swimming pools, solar water heating, and grading. The ordinance
will create a new chapter adopting the 1991 codes with amendments.
Due to the revisions contained in the 1991 edition of the Uniform
Building Code (UBC) , it is no longer necessary to establish
separate Chapters in the Municipal Code to address retaining/garden
walls, swimming pools, and grading. If UBC text is not adequate
for a recognized local condition, minor amendments in the proposed
ordinance simply continue previously adopted standards. A new
chapter in the UBC regulates swimming pool construction and has
been determined to be equivalent to the Municipal Code chapter with
addition of four amendments. The majority of Chapter 10 of the
1991 UBC is the same as the City's grading regulations, and is
amended by the proposed ordinance to retain all previously
established local standards. Brief summaries of all UBC amendments
follow.
Amendments retained from previous code adoptions:
■ Clarification of membership and function of the Board of
Appeals and the Board of Appeals for Disabled Access.
■ Regulations for construction in flood areas and adjacent to
waterways.
■ References to City Council resolutions instead of Uniform
Administrative Code tables for fees.
■ Fire-resistive requirements for construction in the commercial
fire zone (from Fire Code) .
■ Foundation and concrete floor slab requirements due to
expansive soil conditions.
■ Additional requirements for the disposal of on-site surface
drainage.
■ Prohibition on the use of wood shingle and shake roof
coverings (from Fire Code) .
■ Requirement that all new buildings except most detached
residential garages be equipped with an automatic fire
sprinkler system (parallels Fire Code amendments) .
■ Deletion of parapets and fire-resistive corridor construction
as a trade-off for expanded fire sprinkler requirements.
■ Fire-resistive requirements for awnings.
■ Requirements for water well permits.
Amendments that are new:
■ Suspended ceiling requirements inadvertently deleted from the
1991 code.
■ Floodproofing requirements (parallels existing flood
prevention regulations) .
■ Grading requirements (based on existing Chapter 15.44) .
A new component of this code update process is the adoption of the
Uniform Code for Building Conservation (UCBC) . Since use of the
UCBC Appendix Chapter 1 is mandated by State law for strengthening
of unreinforced masonry buildings, staff compared the recently

published UCBC Appendix with the City's unreinforced masonry
building regulations (Ordinance 1203, 1992 Series) and found them
to be identical. However, amendments will continue to recognize
the use of Seismic Zone 3 criteria and the previously approved
administrative regulations.
Attachment 1 summarizes the content and justification for the all
code changes. Attachment 2 illustrates actual text changes for
new amendments to the Uniform Codes.
Conclusion
A goal of this adoption process is to incorporate all local
construction related requirements into one document that is based
on nationally recognized standards. This recommended action is a
"housekeeping" function that will utilize the most current model
construction codes but will retain (by amendment) ALL previously
established provisions not otherwise found in the model code. The
convenience of one document containing all construction regulations
will be of significant benefit to designers, builders, and
enforcement staff.
The content of the proposed ordinance was distributed to the
Contractor's Association and the local chapter of the American
Institute of Architects. No adverse comments have been received.
CONCURRENCES:
The City Engineer's office has reviewed floodproofing and grading
provisions as amended and concurs with the proposal. The Fire
Department supports efforts to consolidate local construction
requirements in one document and concurs with the proposed new
amendments.
FISCAL IMPACT: i
There are no significant fiscal impacts.

