctioned
events. That's not really the point of my correspondence, but I wanted to make you aware that the information
you've provided is not true.
You originally contended that Cal Poly "realized" it was the only CSU to post the addresses of sanctioned
events, and that was the reason they decided to remove the addresses which was untrue. It is obvious that Cal
Poly removed the addresses because the City of San Luis Obispo and Code Enforcement contacted Cal Poly
about the illegal fraternity operations in R-1 and R-2 neighborhoods which were confirmed by the AB 524 Report.
Everyone knows that's the truth. Other excuses are not credible.
Your previous email also said that Cal Poly Greek life "party registration policy and guidelines are going through
the annual update" which implies that they are reviewed annually. But that is not true either. According to Cal

Poly Greek Life, the same party registration policy and guidelines have been in place since they were adopted in
2014 as a result of the Deferred Recruitment Compromise, which was a result of Carson Starkey's hazing death
at a satellite fraternity house. A comparison of the document since 2014 shows it has not changed. It is
disingenuous to claim they are "going through the annual update".
I haven't seen the "annual update" but we all know (without even seeing it) that Cal Poly is rewriting the party
registration policy and guidelines to hide the locations of satellite fraternity houses in our neighborhoods. The
policy that required events to be held at a registered satellite fraternity house will be removed, right? But that
doesn't solve the problem because they will still operate and make our weekends unbearable with their loud
parties.
This was never a problem for Cal Poly until the City of San Luis Obispo Code Enforcement told Cal Poly that
those operations were not legal and sent out Notices of Violation and Advisory Letters to properties. Regardless
of whether Cal Poly hides the locations of their fraternity operations by eliminating "documentation" of their
locations, it is still obvious to those who live near them because of the loud, disruptive parties every weekend.
The illegal fraternity operations have ruined the lives of many people in our neighborhoods who cannot have
peace in their properties from Thursday to Sunday during the academic year.
How can I, our neighborhoods, and the City of San Luis Obispo trust you when you have misrepresented the
facts?
You also did not answer my question about whether Cal Poly keeps track of the main Chapter house for each of
their fraternity houses, including those in R-1 and R-2 neighborhoods. Most of the main chapter houses for
Cal Poly's fraternities are located in R-1 and R-2 neighborhoods . Do you have documentation of the main
chapter houses for each of Cal Poly's fraternities?
You have used the "legal definition" for main Chapter houses that applies only to AB 524, which is brand new
legislation. Does, or has Cal Poly, ever kept a record of the main chapter houses for its fraternities, even if they
aren't owned by the fraternity corporation?

Cal Poly's interpretation of AB 524 is incorrect and many other CSUs have published the addresses of their
sanctioned events on their AB 524 reports. It is a misrepresentation to claim that "Cal Poly is the only one of the
23 CSUs that posted the exact address." Those universities that did not post their addresses are not in
compliance with AB 524. In fact, the CSU system published a template for the AB 524 reports to make it
easier for their school locations to fill out information related to the requirements of AB 524. The
template for sanctioned events specifically states "Address (On and Off Campus", not "location", as
shown below. It is not ambiguous.

Also, I'm sure you agree that it looks suspicious that Cal Poly removed the addresses from their AB 524 report
only after they were contacted by the City of San Luis Obispo, including Code Enforcement, regarding the

houses". And the Assembly Bill's definition. Cal Poly could have its own definition of a chapter house,
especially considering that many of the "chapter houses" for Cal Poly's fraternities are in R-1 and R-2
residential neighborhoods. How does Cal Poly keep track of the main chapter houses for each of their
fraternities? Most CSUs keep track of their chapter house addresses and contact info (owner, landlord, etc.)
even if they aren't owned by the fraternity corporation. Does Cal Poly do this?
I asked if Cal Poly has decided to stop keeping track of its fraternity satellite houses and you did not answer my
question.
I have been tolerant and my patience is running thin because it does not seem that Cal Poly cares about the
neighborhoods or, for that matter, code enforcement and the laws related to fraternity operations in R-1 and R-
2 neighborhoods. We are literally unable to rest, sleep, and enjoy our property on weekends due to the 40
documented fraternities in our neighborhood. Our neighborhood is tired of the abuse and needs meaningful
solutions, including Cal Poly cooperating with its neighbors to solve this problem.
Please let me know what, if any plan is in place to stop the illegal fraternity activity in our neighborhood.

