Kessler AM To:CityClerk Subject:California Public Records Act Request - Incidents Involving Mark Neville, Rachel Neville, and Russell Kessler Follow Up Flag:Follow up Flag Status:Flagged Dear Custodian of Records, Pursuant to the California Public Records Act (Government Code §7920.000 et seq.), I request access to and copies of all public records maintained by the San Luis Obispo Police Department and the San Luis Obispo County Sheri?’s O?ice relating to incidents involving:  Mark Neville  Rachel Neville  Russell Kessler 1. Case Reports and Investigative Files All police reports, investigative reports, supplemental reports, and related documentation relating to incidents involving Mark Neville, Rachel Neville, or Russell Kessler from 2022-present. 2. Calls for Service and Dispatch Records All calls for service, CAD logs, dispatcher notes, and related dispatch records involving:  Mark Neville  Rachel Neville  Russell Kessler 3. 911 Calls and Dispatch Audio All 911 call recordings and dispatch audio recordings relating to incidents involving:  Mark Neville  Rachel Neville  Russell Kessler. This includes:  recordings of incoming emergency calls  dispatcher radio communications  communications between dispatch and responding o?icers or deputies. 4. Body-Worn Camera Footage All body-worn camera recordings captured by o?icers or deputies during any police contact with:  Mark Neville  Rachel Neville 1  Russell Kessler. 5. Interview Recordings All audio or video recordings of interviews conducted by law enforcement involving:  Mark Neville  Rachel Neville  Russell Kessler  any witnesses interviewed regarding these incidents. This includes interviews conducted:  at police stations  in the field  during follow-up investigations. 6. Field Interview Cards / Contact Reports All field interview cards, contact reports, or investigative detention records documenting police contact with:  Mark Neville  Rachel Neville  Russell Kessler. 7. Airport Surveillance and Security Records All records relating to the review or request for San Luis Obispo County Airport surveillance video, including:  surveillance footage  evidence downloads  video request forms  evidence logs  chain-of-custody documentation. This includes any surveillance video referenced by deputies or o?icers regarding alleged incidents at the airport. 8. Evidence and Property Records All evidence records relating to these incidents, including:  evidence logs  property reports  evidence intake forms  chain-of-custody records  digital evidence submissions. 9. Communications Between O?icers and Deputies All communications between law enforcement personnel relating to the investigation of incidents involving Mark Neville, Rachel Neville, or Russell Kessler, including any direct communications between Kessler and any o?icer under the employment of the San Luis Obispo Police Department. This includes:  emails  internal memoranda  case notes 2  investigative summaries  internal messaging systems.  Text messages, personal phone calls or emails between Kessler and any o?icer. Include, date, time and provide full records of these messages/emails and calls including dates and times. 10. Investigative Conclusions All records reflecting investigative findings or conclusions regarding complaints made by:  Rachel Neville  Russell Kessler. This includes documentation indicating whether complaints were:  substantiated  unsubstantiated  inactive  closed due to lack of evidence. 11. Body-Camera and Digital Evidence Audit Logs All audit logs or access records relating to digital evidence systems used to store or review body- worn camera footage, in-car camera footage, or other digital evidence related to these incidents. This includes logs showing:  when recordings were accessed  which o?icers or investigators accessed them  when the recordings were viewed, downloaded, or exported. FORMAT OF RECORDS I request that responsive records be provided electronically if available to avoid printing and mailing costs. SEGREGABLE PORTIONS If any portion of responsive records is claimed to be exempt from disclosure, I request that all reasonably segregable non-exempt portions be produced pursuant to Government Code §7922.525. INDEX OF WITHHELD RECORDS If any records are withheld in whole or in part, please provide an index describing each withheld record, including the date, author and recipient, general subject matter, and the statutory basis for withholding. RESPONSE DEADLINE Under the California Public Records Act, the agency must determine within 10 days whether the requested records will be disclosed. RELATED FEES AND COSTS I will pay any standard fees and costs for the records and shipping of records that cannot be provided electronically. Please provide me with an invoice or notice of those fees and the process to pay the associated costs, including the cost of any hard drive or USB drive for storage if necessary.