DISCUSSION & SUMMARY OF AMENDMENTS
PROPOSED CHAPTER 15.04 OF THE SAN LUIS OBISPO MUNICIPAL CODE
SECTION 15.04 .010 ADOPTION OF CODES
All 1991 editions of the Uniform Codes and the 1990 National
Electrical Code, including standards and appropriate appendices
are adopted in this section.
SECTION 15.04.020 BUILDING OFFICIAL DESIGNATED
This section continues existing text and names the staff
person referenced throughout the Uniform Codes.
SECTION 15.04.030 AMENDMENTS; UNIFORM ADMINISTRATIVE CODE
Amendments to the Uniform Administrative Code (UAC) are as
follows:
A. Section 204 (a) is amended to specify the number of
members on the Board of Appeals, to establish this
board as the appeals board for the Uniform Housing
Code, the Dangerous Buildings Code, and the Uniform
Code for Building Conservation,• and to merge existing
UAC Section 204 (b) with this subsection.
B. Section 204 (b) is added to establish the Appeals Board
for Disabled Access. This subsection includes a
statement of the Board's purpose and adds two
physically disabled members to the Board of Appeals to
create the Board of Appeals for Disabled Access.
C. Section 301(c) is added to include special permit
requirements for construction within 20 feet of the top
of banks adjacent to waterways. This language
currently exists in Section 15.04.050 of the Municipal
Code (MC) .
D-G. Sections 304 (b) , 304 (c) , 304 (e) 2 and 305(h) are amended
to replace fee tables in the UAC with a reference to.
City Council resolutions establishing fees.
H. Fee tables published in the UAC are deleted. See D-G
above.
SECTION 15.04.040 AMENDMENTS, UNIFORM BUILDING CODE
Amendments to the Uniform Building Code (UBC) are as
follows:

A. Chapters 1, 2 and 3 of the UBC are deleted because
administrative provisions are contained in the UAC.
Explanations for deletion of appendix chapters follow.
Chapter 1 deals with minimum standards for life-
safety requirements in existing buildings, and as
a maintenance item, is covered by the Fire Code.
Chapter 12, Division I establishes an alternate
code (CABO One and Two Family Dwelling Code) for
residential occupancies, which is not adopted by
the State of California.
Chapter 23, Division I establishes criteria for
snow load design and is not applicable to the San
Luis Obispo area.
Chapter 26 establishes criteria for concrete
exposed to freezing and thawing, which is not
applicable to the San Luis Obispo area.
Chapter 32 concerns reroofing. Historically, the
Building Division has not experienced problems
resulting from reroofing projects in the City and
has determined that implementation of permits and
inspections required by the Chapter is not
necessary.
Chapter 51, which regulates elevators,
dumbwaiters, escalators, and moving walks, is
superseded by Part 7, Title 24, of the California
Building Standards Code.
Chapter 53 establishes energy conservation
standards by referencing the Model Energy Code,
but is superseded by Part 6, Title 24 of
California Building Standards Code.
B. Since the first three Chapters of the UBC are deleted,
Section 502 is amended to reference the UAC.
C. Section 508 is changed to ensure that automatic fire
sprinkler systems required by local amendment per
Section 3802 (b) can be used as a substitution for fire-
resistive construction.
D. Section 1701 is amended to require fire resistive
construction for alteration of buildings located in the
commercial fire zone, except buildings equipped with an
automatic fire sprinkler system.
E. Section 1710(a) is amended to include a trade-off for
installing an automatic fire sprinkler system in a

building by allowing elimination of required parapets
at exterior fire-resistive walls.
F. Section 2623 establishes minimum criteria for concrete
slab-on-grade construction due to the expansive soils
found in the San Luis Obispo area. The requirements
are considered standards in-lieu-of a soils report.
G. Section 2905(f) is amended to provide criteria for
controlling surface drainage from new development which
impacts adjacent property.
H, I. Sections 2907 (a) and 2907 (e) are amended to establish
minimum foundation requirements due to the expansive
soil in the San Luis Obispo area, and are considered
standards in-lieu-of a soils report.
J. Section 2907 (f) is amended to require that anchor bolts
be held in place prior to concrete placement to allow
verification of proper location and embedment during
inspection.
K. A revised Table 29-A requires greater foundation depths
due to the expansive soils in the San Luis Obispo area,
and is considered standards in-lieu-of a soils report.
L. Section 3201 is amended to include the prohibition of
wood shingle and shake roof coverings currently found
in the Fire Code. A new exception allowing the use of
wood shakes or shingles for an addition to an existing
building has been added.
M. Section 3305(g) is amended to allow the elimination of
fire-resistive corridor construction all B-2
Occupancies with an occupant load of less than 100.
This change is a trade-off due to the additional fire
sprinkler requirements in Section 3802 (b) .
N. Section 3802 (b) is amended to require fire sprinkler
systems in all new buildings except private garages and
accessory buildings not exceeding 500 square feet in
floor area. In existing buildings, significant
alterations, additions greater than 1000 square feet in
floor area, and occupancy changes also require
installation of fire sprinkler systems. These
requirements are identical to the proposed amendments
to the Fire Code being considered concurrent with the
Building Code adoption. Section 3802 (c) , (d) , (e) ,
(f) , (g) ., and (h) are deleted because all are
superseded by the amended Section 3802 (b) .
0. Section 4506 (b) is amended to limit awning construction
to flame-retardant coverings.

