Conditions of Discharge • The Permittee shall comply at all times with the City’s Sewer Use Ordinance, applicable Federal and State pretreatment standards, and local discharge limits. • The City may inspect, sample, or request reports to verify compliance. • Discharge must not endanger public health, interfere with treatment plant operations, or violate permit limits. • Annual permit fees must be paid and current for this permit to remain valid. 3. Permit Reissuance & Transfer • This permit is not transferable and is valid only for the location and business listed above. • It must be reissued if there is a change in ownership, business practice, production process, or any other change that could affect wastewater characteristics or volume. • The Permittee shall notify the City in advance of any such change. 4. Duration & Revocation This permit is valid until the Expiration Date unless suspended or revoked by the City for non-compliance, unpaid fees, or changes in applicable regulations. HM1 and B3402 arrived at scene, B3402 was assigned as HazMat group supervisor with prevention 21, and HM Tech Hutslar assigned to them. isolation area was identified as the building and ICP suitable distance from building. Div alpha confirmed knockdown and involvement of several Li-Ion batteries. IC made an emergency notification for all personnel to keep PPE on and report to gross decon after leaving IDLH to removed particulates per Haz Mat Group, PAR conducted with all resources confirming the order. Two additional engines were ordered, E5191 was cancelled prior to arrival, E5392 was assigned to Division A so personnel could rotate out after several work periods. T2 was released and E40 requested to the scene for HazMat personnel. HazMat group briefed all operational personnel on the HazMat plan to contain the battery packs involved, see HazMat narrative. A key card was handed to E4 Captain to access locked doors in the structure. E4 Captain had E4 FF pull a 2 1/2" to the glass door entrance for a wye line operation. E4 operator worked on getting a supply line at the closest hydrant on Higuera with the aid of E3 Engineer and CalFire BC. E4 Captain requested E3 to assist with grabbing both wye lines while E4 entered the main entrance to find access to the fire. The main open area on the west side of the building where all the cubicles were located was all clear with slight haze. As E4 Captain turned the corner, he noticed water on the ground from what appeared to be an active sprinkler on the other side of the wall and backtracked to a locked door. The key card was used to open the door and E4 was met with dark grey smoke banked all the way to the floor. There was zero visibility and TIC was used to assist in finding the seat of the fire. E4 and E3 made access in the room to locate the fire. Locating the fire was challenging due to zero visibility and glass walls making it challenging for the TIC to identify the fires location. As the two crews progressed further into room, the temperature was increasing indicating we were close to the seat of the fire. E4 eventually found the seat as the glass panes broke and the TIC was able to identify its location. E4 was able to knockdown the fire and E3 extinguished the fire as E4 had to back out due to low air warning. E4 personnel was deconed several times after initial entry and subsequent entries for salvage and lithium iron battery cleanup. T1 arrived at scene and was given the assignment for vertical ventilation by BC3. T1 set up aerial for roof access on the alpha side. T1 also threw a 35' ground ladder on side alpha. T1 was staffed with six personnel, two from medic rescue. Four of the six personnel access the roof via the aerial and the remaining two crew MR1 members stayed on the ground for support, adding and assisting with ground ladder locations and rehab. T1 made access to roof, roof was a saw tooth design construction. T1 ladder was placed at the exterior wall and the high point of the saw tooth design. T1 crew utilized a 14' roof ladder to assist in descending to a safe location at the bottom of the 8/12 pitched roof (roof was approx. 26'-30' long from top to bottom). T1 was notified of BC 3405 would be Roof Division. Roof construction was 29-gauge metal, rib style roof with 1/2"-5/8" plywood sheeting with approx. 