HomeMy WebLinkAbout07/06/1993, C-3 - TRANSFER OF APPLICANT STATUS FROM THE SAN LUIS OBISPO COUNCIL OF GOVERNMENTS (SLOCOG) TO THE CITY OF SAN LUIS OBISPO FOR PROPOSITION 116 GRANT APPLICATIONS MEETING DATE- city ATEcity of san lus oBispo July 6, 1993 we is COUNCIL AGENDA REPORT "NUEfl: FROM: Michael McCluskey, Public Works Direct PREPARED BY: Harry Watson, Transit Manager SUBJECT: Transfer of Applicant Status from the San Luis Obispo Council of Governments (SLOCOG) to the City of San Luis Obispo for Proposition 116 grant applications CAO RECOMMENDATION: By resolution, approve the transfer of applicant status DISCUSSION: The City Council has previously taken action by Resolution Nos. 8039 and 8040, authorizing applications through SLOCOG for Proposition 116 funding of the Multi-Modal Transit Transfer Center and the Railroad Bicycle/Pedestrian Bridge project. SLOCOG has requested that the City assume primary applicant status of Proposition 116 funds for both transit and bicycle projects. Other minor changes have been made to the applications, specifically substituting our grant application request amount for the actual amount allocated by SLOCOG. Milestone dates have also been changed due to preliminary engineering study activities currently in progress. Copies of the amended grant . applications are available in the Council Office. (1993 SERIES) A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO TRANSFERRING THE APPLICANTS STATUS FOR A PROPOSITION 116 GRANT FROM THE COUNCIL OF GOVERNMENTS TO THE CITY WHEREAS, the City of San Luis Obispo has previously filed applications for Proposition 116 funding for the development of a Multi-Modal Transit Transfer Center and for a Railroad Bicycle/Pedestrian bridge; and WHEREAS, those applications have been previously approved for funding by SLOCOG at reduced funding levels; and WHEREAS, SLOCOG's program of projects for Proposition 116 funding is going forward to the State of California; and WHEREAS, the SLOCOG is the designated regional transportation planning agency (RTPA) and eligible applicant identified in Proposition 116, and WHEREAS, the San Luis Obispo Council of Governments (SLOCOG) has requested that the City become the applicant for Proposition 116 funding; and NOW, THEREFORE, be it resolved by the Council of the City of San Luis Obispo as follows: (1) That the City of San Luis Obispo accepts the transfer of status and all management responsibility for the project. (2)That the City of San Luis Obispo can encumber the funds within 24 months following funding allocations. (3) That the City of San Luis Obispo will construct and operate the projects in a manner that is fully accessible to older persons and persons with disabilities, including wheelchair users, in accordance with the provisions of the Federal Americans with Disabilities Act, and further certify that the projects will be reasonably accessible to bicycle users. An overview of the missing information for the two projects from the City of San Luis Obispo is discussed below. Dan Herron discussed the some of these issues with Ken Hampian in September, 1992. REGIONAL TRANSIT TRANSFER CENTER Funding Amount: The application requests $24 million. This funding amount should be replaced with the $1,016,205 approved by the COG. Project Location: The project location is identified as the block bound by Toro, Santa Rosa, Monterey and Higuera Streets. Is this still the preferred location? Update _ as appropriate with the new information provided in your consultant study. Project phasing: In Part 3b, the language in the first paragraph of the text does not seem to pertain to this application. J Site Map (3c): No site maps with the location alternatives or preliminary design concepts are included. Financial Plan: The table on page 17 needs to be modified to reflect the approved Proposition 116 funding amount. Cash Flow Expenditure Plan: The funding amounts need to be modified, and the expenditure plan should be consistent with the project schedule on page 18. Resolution:- The executed resolution (No 8039, 1992 series) does not indicate acceptance of eligible applicant status. Attached is an example resolution showing acceptance of eligible applicant status. One resolution could be prepared for both the Rail/Bike bridge and Regional Transit Transfer Center. The supporting resolution by the County in the application has not been finalized. (805) 781-5703 BICYCLE/PEDESTRIAN BRIDGE On May 7th I gave Craig Anderson the new bicycle forms for the pedestrian/bicycle bridge over the railroad tracks. Since only one of the five phases in this project has been approved for funding the entire application needs to be rewritten. I will be meeting with Terry Sanville and Craig Anderson on June 7th to review their revised application. The acquisition of rail right-of- way becomes a complicated process with the appraisal requirements and necessary certifications that the property is free from environmental contaminates. No less important is the agreement from Southern Pacific to sell the land. While the appraisal, environmental analysis or land acquisition agreement do not need to be completed before submitting the application to the state, they should be addressed in the application.