P. Section 4715 is added because the standards were
inadvertently deleted from the 1991 UBC Standards.
Until those standards are placed back into the code
with the 1994 edition, the provisions in the 1988 UBC
Standards must be adopted.
Q. Appendix Chapter 12-Division III is new to the UBC and
regulates residential swimming pool construction. With
the addition of amendments concerning hydrostatic
uplift, pool access, pool lighting, and abandoned
pools, this Chapter will effectively replace swimming
pool requirements found in MC Chapter 15. 32.
R-T. Appendix Chapter 23-Division IV is new to the UBC and
establishes standards for flood-resistant construction.
Appendix Section 2390(b) is amended to allow the City
Engineer to establish additional flood-prone areas.
Appendix Sections 2392 and 2393 (b) are amended to
include the local requirement to elevate or floodproof
buildings to one foot above base flood elevation, which
is consistent with the provisions of MC Chapter 17.84
(Flood Damage Prevention Regulations) .
U. Appendix Chapter 7001 is amended to include additional
items which clearly. establish the intent of grading
regulations in San Luis Obispo.
V. Appendix Section 7002 is amended to clarify application
to work within waterways and jurisdiction of the City
Engineer for subdivision grading.
W. Appendix Section 7003 (a) is amended to clarify
limitations for grading within a waterway. Section
7003 (b) contains minor modifications to exempted work
categories. Section 7003 (c) is added to retain
existing MC language allowing grading in advance of
building permit issuance. Section 7003 (d) is added to
retain existing MC language which allows certain types
of grading projects only with City Council approval.
An exception has been added which exempts minor
stockpile operations of 200 cubic yards or less.
X. Appendix Section 7004 (b) is added to require dust
control in conjunction with grading and to allow
emergency grading. Both provisions currently exist in
the MC.
Y. Existing MC definitions for average cross slope and
waterway are added to Appendix Section 7005.
Z. Appendix Section 7006 (c) is amended to reduce the
amount of grading to 500 cubic yards or less to qualify
for "regular grading".

AA. Appendix Section 7006(d) is amended to require
additional details on grading plans.
AB. Appendix Section 7006(g) is amended to require that
"engineered grading" (grading in excess of 500 cubic
yards) include plans prepared and signed by a
registered engineer or architect.
AC. Appendix Section 7006(i) is added to continue existing
MC limitations for maximum grading allowed in relation
to the slope of a lot.
AD. Appendix Sections 7007 (b) and 7007 (c) are deleted
because they are superseded by amended Sections in the
UAC.
AE. Appendix Section 7008 is amended to include guarantees
for the restoration of a graded site and cost recovery
for damage to public right-of-way.
AF. Appendix Section 7013 (a) is amended to retain current
MC provisions requiring erosion control for any surface
that is disturbed during grading operations.
AG. Appendix Section 7015(c) is added to retain existing MC
provisions requiring verification of graded elevations
prior to start of building construction.
AH. Table 70-C is added to retain an existing MC table
referenced in the average cross slope requirements of
Appendix Section 7006(i) .
SECTION 15.04.050 AMENDMENTS; UNIFORM CODE FOR BUILDING
CONSERVATION
Amendments to the Uniform Code for Building Conservation
(UCBC) are as follows:
A. Chapters 2, 3, and 4 of the appendix are deleted
because they are superseded by regulations in the UBC
or disabled access and energy regulations in the
California Building Standards Code.
BIC. Section 606(b) and Appendix Section A101 are amended to
be consistent with the unreinforced masonry (URM)
strengthening program previously approved by Ordinance
1203 (1992 Series) , which requires strengthening of all
buildings of unreinforced masonry construction.
DIE. Appendix Sections A104 and A105 are amended to
recognize Seismic Zone 3 criteria as previously
approved.