20" TJI roof rafters with a 2' on center span. Top half of metal roof was covered in a thin layer of moss making it very slippery. T1 Captain and crew made our way near the South end (towards marketplace) of the roof. T1 requested a 24' ground ladder to be utilized as a roof ladder, from bottom of saw tooth to top. T1 cut an inspection hole to see construction material. T1 fully extended 24' ladder. T1 crew cut multiple 4x4 holes and extended the holes vertical as we made our way down the ladder. T1 face to face with T2 Captain requesting another 24' ladder for egress on side Alpha. T1's crew bottles ran low, exited the roof for bottle exchange. T1 returned to roof and extended vertical holes laterally. BC 3405 Roof Division was reassigned and T1 assumed Roof Division. T1 completed assignment and reported to med unit for EMS vitals evaluation. T-2 arrived and was assigned 2 out. T-2 was setting up at the entry point and was reassigned to RIC. FF-2 and PUMP-2 cached out the RIC complement near the entry point. T-2 coordinated cutting access for an additional ladder to the Alpha side, gaining access points around the building and tracking resources. T-2 also assisted with rehab setup. Initial RP at scene reported that lithium batteries from a drone were possibly involved, and that all occupants were out of the building and in a staging area at the back of the parking lot. E4 was first due and assigned division A with a primary objective of determining where the fire was and what resources were needed, the building area of the fire was a large open space and smoke conditions made visibility poor. T1 arrived at scene and was assigned roof division with the objective of vertical ventilation. Chief 2 arrived at scene and assumed IC, BC3 assigned operations. Chief 2 made a working incident notification, requested a second alarm and a full HazMat response. E3, T2 and E21 arrived at scene and were assigned to division A . Division A assigned T2 to RIC, accomplishing two out. Prevention 20 arrived at scene and was assigned as a safety, and to conduct a 360. 360 report was unremarkable. City building inspector and Prevention 20 secured the building and transitioned it to the RP. IC terminated, all units were released. E3 arrived on scene and was assigned to assist E4 with fire attack. E3 engineer assisted E4 with establishing a water supply. E3 Captain and FF stretched a secondary attack line and advanced into the fire room. Once E3 engineer finished assisting E4 with establishing a water supply he linked up with E3 Cpt. and E3 FF. E3 assisted E4 with fire attack. Once the fire was extinguished E3 exited the fire building and went through gross decon outside. E3 reported to rehab and awaited further assignment. Once rehabbed E3 was assigned to make entry and collect personnel effects of employees. Once the assignment was complete E3 went to rehab. Once rehabbed E3 then assisted the Haz-Mat team with removing hazardous material from the structure. Once All hazardous material was removed E3 exited the structure and went through gross decon. E3 was released by the IC and returned to the station for rehab and decon of personnel and equipment. Training 1 arrived on scene with (1) one firefighter Emerson. Firefighter Emerson was directed to attach to E-4 personnel. Training 1 donned PPE and made face to face contact with IC @ICP. IC advised Training 1 to assume Alpha division. Alpha division initial resources included E4, E3, T2 and E21. E-4 and E-3 initiated fire attack based on objectives. Attempts were made to meet objective of fire suppression, primary and secondary search. Poor interior visibility once 20-30' interior included moderate grey smoke banked down from 1-2' from floor. E-4 initiated fire attack at the nozzle as E3 backed up E4 progress of attempting to locate and suppress fire. E21 remained two-out and T2 reassigned as RIC. E4 required to exit structure for low air. E4 evacuated and E3 assumed nozzle line for attack. Unable to find location of fire. E4 personnel returned interior with full breathing air cylinders and E3 required evacuation for low air bottle. E21 advised to move up hose line to back up E4. Alpha Div requested vertical ventilation. T1 was able to perform vertical ventilation. Visibility improved. E4 was able to make progress and locate fire. Suppression was conducted with 1 3/4" hose line. Sprinkler heads open in fire room. Limited exposure to fire room after IC advises of Lithium Ion fire and a possible Haz Mat incident. SOURCE OF ACTIVITY On January 12, 2026, at approximately 0824, San Luis Obispo County Dispatch received a 911 emergency call reporting smoke and flames seen at 3825 South Higuera, San Luis Obispo, CA. 93401 in San Luis Obispo County. At approximately 0825 hours, while working my regular schedule as the SLO Fire Department (SLOFD) Fire Marshal (PREV20), I responded code 3 from my office at SLOFD Station 1, 2160 Santa Barbara Ave., San Luis Obispo, CA. I arrived at the fire scene at approximately 0838 hours and cleared it at approximately 1730 hours. OBSERVATIONS/ACTIONS Upon my arrival, I observed Battalion 3 (BC3), Truck 1 (T1), Engine 4 (E4), and Engine 3 (E3) entering the 10,000-square-foot commercial structure to begin a fire attack and ladder the roof for ventilation. I observed faint smoke coming from the southeast (A-D corner) of the building. I reported to the Higuera IC and was originally assigned to Safety; my role later changed to Medical