Please provide the following records in your possession: Any and all records involving any motor vehicle or motor vehicle versus pedestrian collisions within 1000 feet in either direction from the above-referenced intersection over the two year period before my client's collision, and any and all responsive reports in your possession occurring after that date. Specifically, I am requesting all collision or incident reports, including, but not limited to all Traffic Accident Surveillance and Analysis Systems (TASAS) data, any Major Accident Investigation Team (MAIT) reports for incidents occurring at the above- referenced locations during the specified time frame above. This request seeks all responsive diagrams, photos, witness statements, 911 audio, CAD Logs, or any other materials related to responsive TASAS data, collision and/or MAIT reports falling within the 2 year time frame set forth above. See, e.g., Davies v. Superior Court (1984) 36 Ca1.3d 29I, at 299-300 (holding that traffic collision reports are discoverable under the California Public Records Act); see also, State of California vs. Superior Court (Paniagua) (2022)77 Cal.App.sth 998, at 1003-1005 (holding that plaintiffs investigating a dangerous condition of property case were "persons with a proper interest under the statute" to obtain other accident reports and related dataatthat location). Please provide the requested information within the next 14 days. Alternatively, please confirm that your client has refused to reveal their policy limits to us. I ask for a determination on this request within 10 days of your receipt as required by the CPRA at Govt. Code Sec. 7922.535(a). Should part or all of this request be denied, please provide a written response describing the legal authority or authorities on which the denial is based, as required by the CPRA. Please also address the question whether Proposition 59 requires disclosure even though authorities predating Proposition 59 may appear to support your exemption claim.
