Description
The owner of 2505 Johnson Ave, Kyle Billingsley, cut down the bamboo on his property. Kyle then put dirt over
where the bamboo had been but did not kill it. Now the bamboo is growing on
We have tried many ways to kill the bamboo as it grows on our property. We
are not sure what we can do at this point as we have reached out to Kyle and his response indicates he doesn't
care. In his response he also stated he over excavated the area- which he did not. Now all the dirt he put over where
the bamboo was is harboring a lot of rodents. The rodents have decided to come go into that dirt and under our
fence- so now we have a rodent problem. I reached out to Kyle about this issue.
We, my spouse and I, have tried to work with Kyle and have shared information with him a few times about how to
get rid of the bamboo from his side so it doesn't grow on our property but this seems to have fallen on deaf ears.
Every time we have made a complaint to the city about possible code violations it seems that within less than 12
hours Kyle attempts to make the correction. Now we are curious as to who is the person that is reaching out to Kyle
as soon as we file a complaint?
So if you can help us as to our next steps to deal with Kyle, the bamboo, and the rodent issue we'd appreciate any
assistance you can provide. The pictures I have uploaded only show a tiny bit of the bamboo issue- we have a video
of the current problem.
ps: we never had any of these issues prior to Kyle working on the property.

Unfortunately, the bamboo would be a civil issue and not something the City could get involved in. If you have a report from a
certified pest inspector stating that the neighboring property is the cause of a rodent infestation on your property, we could follow
up with Kyle on that.
If you think Kyle might be open to mediation regarding the bamboo, there is a free mediation service available called SLO
Solutions. They help workout disputes between neighbors, landlords and even roommates. If you'd like to explore that option their

I have contacted Kyle regarding most, if not all of the complaints at his property. He has typically, as you noticed, been quickly
responsive when I've informed him of violations.

property line toward the sidewalk at Sydney. He said he would install the silt fence on 4-18-24 by mid morning. I will schedule a

4-24-24 Revisit site at 2525 Johnson to inspect silt fence installation. Fence has been extended to the limits shown on the S/W
plans. Checked the trenching and back fill and all fence panels are securely anchored. There are several large soil clods laying up
against the fabric. I told the foreman on site to go along the fence and remove the clods to reduce the loading on the fence fabric.
The foreman said he would remove the clods. Soil along the inside base of fence has been compacted with a wacker.

Hello
The most relevant definition for primary residence, in the context of Accessory Dwelling Unit provisions, is that for "Primary
Unit" set out in Section 17.158.036 of the City's Zoning Regulations. That definition describes a primary unit as: The existing
single-unit residential structure on the site when used in the application of accessory dwelling unit regulations. Whenever we are
discussing Accessory Dwelling Units a "primary dwelling" or "primary residence" refers to a structure, and in the case of
residential property, the structure or structures which are being occupied as a residence.
It should be noted that this differs from the question of where a person's primary residence may be located, insofar as it's relevant
to know where they spend most of their time residing. In the case of Accessory Dwelling Units it is not relevant because there is
no owner-occupancy requirement. A property owner may establish an Accessory Dwelling Unit regardless of whether their
primary residence is located on the property, or whether the existing dwelling on the property is owner-occupied or rented to
others.

When the Planning Division inspects new construction, that inspection does not normally include measurements of the extent of
the foundation. We look to verify general conformity to plans, under a basic presumption that construction has been carried out
according to approved plans, an obligation of everyone involved in the project. Gross inconsistency with plans would likely be
apparent, though I myself have not run into this kind of situation. That said, I do not know whether any other inspecting
department or division routinely makes such measurement, and it may be useful to make the same inquiry of our Building &
Safety staff to find out.

This is more of a safety concern. The property has a ponding/drainage basin and only a 2-foot-tall fence in front of it
allowing access to public. Concern is that a child, as many walk down the street to school and the park unattended,
will be attracted to the basin once it has water in it and a child will fall in and be injured or drown.