Group Supervisor. I conducted a 360-degree building inspection and spoke with representatives from the ESAero business to confirm that no one had medical needs. No medial needs were requested. I then walked to nearby businesses and asked them to remain inside and turn off the HVAC due to smoke drifting southeast from the building. I contacted an SLO PD officer and asked whether we could expand the safety zone to keep people out of harm's way from the smoke. SLO PD officers assisted in expanding the perimeter. I then contacted the standby ambulance and confirmed they were on the Tac 1 radio channel. I assisted in setting up a rehab location with all necessary supplies. After suppression efforts were effective, I was then assigned to the Fire Investigations lead. INVESTIGATION My investigation actions and findings are based on a scientific examination of the fire's origin and cause. Methodology The methodology I utilized during this investigation consisted of identifying all available data for origin determination, including witness accounts, an initial scene assessment, development of a preliminary fire spread hypothesis, an in-depth examination of the fire scene, reconstruction of the fire scene, development of a final fire spread hypothesis, and identification of the fire’s origin. I identified all available data for cause determination, including ignition sources, fuel packages, oxidizers, and circumstances. I used all available resources to develop fire-cause hypotheses and determine which best fit the credible data to identify the cause of this fire. During my investigation, I obtained witness statements. I conducted the interviews in full uniform. The following is a summary of the statements I collected. While enroute, dispatch updated information that fire was located in a barrel outside the structure and assignment was reduced to BC2, E4, and E3. BC2 arrived on scene and assumed command. E4 was assigned 360 size up. E4 was met by staff who reported a barrel drum had been on fire and gone out. E4 made access to the patio area where barrels were being stored and found a single barrel with an approximately 6 inch flame coming from a hole in the top. E4 isolated the area and pulled a hose line for possible extension and ventilated the area with power fan. E3 was assigned to assess the barrel for possible Haz mat. Upon conferring with resources on and off scene, E3 was able to determine that a water/salt solution could be applied to the material inside the barrel to safely cool and extinguish the fire. Water and salt solution was applied inside the barrel and material was successfully cooled and extinguished. All units remained on scene for another 30 minutes to ensure the barrel in question remained static and all heat had completely dissipated. Command was terminated, all units were released and cleared from scene. Additional Narrative Additional Narratives Authored By Authored Date Engine 3 arrived on scene and was assigned to Recon by IC. Hazmat 46 contacted Engine 4 and noted one barrel containing a lithium ion battery was producing heat and flame from vented hole. Hazmat 46 confirmed the barrel was heated to 250+ degrees on thermal camera indicating the lithium ion battery was in thermal runaway. HM46 and Prev21 decided to cool the barrel with water and place battery in a brine solution with 2lbs of salt. Approx. 30 gallons of water was placed into drum, and temperature was approximately at 100+ degrees. Salt was added to the drum and thermal camera indicated drum remained at 90 degrees for the remainder of the incident. HM46 and Prevention 21 informed IC the hazard had been mitigated with brine solution. BC 2 responded and requested E4 respond to the incident. On arrival, BC 2 assumed command of the incident and had E4 check the area. E3 donned PPE and SCBAs and assessed the barrels that Page 2 of 5 Incident Location:3825 HIGUERA South Incident Date:01/15/2026 Incident City, State, Postal Code:San Luis Obispo, CA 93401 Incident Number:26-00326  Incident Date:01/15/2026 had previously been producing smoke from those that had lithium-Ion batteries stored in them. The barrel in question, had a heat signature that showed 110 degrees. The barrel was no longer smoking, and I made the decision to have E3 back out of the area to a safe location approximately 70 feet away from where the barrels were being stored. The plan was to monitor the location for another 15 minutes and then turn the scene over to the security company that was providing 24-hour fire watch. E4 was released, and E3 and BC 2 remained at the scene to watch the area and rehab E3's PPE. While E3 crew was putting their gear away, another barrel began emitting smoke. The smoke was going straight up, and the wind was calm. The smoke column then moved toward where E3 was parked and the Captain on E3 was exposed to the smoke. He began moving away from and out