Re:1035 Monterey St., San Luis Obispo, CA. Fremont Theater Fire Sprinkler
Installation Project - Fire Department Requirement to Conduct Friable Asbestos
Survey of Affected Work Areas.
Dear Mr. King:
Due to the age of this building and the high likelihood of asbestos containing materials
incorporated into a number of the building materials, we are requiring that you hire a certified
asbestos consultant to conduct an asbestos survey of work areas targeted for fire spnnklers and
other related work. As you will note in the attachment from the local Air Pollution Control
District, asbestos containing matenals were used extensively during the time this theater was
constructed.
This requirement is in place in order to protect the health and well being of the public, as well as
prevent a potentially costly cleanup should a release of friable asbestos occur. Please forward to
my attention the name and contact information of the contractor as well as the laboratory
analytical results and final report of findings once the survey has been completed. I would also
expect that whatever recommendations are made by the contractor you would implement. This
must be leted to the fire Please contact me at (805) 781-
7383 should you have any questions regarding this correspondence. Thank you for your
cooperation and your interest in protecting the health of all future patrons of the theater.
Sincerely,
\,kurufuryhD. Kerry Boylu \

Re: Fremont Theater Fire Sprinkler lnstallation
Dear Kerry,
As you requested, we are providing your office with the asbestos and lead
laboratory tests for the ceiling areas that will be penetrated in the course of
installingiire sprinklers. The results indicate minor level of asbestos in the surface
layer ofifre auditorium ceiling and lead containing paint on the lobby ceiling. We
shall treat all penetrations for fire sprinklers as containing either asbestos or lead
and shall engage a certified hazardous material abatement contractor to properly
drill the holes for the sprinkler penetrations.
Please feel free to contact me if you have any other questions.

Re: 1035 Monterey St., San Luis Obispo, CA. Fremont Theater Fire Sprinkler
Installation Project - Fire Department Requirement to Conduct Friable Asbestos
Survey of Affected Work Areas.
Dear Mr. King:
Due to the age of this building and the high likelihood of asbestos containing materials
incorporated into a number of the building materials, we are requiring that you hile a certified
asbestos consultant to conduct an asbestos survey of work'ryteas targeted for fire sprinklers and
other related work. As you will note in the attachment from the local Air Pollution Control
Distriot, asbestos containing materials were used extensively during the time this theater was
constructed
This requirement is in place in order to protect the health and well being of the public, as well as
prevent a potentially costly cleanup should a release of friable asbestos occur. Please forward to
my attention the name and contact information of the contractor as well as the laboratory
analytical results and final report of findings once the survey has been completed. I would also
expect that whatever recommendations are made by the contractor you would implement. This
survey must be completed prior to the fire sprinkler installation. Please contact me at (805) 781-
7383 should you have any questions regarding this correspondence. Thank you for your
cooperation and your interest in protecting the health of all future patrons of the theater.

The term asbestos i'efers to sevei'a! t'/pes of fibi"ous minei-a!s. it
can be found ln a variety of natural and man-made
environments. Asbestos from either source can be a health
concern if inhaled.
Naturally Occurring Asbestos
In its natural state, asbestos occurs throughout much of the
planet. Serpentine is a very common rock type in California and
was identified by the Air Resources Board as having the
potential to contain naturally occurring asbestos.
The state Air Resources Board has identified asbestos as a toxic
air contaminant. Under the ARB's Air Toxica Control Measure
(ATCM) for Construction. Grading. Quarrving, and Surface
Mining operations, prior to any grading activities at the
site, a geologic analysis will be necessary to determine if
serpentine rock is present. Grading projects in serpentine
rock larger than 1 acre will require prior District approval of a
Asbestos Dust Mitigation Plan and an Asbestos Health and
Safety Program. All subject project applicants should complete
a construction and Grading Project form. If Naturally occurring
asbestos is not pres€nt, an Exemption form must also be filed
with the APCD. When submitting the Project/ Exemption Form,
please fill in all applicable contract information. Consult the
California Geological Survey and the A,ir Resources Board for
more information on naturally occurring asbestos.
NOA Fees:
The San Luis obispo County Air Pollution Control District
(APCD) will assess Review Fees for all work that has the
potential to disturb soil containing Naturally Occurring Asbestos
(NoA). Asbestos is commonly found in ultramafic rock,
including serpentine, near fault zones and is released into the
air when it is broken or crushed. This can happen when land is
graded for building purposes, or at quarrfing operations. The
state of California has determined that NOA, such as serpentine
rock, is a toxic air contaminant and if inhaled may result in the
development of lung cancer or cause other health
hazards. Work in asbestos serpentine areas requires using dust
control plans and may include air monitoring.
NoA Review Fee amounts depend upon the project size and if
projects involve disturbance of asbestos serpentine, dust
control plans or air monitoring. Exemptions from requirements
are available based on geological evaluation. Please refer to the
fee schedule for more information.
In San Luis Obispo County, serpentine rock is located in many
regions of the county including: coastal, coastal mountain,
Home
western north county and the extreme eastern county area
along the San Andreas Fault. Areas subject to the NoA ATCM
requirement can be found on the APCD NOA maD.
In order to process the review of your project ln the shortest
time possible, please contact the District immediately.