F. Appendix Section A109 (1;) is amended to address masonry
infill walls and to recognize use of the State
Historical Building Code as previously allowed.
G. A new Appendix Section A111 is created which includes
all administrative regulations adopted under the URM
strengthening program (Ordinance 1203) .
SECTION 15.04.060 AMENDMENTS, UNIFORM MECHANICAL CODE
Chapters 1, 2 and 3 of the Uniform Mechanical Code (UMC) are
deleted because administrative provisions are found in the UAC.
SECTION 15.04.070 AMENDMENTS; UNIFORM PLUMBING CODE
The Uniform Plumbing Code (UPC) is amended as follows:
A. Part 1 of the UPC is deleted because administrative
provisions are found in the UAC.
B. Subsection 317 (d) is amended by requiring a layer of
sand in sewer trenches to ensure a uniform laying bed
for pipe and to counteract effects of expansive soil
conditions.
SECTION 15.04 .080 PERMITS REQUIRED FOR WELL CONSTRUCTION
This section continues an existing MC section which
establishes permit criteria for new water wells and requirements
for capping of abandoned wells.
SECTION 15. 04. 090 AMENDMENTS; NATIONAL ELECTRICAL CODE
The National Electrical Code (NEC) is amended as follows:
A. Article 230-70 (a) is amended to continue the
requirement that the electric service disconnecting
means be accessible to emergency personnel at the
exterior of a building or in an equipment room directly
accessible from the exterior and adjacent to an
exterior wall. Fire Department personnel will be able
to address fire and other emergency situations without
exposing personnel to energized electrical equipment.

The plan review fees specified in this subsection
are separate fees from the permit fees specified in
Section 304 (b) and are in addition to the permit
fees.
where plans are incomplete or changed so as to
require additional plan review prior to the issuance
of a permit, an additional plan review fee may be
charged at a rate established by resolution of the
City Council.
Plan review fees for minor revisions and other data
submitted subsequent to the issuance of a permit
shall be at a established by resolution of the City
Council.
SECTION 15.04. 040 AMENDMENTS; UNIFORM BUILDING CODS
B. Amend Section 508 to read as follows:

Sec.. 502. No change shall be made in the character of
occupancies or use of any building which would place the
building in a different division of the same group of
occupancy or in a different group of occupancies, unless
such building is made to comply with the requirements of
this code for such division or group of occupancy.
EXCEPTION: The character of the occupancy of
existing buildings may be changed subject to the
approval of the building official, and the building
may be occupied for purposes in other groups without
conforming to all the requirements of this code for
those groups, provided the new or proposed use is
less hazardous, based on life and fire risk, than
the existing use.
No change in the character of occupancy of a building
shall be made without a Certificate of Occupancy, as

supporting roof construction and shall provide weather
protection for the building at the roof.
Subject to the requirements of this chapter, combustible
roof coverings and roof insulation may be used in any
type of construction.
Wood shake or wood shingle roof coverings shall not be
installed on any building. Where buildings to be re-
roofed have different roof coverings present, the least
combustible covering shall be used as the minimum
standard of replacement.

4. At the top of rubbish and linen chutes and in
their terminal rooms. Chutes extending through
three or more floors shall have additional sprinkler
heads installed within such chutes at alternate
floors. Sprinkler heads shall be accessible for
servicing.
5. In rooms where nitrate film is stored or
handled.
6. In protected combustible fiber storage vaults
as defined in the Fire Code.
For the purpose of requiring the automatic fire
sprinkler systems specified in this chapter, the

feet of the property or which may be affected
by the proposed grading operations.
6. Recommendations included in the soils
engineering report and the engineering geology
report shall be incorporated in the grading
plans or specifications. When approved by the
building official, specific recommendations
contained in the soils engineering report and
the engineering geology report, which are
applicable to grading, may be included by
reference.
7. The dates of the soils engineering and
engineering geology reports together with the
names, addresses and phone numbers of the firms