of the smoke while coughing from the exposure. Once I witnessed this, I request his crew to treat E3 Captain in an area farther away from where he was first standing. I requested an ambulance and two additional units (T1 and E4). I requested all units respond up wind and we moved both E3 and the BC vehicle to a safer location approximately 200 feet from the barrels. SLAS arrived and transported E3 Captain with the FF/PM to continue treatment. E3 engineer left the scene and headed to the ED to meet with E3 captain. I then requested HM 1 with a full hazmat response, Chief 1, and an emergency callback. The acting deputy chief and emergency manager also responded. When T1 and E4 arrived at scene, crews expanded the exclusion zones, and SLOPD assisted with closing off two driveways to the parking lot. As IC my primary objection was to isolate the area and deny entry until HM 1 arrived. Once HM 1 arrived they were advised of the incident and updated on what had been done over the last two days. Multiple HazMat Specialists assessed the situation, and it was determined that the best course of action and safest option would be to monitor the barrels and not make any further entry into the area until a private hazmat company could respond and properly dispose of the batteries. During the time the hazmat team was on site the barrels did emit smoke two more times. HM 1 was released from this incident and E4 and BC 2 remained at scene in a safe distance to monitor the barrels. After multiple hours, the barrels did not have any further reactions. The scene was then turned over to the property owner and private security company that was providing a 24 hour fire watch. E4 was released, Higuera IC was terminated, BC 2 went available. Additional Narrative Additional Narratives E4 arrived on scene to find during the investigation phase of the incident. E4 was assigned to survey the area north of the dispatched location to check for possible smoke production. E4 patrolled the area up to Prado Rd. with no smoke found. BC2 and units on scene had found the source of the smoke and advised could handle with units on scene. E4 was released from incident and returned to quarters. E4 was requested back to the scene by BC2 and responded C3 to the incident. E4 arrived on scene and was assigned to isolate and evacuate the area surrounding the incident. Upon completion of task, E4 met with units on scene and was briefed on incident objectives going forward. After briefing, E4 was assigned to make entry to the patio area containing the barrels producing the smoke and mitigate the hazard by adding a salt brine solution to any barrels meeting the requirements for intervention as outlined in the briefing. E4 crew members donned full PPE with SCBA, ventilated the area with power fan and made entry with charged hose line. E4 completed the assignment as instructed and surveyed the conditions of the barrels and patio area. E4 crew exited the patio area and met with units on scene at the ICP for report on conditions of the patio area and barrels and debrief. E4 remained on scene to return equipment back to service and assist with monitoring the area for approximately 30 minutes. E4 was then released from incident by BC2 and completed assignment. This is a response from a previous incident of a lithium battery fire. A few days prior multiple lithium batteries caught on fire at this site and were removed once extinguished. The batteries were placed in 55 gallon drums, moved to the exterior and filled with water and salt. Since then the batteries inside the barrels have been reigniting with fire and smoke seen. E4, E3 and BC2 were at this site earlier in the night for the same reason. A security guard was informed to watch the seen and call 911 if the barrels reignite. E4 arrived on scene and found no smoke or fire. E4 evaluated the barrels and found one of them with half the water gone. It appears that one of the batteries had reignited boiling most of the water out of the barrel. E4 donned full PPE, extended a hose line to the barrel and filled it back with water. The barrel was checked with a thermal imaging camera and minimal heat was present. No further hazard was present, E4 informed the security guard to call back if another barrel started smoking again. E4 cleared the scene and returned. Upon arrival, E4 established Higuera IC and reported light smoke showing from the outside patio area where the containment barrels had been staged. BC2 arrived and assumed command, T1 requested for two out. Upon T-1 arrival, E4 and FF made entry on SCBA to the exterior patio to determine if there was a hazard. No smoke was showing, containment barrels were still full of medium and water, no hazard. Thermal imager revealed one barrel had an exterior temperature of 135 deg F, but no smoke or steam was rising from the open top barrel. We all appreciate the level of