Asbestos in Damaged Buildings
Structures that have been damaged or have collapsed due to
the December 22,2oo3 earthquake may contain hazardous
materials, principally asbestos. Any building built before 1984
may contain asbestos materiais. Home or buiiding owners anci
workers cleaning up debris should take steps to protect
themselves, or hire a licensed contractor to handle the cleanup
The APCD has the local responsibility to regulate material
containing more than 1olo asbestos, and can be contacted at
their office for advice at 8O5.781.5912 during regular business

Asbestos as a Health Threat During Demolition
Asbestos products in good condition and undisturbed do not
pose a health threat. However, if the asbestos is not in good
condition and RACM dust is inhaled, the fibers pose a serious
health threat by becoming permanently lodged in body tissues.
symptoms of asbestos related diseases might not appear t'or 20
years or longer after the first exposure. Since there is no known
safe level of er<posure, all asbestos exposure should be avoided.
The Role of the Air District During Demolition
The Air District is delegated authority by the Envlronmental
Protection Agency (EPA) to implement the Federal Asbestos
NESHAP (the National Emissions Standards for Hazardous Air
Pollutants established by the EPA) regulations specified in 40
CFR 61, Subpart M.
There are specific requirements and procedures delineated in
this regulation which pertain to certain demolition and
renovation projects and projects involving the removal of
asbestos containing or asbestos wrapped utility pipes and
cables. All non-resid€ntial demolitions of any kind of
structure or asbestos containing or asbestos wrapped
utility pipeline and cable are required to be approved in
advance by the District. The steps to be taken by an
owner/operator subject to this regulation are clearly defined.
Contractors should call the District to obtain specific
requirements that relate to their specific project at least one
month in advance of the project start date.
If You Think Your Home or Building Contains Asbestos
r Hire an asbestos consultant or call an asbestos
laboratory for in-depth instructions on how to safely
brins them a sample for analysis. Look in the yellow
pages under "Asbestos" or "Environmenta1."I Do not dust, sweep, or vacuum particles suspected of
containing asbestos. Use only licensed asbestos removal
contractors.r The Contractors State Licensing Board has prepared a
booklet titled: "What You Should Know Before You Hire a
Contractor."r The District has free copies of several booklets available
on asbestos.I Should you have a complaint or concern regarding
asbestos, please feel free to call the District (805) 781-
5912 for prompt attention to the matter. You can remain
anonymous.

Re: Yes Concert in San Luis Obispo
Dear Mr. Holmes:
Due to the positive report we received from Fire Inspector Spencer Meyer, who monitored
the concert on March 4th, the Fire Department has determined that an Inspector will not be needed
for the other two concerts. Therefore, we amend the stand-by fees as follows:
1 Inspector for 5 hours at $42.38 per hour on March 4th '. $211.90
We appreciate the professional way in which the concert was handled

Re: Fremont Theatre San Luis Obispo, CA
Dear Mr. Cohen:
On June 17, 1988 I received a copy of the
attached Notice of Violation, SLO Fire Department,
from Mr. Curtis Sorg, Property Manager from
the County of San Luis Obispo. Mr. Sorg stated
that Mr. Flerb Gunn from the Fremont, had
received this violation from the Fire Department
and passed it on to the County. The County
in turn passed it on to us. , ,
I believe that this is the theatrers res, ponsibility
or the County's. Our company does not have a
relationship with the County on this l.ease.
lf you have any questions or comments, please
feei free to call our office. I am expecting that
your office will handle this violation.
Thank you.

RE: Snoking Requirement,s for Assemblies
Dear Sir:
Recently, the Fire Department, was advised that during aconcert at, your facility, there was smoking taking place in theseating area. Section 13.101 of the Uniform Fire Code prohibits
smoking in places of assembly. In addition, there shal1 beposted no srnoking signs in all areas where srnoking isprohibited. , ,i t
Where smoking is allowed, there shaIl'be provided on eachtabre and at other convenient places, approved noncombustibleashtrays or match receivers.
The only area acceptable for the purposes of smoking (aspermittea !v the Fire chief) is the lobby area provided-theymeet the minimum code requirements as stated above.
The san Luis obispo city Fj-re Departrnent wouId appreciateyour cooperation in preventlng this activity in future events.should at any time a representative of the Fire Departmentinspect your facility during an activity, and smoking in theprohibited areas is occurring, the activity sharl be stopped andthe owner/manager cited for a failure to comply with the UniformFire Code sections listed above.

0n this date, this departnent responde{ to a dumpster fire at
the rear of the theatre. The fire was almost conpletely
extinguished by the time we arrived, but the incident did
reveal a potentially very serious conditi.on.
Dear Jack:
Thank for your cooperat
s locato-d illtnost di rectlY
itt,le doub!' that a fire in
ttieatre vi'a that window
I'he problem is that the dunps
under an open window and ther
that dumpster could extend in
or a similar offiing.
Since dumpster fires are unfortunately Yery common, and the
life hazai^d potential in the theatre is 'very high, I would
strongly recbmmend that you take steps to ensure that the
durnpsier is placed away fron any structural openings. This
might be done by signs, barricades, or other nethods.
ftn sure you share our concern for the sa.fety
and we would welcomc any questiotrs you may h;lv