I corresponded with the County Supervisor for District 5 to encourage her to attend the first SCLC meeting this
academic year. I also explained about ongoing issues related to Cal Poly's illegal fraternity operations and
their detrimental effect on neighborhoods in San Luis Obispo, including the effects of noisy parties on my
family and several other people who have reached out to me from various neighborhoods including Alta Vista,
Monterey Heights, and the S. Tassajara/Ramona area. The Supervisor offered a list of people to contact,
including you, so I am reaching out to you for solutions.
I previously emailed you, Courtney, about the ongoing issues but there was never any resolution and the
problem has compounded over the past two years, as more illegal fraternity houses have moved into our
neighborhood. My initial complaints about noise from fraternities in our neighborhood led to targeted
harassment, cyber-stalking (see my email from 4/24/2023 "Ongoing harassment from fraternity tenants at

specifically naming me. Someone also trespassed onto our property on St. Frattys Day (3/16/2024) and came
up to my bedroom window, said my name, then told a bystander that they were friends with the Sigma Pi
fraternity members who lived next to us during the 2022 - 2023 academic year. Each of these events was
captured on our video surveillance.

I also sent the County Supervisor a link to Assembly Bill 524: The Campus-Recognized Sorority and
Transparency Act (AB 524), with the requirements that sororities and fraternities provide specific information
to Cal Poly on or before July 1st, including a list of their sanctioned events and the date, time, and address
location of those events for the previous academic year. Cal Poly published their AB 524 Report for last year
on October 1, 2023, as mandated, including the date, time, and address location of each sanctioned event
held by sororities and fraternities at Cal Poly during the previous academic year 2022-2023. I had already
identified the addresses of fraternity houses, including "satellite houses" before Cal Poly published their AB
524 Report, but was able to cross-reference the addresses to confirm their locations. Most of Cal Poly's main
Chapter houses are "satellite houses" and are not owned by the fraternities. They are rental homes in R-1 and
R-2 residential neighborhoods.
San Luis Obispo Municipal Code (SLOMC) and Zoning Regulations prohibit fraternities and sororities from
operating in R-1 and R-2 residential neighborhoods, which means they are not allowed to hold "sanctioned
events" or "parties" as defined in the Party Registration Policy and Guidelines of Greek life at Cal Poly. I
reached out to Elizabeth Aiello-Coppola at Cal Poly's Greek life office and she directed me to contact SLOPD
and/or Code Enforcement. I then met with City Administration and Code Enforcement, and they began
investigating the illegal fraternity operations. The City's code enforcement supervisor, John Mezzapesa, met
with Cal Poly staff and members of Greek life to explain the SLOMC and Zoning Regulations, and the
prohibition of fraternity and sorority operations in R-1 and R-2 residential neighborhoods.
The City was able to identify over 50 illegal fraternity houses and sent Notices of Violation or Advisory Letters
to those properties. Shortly after the City sent these notifications, Cal Poly staff told John Mezzapesa that Cal
Poly would no longer keep track of their satellite fraternity houses, which include the main Chapter houses for
many of Cal Poly's fraternities. Additionally, during this same timeframe, Cal Poly staff edited their AB 524
Report online and erased all of the addresses for sanctioned events for every fraternity and sorority during the
2022-2023 academic year, and replaced the addresses with the generic location of "San Luis Obispo". It is
evident that Cal Poly took these actions after realizing the illegal operations of their fraternities, and to hide
the information from the City and the public.
The Party Registration Policy and Guidelines were enacted as a part of the Deferred Recruitment Compromise
between Dr. Armstrong and Greek Life Leaders / Keith Humphrey. In 2010, Cal Poly implemented a deferred
rush policy for freshman males that did not allow them to join fraternities until their second quarter. The policy
was a result of the death of Cal Poly student Carson Starkey, who died from acute alcohol poisoning due to
fraternity-related hazing at a satellite fraternity house. Soon after the deferred recruitment was announced,
representatives from the NIC flew to Cal Poly to visit with administrators and spurred a three-year campaign
to restore recruitment of the freshman fraternity members in the fall.
In 2013, Dr. Armstrong entered into the Deferred Recruitment Compromise with Greek leadership and Keith
Humphrey. One commitment in the Compromise was the implementation of a Party Registration Program that
specifically included "satellite houses". Now, Cal Poly has discarded the commitment. It is no longer keeping
track of the fraternity satellite houses and parties at satellite houses will no longer be registered with Cal
Poly's Greek life office, per the commitments in the Deferred Compromise Agreement and Party Registration
Policy. This was confirmed recently when I made a public records request and received a response from the