collaboration, as it reflects both the City’s direction and ESAero’s obligation to address these serious and important items in a transparent and lawful manner. Unfortunately, given the circumstances, our ability to immediately resolve the items noted in the 01 and 02 December 2025 SLOFD Fire Inspection Reports has been severely hampered. As noted in the previous extension request, dated 23 December 2025, some of the noted items have been resolved, e.g., signage to the Fire Alarm Control Panel and the addition of the facility to the Hazardous Waste Generator Program under CUPA permit. We continue to work diligently with our consultant team to correct the balance. As you know, ESAero’s priority is to return the manufacturing portion of the S. Higuera facility to full operations as soon as practicably possible, while fully resolving the corrections. To that end, environmental sampling/testing and cleaning has been on-going and will continue until your department, et al. inspect and, ultimately, deem the facility approved for reoccupation. The office portion of the facility will be the next priority, while we continue to pursue the resolution of inspection items. I understand that your inspection schedule is dependent upon ESAero’s receipt of the final test results in the manufacturing area of the S. Higuera facility. That inspection is tentatively scheduled for either Thursday, 05 February or Friday, 06 February. Inspections of both the S. Higuera and Empleo sites are anticipated to occur on Thursday, February 12 to review the status of outstanding items, as well as current operations. Below is an overview of our activities to better assess the situation and establish realistic expectations. SOUTH HIGUERA FACILITY • The Manufacturing Area – This area of the facility should be ready from an environmental perspective for your inspection on 05/06 February. This aspect necessarily includes design, procurement, and installation of the new system. While the consulting engineers are designing a code compliant system and preparing plans and calculations, accordingly, to expedite the installation, we will ultimately prepare an as-built application to submit to the Community Development Department/Building Division. With regards to the Inspection Room. Our consulting Fire Protection Engineers (FPE) are preparing an analysis and recommendations for the appropriate fire suppression system for this room and its contents. This report should be available on or before the proposed 05/06 February inspection. Our goal is to retain a design/build C-10 & C-16 fire sprinkler contractor, who will prepare the plans based upon the FPE’s recommendations. Again, this system could be installed and operationally tested by SLOFD with a subsequent lodging of an as-built application or, if time allows a more traditional permit process. The Layup Room design is also being analyzed/peer reviewed by our structural engineer, electrical engineer, FPE, and mechanical engineer. We have asked our team to make the manufacturing area and the Inspection Room the priorities for now but anticipate that the Layup Room would be processed as a traditional permit application, although we would request an expedited plan check review. • The Office Area – Again, the focus has squarely been on the manufacturing area, but the next priority is the office area and the adjacent Annex, where the fire originated. The plan is to perform environmental testing and waste classification, removal the flooring, cubicles, and related materials as well as office amenities, perform cleaning as required, and then complete environmental testing that will be submitted to your department before scheduling a re-occupancy inspection. EMPLEO FACILITY The consultant team is actively working on the tasks noted below that will not only address the SLOFD’s Inspection Report items but assist ESAero to make an informed decision whether this building is physically and economically suitable for their purposes. • The architects are analyzing the occupancy of the building in addition to the disposition of the sea/storage containers, i.e., setbacks, requisite building parking spaces, separation and working with FPEs, accordingly. • The structural engineer has determined that the existing structure can, in fact, accommodate the weight of a sprinkler system, therefore, • The sprinkler contractor is currently assessing the building, accordingly, to provide a cost estimate for installation, which would necessarily include tying into the water main, the addition of a BFP, alarm, etc. • The FPEs are assessing the existing battery storage cabinets to determine proper spacing, venting, etc. 1 Festoon electrical systems are overhead wiring setups used for powering equipment, etc. that typically consist of a series of suspended cable or tracks, while allowing flexible movement of the electrical connections. This item has