1 . Adopt a corrected resolution ceasing to pay and report the value of the employer pai d
member contribution (EPMC) to California Public Employees Retirement Syste m
(Ca1PERS) for members of the City's Confidential Employees .
DISCUSSIO N
Backgroun d
In preparing the final resolution staff discovered an inadvertent inconsistency between the terms o f
the agreement approved by City Council as reflected in the staff report and the terms of th e
resolution adopted by City Council . The graduated schedule for the Confidential Employees paying
the Member contribution is correct ; however, the percentages being reported to Ca1PERS wer e
incorrect. The resolution adopted by Council on April 10, 2012 had the Member contributio n
totaling 9% instead of 8%. In order to correct that mistake staff is requesting that Council adop t
the corrected resolution attached hereto that supersedes prior resolutions in conflict, including th e
recently adopted incorrect one .
FISCAL IMPAC T
There is no cost associated with adopting the corrected resolution .
ALTERNATIVE S
Do not approve the corrected resolution .This alternative is not recommended, as the curren t
resolution would conflict with the amount being reported to Ca1PERS for unrepresented confidentia l
employees .

A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO CEASIN G
TO PAY AND REPORT THE VALUE OF EMPLOYER PAID MEMBE R
CONTRIBUTIONS FOR UNREPRESENTED CONFIDENTIAL EMPLOYEES AN D
SUPERSEDING PREVIOUS RESOLUTIONS IN CONFLIC T
WHEREAS,the Council of the City of San Luis Obispo has the authority to implemen t
Government Code Section 20636(c) (4) pursuant to Section 20691 ; an d
WHEREAS,the Council of the City of San Luis Obispo has adopted Resolution No .
10345, which reduces the Employer Paid Member Contribution (EPMC) a total of 3% effectiv e
June 28, 2012, and a total of 6% effective January 24, 2013 and provides that the City will n o
longer report the normal member contributions to be paid by the employer and as additional
compensation effective June 27, 2013 ; and
WHEREAS,one of the steps in the procedures to implement Section 20691 is the adoptio n
by the Council of the City of San Luis Obispo of a Resolution providing that the City will no longe r
pay and report the value of said Employer Paid Member Contributions (EPMC); and
NOW, THEREFORE, BE IT RESOLVED,by the Council of the City of San Luis
Obispo as follows :
SECTION 1 .Effective beginning June 28, 2012, the City elects to reduce the EPMC a s
set forth in Section 2 and effective June 27, 2013 elects to no longer pay the member contributio n
and therefore no longer report EPMC as additional compensation .
SECTION 2.The City's payment and reporting of the EPMC benefit to it s
Unrepresented Confidential Employees shall be reduced and modified as follows :
a.Effective June 28, 2012, five percent of the normal contributions will be paid a s
EPMC, and the same five percent (value) of compensation earnable {excludin g
Government Code Section 20636(c)(4)} will be reported as additional compensatio n
for the Unrepresented Confidential Employees .
b.Effective January 24, 2013, two percent of the normal contributions will be paid a s
EPMC, and the same two percent (value) of compensation earnable {excludin g
Government Code Section 20636(c)(4)} will be reported as additional compensatio n
for the Unrepresented Confidential Employees .
c.Effective June 27, 2013 employees of the Unrepresented Confidential Employee s
shall cease to receive the EPMC benefit .
d.Effective June 27, 2013, zero percent of the normal contributions will be paid a s
EPMC, and the same zero percent (value) of compensation earnable {excludin g
Government Code Section 20636(c)(4)} will be reported as additiona l
compensation .

Directs that prior resolutions relating to the Unrepresented Confidential Employee s
compensation and benefits are hereby superseded to the extent inconsistent with this resolution .
