SUBJECT:
Revised list of designated employees and advisory body members required to file Conflict
of Interest Statements (Form 730).
CAO RECOMMENDATION:
Adopt resolution updating list of designated employees and advisory body members
required to file Conflict of Interest Statements and rescind Resolution No. 7029 (1991
Series).
BACKGROUND:
On September 17, 1991, the City Council last considered and adopted an updated list of
designated employees and advisory body members required to file Conflict of Interest
Statements. New state legislation requires that aan agency update its Conflict of Interest
Code prior to June 30 of each year.
Section 87300 et. seq. of the Government Code requires the City to adopt and maintain a
Conflict of Interest Code. It must identify and require certain positions to disclose specified
information regarding investments, interests and income. The Political Reform Act of 1974
directed that a Conflict of Interest Code identify all positions that take or authorize any
official action on behalf of their agencies. This includes an official's participation by way
of advising or making recommendations to a decision-maker, whether or not the decision-
maker follows the official's advice.
Governmental decisions include: decisions on ordinances, regulations and resolutions;
decisions on contract awards,purchases and leases; decisions on hiring, firing and personnel
actions; decision on land use, zoning, redevelopment plans, permits and variances; and
decisions on other matters that may come before the agency.
The primary reason for establishing Conflict of Interest Codes is to prevent financial
conflicts of interest on the part of public officials. These statements are public records and
are kept on file in the City Clerk's Office.
There are few changes this year. The code has been amended to add the positions of
Traffic and Transportation Manager and Transportation Planner. Positions that were
eliminated by the reorgranization are still included in the code and will be deleted as
vacancies occur.

CITY OF SAN LUIS OBISPO UPDATING THE LIST OF
CITY EMPLOYEES AND COMMISSION MEMBERS REQUIRED
TO FILE A CONFLICT OF INTEREST STATEMENT
AND RESCINDING RESOLUTION NO. 7029 (1991 SERIES)
BE IT RESOLVED by the Council of the City of San Luis Obispo as follows:
SECTION 1. Designated city employees and commission members listed on the
attached Exhibit "A' shall be required to file a Conflict of Interest Statement (Form 730)
with the City Clerk.
SECTION 2. Resolution No. 7029 is rescinded upon adoption of this resolution.