I have read that city code states only 40% of the front yard can be concrete.
Does this also apply to the ADU situation?We ask that the concrete parking pad be even with the current ground level. As it is we
have lost all privacy on that side of our property due to the increase in the height of ground that Kyle built on and currently the
tenants can see over our roof line and into our yard when going to and from their cars. We hope the city will take privacy into

That is not acceptable. The parking in the front yard has been on going since the tenants moved it. This was previously reported
and the city responded to the complaint as “unfounded”. There does not seem to be a reason that the tenants should be allowed to
park in their yard for another month. There’s plenty of space on the street and no one else in the neighborhood does this. It’s ugly
and tacky.

2-13-25 Site Visit. Rain has filled the basin and overflow drain is partly clogged with debris. spoke to Kyle B. about cleaning out
drain and he said he did earlier. Very little flow from drain pipe given the water level was over inlet. RP said the water came thru
fence across driveway and washed out landscape mulch in yard. Noted 4 inlet pipes into basin and one 3 inch pipe for drain.
Will check with engineering to see if drainage calcs were performed on the revised drainage plan which added 2 additional inlet
pipes.

Reference to application SBDV-0312-2025. We object to the lot split because (see photo below). And Kyle has never
lived at any of the addresses affiliated with the application nor will he ever live there. And all the units on the lot are
currently rented and have been re rented for the next year. And because of density. There is no provided off street
parking for 90% of current residents. (ps you should drive down Sydney street in the evening to see all the cars.) And
with the new homeless village going in on Johnson at Bishop there will be even more parking on the streets. And
Kyle, and his tenants, repeatedly violate codes at his rental properties and does not do proper upkeep of the
property unless it’s reported to the city. And Kyle lies ( see article in news related to his forging a business partners
signature).
And the decreasing value of our property (1475 Sydney Street) due to the neighboring ADUs and a drainage basin
that floods our property

11-17-25 Site Visit. Went to 1475 Sweeney. Met with The drainage pond next door has filled with rainfall
and some of the water is running into their yardd. Also hydrostatic pressure is causing water to leak under and thru concrete block
wall between properties. The outlet grate has been insstalled too high and is allowing the water to flow around the fence. The pipe
to drop box and gutter is nearly horizontal so the drain box cannot be lowered too much and still allow flow. grate and box are
clean with no plugging or restrictions. 3- 6inch pipes bring drain water into pond and 1-6 inch pipe delivers drain water to gutter.

Description
Since 1/1/24 we, have been dealing with storm water run off from 1495
Sydney Street. Kyle Billingsley, owner 1495, submitted a plan that you, the city, that was approved for a water basin.
The water runoff is still happening and it’s been 2 years. We last submitted runoff on 12/26/25, the reply from the city
was that this is to be dealt with between the owners of the adjacent properties. (This was an idea that Kyle gave the
city, specifically the planning engineer, Gabriel.). This isn’t so because all the prior reports of runoff the city has held
Kyle accountable. See the city approved the plan, the plan isn’t working therefore the city needs to address Kyle and
formulate a new plan that works. So if just floating an idea to the planning engineer is all it takes we suggest the city
continue to hold Kyle accountable. Just ask the city attorney, the city can’t allow this failed plan to stay in place the
city must work to protect our property, as city employees do work for the citizens in this city. Previously the city did
hold Kyle responsible this doesn’t change for any reason whatsoever. We never had water runoff from that property
until after Kyle’s plan for the basin and ADUs was approved and implemented. Yes changes have been made over
the past two years but they aren’t working. There has been a significant reduction in runoff but runoff is still
occurring. Water doesn’t stay still when it is absorbed in the ground it will moves in the direction of least resistance
and therefore is running onto our property. Yes on 12/26 we thought finally everything is working, we were so
excited, but no, it started raining again and we were getting storm water runoff from Kyle’s property. The state of
California and our county also has very clear environmental standards for such an issue.