not been verified or approved by the San Luis Obispo Fire Department, nor has any evidence of compliance been submitted, as previously stated in the Fire Department’s January 6, 2026, correspondence. Pursuant to CFC Section 104.2, approval of corrective actions is subject to verification by the Authority Having Jurisdiction (AHJ). Until field verification occurs, this item remains unresolved. Correction to Inspection Schedule Your letter incorrectly states that inspections will be conducted at both the South Higuera and Empleo facilities on February 12, 2026. For clarity, the Fire Department confirms the following: Fire and Life Safety inspections are scheduled for February 12, 2026, at the following locations only: o 3534 Empleo Street o 3580 Sueldo Street 3825 South Higuera Street – Separate and Distinct Timeline The building at 3825 South Higuera Street is on a separate, independent enforcement timeline due to the improper storage and accumulation of lithium-ion batteries in excess of allowable quantities, which resulted in a fire on January 12, 2026.  The factory/manufacturing area was inspected on Wednesday, February 4, 2026.  This inspection is a post-fire incident inspection conducted pursuant to CFC Sections 104.2, 107.7, 320, 5001, and 5003.  This inspection is not a follow-up to the prior Fire and Life Safety inspection, nor does it constitute clearance of previously cited violations.  The follow-up Fire and Life Safety inspection for 3825 South Higuera Street will need to be rescheduled and remain in flux, due to higher-priority life-safety and environmental issues, including hazardous waste awaiting classification and removal. Definition and Proper Use of “As-Built” Documents For clarity, the Fire Department finds it necessary to formally define the term “as-built” as referenced in the extension request. Under the California Building Code (CBC) and California Fire Code (CFC), as-built (also commonly referred to as record drawings) means the final set of construction documents that accurately reflects the work performed in compliance with approved permits, reviewed plans, and required inspections. As-built drawings document approved field modifications made during construction after permit issuance, and they are submitted to verify conformance, not to establish approval. As-built drawings:  They are derived from previously approved plans.  Reflect permitted and inspected construction.  Are used to document minor, approved field changes; and  Do not authorize new work or retroactively approve unpermitted construction. Improper Use of “As-Built” in Extension Request The Fire Department finds that the term as-built has been improperly used in the extension request to describe proposed documentation for work that was not permitted, reviewed, or approved at the time of construction. Pursuant to the California Building Code and California Fire Code, construction or installation performed without required permits or approvals constitutes unpermitted or illegal work. Such work cannot be legitimized through the submission of as-built drawings, nor can as-built documentation be used as a substitute for plan review, permit issuance, or inspection. Any reference to “as-built” documentation for the following is incorrect:  Unpermitted rooms, enclosures, or structural modifications.  Fire protection systems installed without Fire Department approval.  Hazardous materials rooms or suppression systems constructed without permits; or  Any construction that occurred outside the scope of approved plans. Unpermitted or illegal construction must be addressed through the appropriate enforcement, plan review, and permitting process, as required by the CBC, CFC, and SLOMC Title 15. Outstanding Documentation Request The Fire Department further notes that an email sent on January 7, 2026, requesting additional documentation has not received a response. Pursuant to CFC Section 104.3, the following materials are required:  A copy of the city-approved plans for the 16-foot by 14-foot “inspection room” located at 3825 South Higuera Street.  A copy of the Fire Department–approved plans for the dry chemical extinguishing system serving the inspection room; and  A copy of all city-approved plans for all electrical and mechanical equipment installed during the time of occupancy.  