CAO RECOMMENDATIONS:
(A) Adopt resolution adjusting annual salary for the City
Administrative Officer
(B) Adopt resolution adjusting annual salary for the City
Attorney
BACKGROUND:
In accordance with the Managerial Compensation Plan for Appointed Officials and for
Certain Management Personnel, Resolution No. 6604 (1989 Series), the City Council
is authorized to approve annual salary adjustments for appointed employees
commencing April 1992 through March of 1993.
The City's compensation plan for the appointed officials as well as all management
positions is based on performance. Performance evaluations were conducted for the
appointed officials in closed session on June 8, 1992. As part of that evaluation
process Council determined appropriate salary adjustments. Those adjustments were
originally scheduled for formal adoption by the Council at their June 30, 1992 regular
meeting. Since the City was in the midst of salary negotiations with the General
Employee Unit, SLOCEA, and since it was unclear at that time what action the state
would be taking, it was determined that the appointed official salary adjustments
should be placed on hold. An exception, the salary for the City Clerk was adjusted
in September of 1992 since the former City Clerk was resigning and entitled to a
salary adjustment from April of 1992 until her effective date of resignation. The
Council went ahead and retroactively adjusted her salary at the same time they
approved her interim work assignment.
Council approved a two year compensation package for SLOCEA in late August,
1992. Consistent with the Council's current policy and contractual obligations to
honor its negotiated agreements with City employees, the adjustments to Appointed
Officials' salaries is appropriate at this time.
As directed by the Council following its closed session of June 8, 1992, staff is
presenting the following salary adjustments:
CITY ADMINISTRATIVE OFFICER
Council has recommended a 3% increase for the CAO based upon performance
and the provisions of the Compensation Plan. An alternative the Council could

consider acceptable to the CAO is to grant a 2 1/2% salary increase consistent
with the salary increase received by the SLOCEA for 1992-93. This represents
an increase in salary from $7,300 to $7,483 per month and is reflected in the
attached resolution, though the Council could change it back to the original 3%
or $7520 per month.
This resolution supersedes Resolution No. 6993 (1991 Series). Resolution
6198 (1987 Series), Employment Agreement, remains in full force and effect,
with the following modification:
"In the event Mr. Dunn's employment is terminated by the
Council, ora majority of the Counci/request his resignation,
during such time that he is willing and able to perform the
duties of City Administrative Officer, the City agrees to pay
him a lump sum cash payment equal to six (6) months
compensation (salary and all appointed officials' fringe
benefits). Should Mr. Dunn obtain employment during the
six (6) month period following termination, he shall
reimburse the City proportionately."
The language appearing in italics is an addition to the severance provision that
is currently in force having been adopted by Council in 1987.
CITY ATTORNEY
The current monthly salary of $6,300 shall be increased to $6,575 effective
April 9, 1992 for the City Attorney. This represents a 4.3% increase which is
in keeping with Council action in April of 1992 that recognized that the salary
range for City Attorney was considerably lower than those for other San Luis
Obispo management positions when compared to our survey cities.
This resolution supersedes Resolution No. 6994 (1991 Series). Resolution No.
6689 (1989 Series) employment agreement, remains in full force and effect
with the following modification:
"In the event Mr. Jorgensen's employment is terminated by
the Council, or a majority of the Council request his
resignation, during such time that he is willing and able to
perform the duties of the City Attorney, the City agrees to
pay him a lump sum cash payment equal to six (6) months
compensation (salary and all appointed officials fringe
benefits). Should Mr. Jorgensen obtain employment during
the six (6) month period following termination, he shall
reimburse the City proportionately."

This represents an increase to six (6) months from the previous agreement of
four (4) months severance pay bringing the City Attorney's agreement in line
with the six month provisions for the CAO and the recently appointed City
Clerk. The phrase in italics, as for the CAO, is new wording and appears in all
three appointed officials' agreements.
All benefits and rights included in the Managerial Compensation Plan,
Resolution No. 6604 (1989 Series), shall remain in effect.
It is important to note that annual salary adjustments are still in effect
throughout the organization by virtue of contracts negotiated with all employee
associations. Thus, the Council's recommended increases are consistent with
and in many cases less than, other negotiated adjustments. If, however,
citywide salary "freezes" or "rollbacks" are eventually identified as components
of a plan adopted to further reduce personnel costs, the salaries of the CAO,
City Attorney, and management team members could be modified consistent
with those plans. However, it is recommended that moderate salary
adjustments be implemented at this time in order to maintain compensation
levels consistent with the marketplace.
FISCAL IMPACT:

The total cost for these changes is approximately $7,425 effective April 8,
1992 through FY1992-93 and is available in the Departmental budgets.
RECOMMENDATIONS:
Adopt resolutions adjusting salaries for the appointed positions of City
Administrative Officer and City Attorney. These adjustments are in accordance
with previously adopted resolutions that establish the City's Managerial
Compensation Plan that applies to Appointed Officials.

Given the current City fiscal crisis, the _rational for .:prposi

pay and benefit increases for- any_ City staff seems
counterproductive to maintaining the. vital City se-r iees;.
During recent City Council meetings; staff expressed the dire;,
situaton -that the City will face over the next several •montkis-
due .to 'decreasing revenues: Given this economic condition, ;pay
increases seem to decrease the ability_ of the City_ to .maintain
other:'.necessary programs.
As .representatives of thedowntown- .busness. communty whohay..e:._.
experienced salary decreases over thepast several years, we;. can
not support this recommendation. . ;

make this proposal more unacceptable. While the perceived jobi.
security at, P#-Y- Hall among the employees is of concern, dueto