Public Records Access Officer, Maren Hufton, that "the location of a sanctioned event must be held at a
chapter house or at a 3rd party venue", excluding "a registered satellite house" from the locations that Greek
life parties can be held per the Party Registration Policy. She also confirmed that Cal Poly no longer has a list
of satellite houses.
I am certain Cal Poly understands the risks of alcohol consumption at fraternity houses, including satellite
houses, especially considering that Carson Starkey died from alcohol intoxication at a fraternity event in a
satellite fraternity house. There are at least 50 satellite fraternity houses in Alta Vista and Monterey Heights
that have ongoing fraternity parties, including hosting sororities since the Panhellenic Conference does not
allow parties with alcohol at sorority houses. Is Cal Poly really going to a blind eye to these events?
Another commitment made in the Deferred Recruitment Compromise was that Cal Poly would recruit more
fraternities to campus. In 2016, Cal Poly administration and Greek leaders met with potential fraternities and
chose to add four additional Chapters to Cal Poly: Pi Kappa Phi, Alpha Sigma Phi, Gamma Delta, and Phi Delta
Theta. They are now all members of Cal Poly's IFC. Every one of those fraternities has illegal "satellite houses"
in R-1 and R-2 neighborhoods that operate as full-fledged fraternity houses. Why does Cal Poly continue to
recruit fraternities when they cannot provide a legal location for their operations? It is unfair to the City to bear
that burden and for the residents to live with more and more disruptive parties every weekend that Cal Poly is
in session. Does Cal Poly understand the negative impact that these constant loud fraternity parties have on
the other residents who live near these fraternity houses in the City's neighborhoods? Does Cal Poly care?
Courtney, you followed me out of a city council meeting a couple of years ago and told me that Cal Poly does
care. I asked you, "Really?" because I didn't know whether to believe you or not. Based on the fact that Cal
Poly erased the addresses from their AB 524 Report, and has told the City that they will no longer keep track of
satellite fraternity houses, and has refused narrow records requests that do no legal exemption that allow
them to be withheld, it does not seem that Cal Poly cares about transparency or accountability to the City and
the neighborhoods.
I share Jan Marx's view that the best long-term solution is for Cal Poly to have a Greek Row on campus. This
has been mentioned multiple times since Carson Starkey died at a satellite fraternity house in 2008, the
commitment was included in the Deferred Recruitment Compromise, and the idea is referenced in Cal Poly's
Master Plan. It is also mentioned in San Luis Obispo's General Plan. We, collectively, have reached a tipping
point and there needs to be meaningful progress toward a solution. Until a Greek Row is built, I ask that Cal
Poly work with the City and our neighborhoods to relocate its fraternities into legal locations, in R-3 and R-4
zones, and stop allowing fraternities to host events in R-1 and R-2 residential neighborhoods. We cannot
continue to live with the extreme disruptions that have been created by Cal Poly's fraternities in our
neighborhoods.
Please let me know what solutions you propose and a timeline for implementation. Also please answer these
questions:

Does Cal Poly plan to stop keeping track of satellite houses for its fraternities? In accordance with legal
requirements, Cal Poly publishes the address for each chapter house, which is a residence that is not
owned by the university but occupied by a campus-recognized sorority or fraternity, or a residence that
is owned and occupied by the campus-recognized sorority or fraternity. Cal Poly does not own any
chapter houses.
Does Cal Poly understand that the main Chapter houses for many of its fraternities are "satellite houses"
in R-1 and R-2 residential neighborhoods? Cal Poly recognizes “chapter houses” as defined by the
law. Cal Poly has no control over the location of chapter houses or other houses used by fraternities.
Is Cal Poly changing their Party Registration Policy and Guidelines for Greek life whereby they will no
longer review or list events held at satellite fraternity houses? The current party registration policy and
guidelines are going through the annual update.
Does Cal Poly plan to help fraternities find legal locations for their fraternities? Fraternities are
independent of the university and we do not provide them with legal advice or real estate
services. However, as with all student organizations, we offer guidance and assistance.
Is Cal Poly planning to recruit more Chapters to campus? Cal Poly remains open to having more
chapters.