Any associated permit numbers, approval records, or inspection documentation related to both the inspection room, the extinguishing system, electrical equipment, and mechanical equipment. Consultant Identification Request Consistent with prior conversations between ESAero staff at the time of all failed fire and life safety inspections at all three locations, and conversations with the same staff as well as Oasis Associates. Pursuant to CFC Section 104.2.2, the Fire Department is formally requesting a complete list of consultants retained by ESAero to perform the prescribed corrective and post-incident work. Please provide the names, disciplines, and roles of all consultants currently engaged, including but not limited to:  Fire Protection Engineers  Environmental or Industrial Hygiene Consultants  Structural, Electrical, or Mechanical Engineers  Hazardous Materials or Waste Management Consultants Additional Information to Expedite Review In the meantime, any documentation of previously approved items for any of the three buildings would be helpful and may expedite the review. City staff are currently retrieving all available building and fire records, including approved plans, permits, and inspection history. Enforcement and Compliance Failure to comply with the Fire Code, including performing work without permits or mischaracterizing unpermitted construction, may result in enforcement action pursuant to CFC Sections 109.2 and 113, and SLOMC Title 15. Conclusion Given the multiple unresolved violations, lack of verification of claimed corrections, outstanding documentation, improper characterization of unpermitted work, and the seriousness of the January 12, 2026, lithium-ion battery fire incident, the Fire Department cannot grant an extension at this time. For further clarity, a building layout has been added to indicate which areas are classified as “Red” or “Yellow” zones. Due to the nature of lithium-ion battery fires, there is potential for hazardous airborne contaminants and corrosive surface residues that may pose health and safety risks. As a result, the building remains under a Do Not Enter restriction until appropriate environmental clearance has been obtained. The portions of the building designated as Yellow Zones will permit contractor work while air monitoring is in progress. The portion of the building designated as a Red Zone will have the strictest restrictions, and no contractor work may begin until hazardous debris has been removed and an approved, licensed, qualified environmental consultant or an industrial hygienist has performed the required post-hazardous-debris-mitigation testing. Hazardous Debris Identification and Removal All fire debris, damaged battery components, suppression residue, and contaminated materials found within the room of origin (Red Zone) shall be evaluated and handled as potentially hazardous until properly characterized. Removal and disposal shall be conducted in accordance with applicable state and federal hazardous waste regulations. Once all hazardous waste has been removed and disposed of appropriately, air and surface testing may begin. Air Quality and Environmental Testing An industrial hygienist or qualified environmental consultant shall conduct comprehensive testing within the red zone identified on the building layout (see attached map), which must include, at a minimum:  Indoor air quality sampling  Surface residue (wipe) sampling in affected areas Testing and analysis shall evaluate contaminants commonly associated with lithium-ion battery fires and shall establish clearance based on Cal/OSHA occupational exposure standards, including:  Title 8, California Code of Regulations (CCR) §5155 – Airborne Contaminants  Title 8 CCR §3203 – Injury and Illness Prevention Program (IIPP)  Applicable OSHA Permissible Exposure Limits (PELs) for an 8-hour workday Clearance Documentation Upon completion of testing, a written report prepared by the industrial hygienist or environmental consultant shall be submitted to the City of San Luis Obispo Fire Department. The report must include:  Air quality testing results  Surface residue testing results  A statement of clearance confirming conditions are acceptable for an 8-hour occupational exposure based on OSHA PELs Lifting of the Do Not Enter Restriction Once the Fire Department has received and reviewed the clearance report demonstrating acceptable conditions, the Do Not Enter restriction will be lifted. Post-Fire Building Inspection and Utility Restoration After the restriction is lifted, the affected parties may request a post-fire building inspection from the City of San Luis Obispo Building Department. This inspection will be conducted to:  Assess fire-related structural and system damage.  Determine requirements for repair permits.  Confirm conditions for restoration of utilities, as applicable. Please note that no repair work or general contractor access is authorized until the clearance documentation has been submitted and approved, and the Fire Department has formally lifted the Do Not Enter restriction for the Red Zone. See the attached map for details on which areas of the building meet the above requirements. The areas highlighted in red would have full restrictions, while the areas highlighted in yellow would have air-monitoring requirements during cleaning and any other mitigation measures as deemed appropriate by the industrial hygienist or qualified environmental consultant.
