SUBJECT: Change to City/County Library Joint Powers Agreement
CAO RECOMMENDATION: By motion, approve and authorize the Mayor to execute an
amendment to the City/County Library Joint Powers Agreement reducing the Library's
hours of operation from 54 hours per week to 50 hours per week beginning July 12, 1993.
DISCUSSION:
Background
The City currently holds a Joint Powers Agreement (JPA) with the County of San Luis
Obispo for the operation and maintenance of the City/County Library. Under the
agreement, daily operations are split between the County and the City with the County
taking responsibility for the library itself and the City taking responsibility for the
Community Room and Conference Room. Ongoing maintenance and liability of the facility
is shared between the County and the City. Any changes to this agreement require the
approval of both the County and City.
The County recently advised the City that the Library will suffer a loss of $430,000 in
property tax revenues during the coming fiscal year (which represents 10% of the Library's
total budget). As a consequence of this, the County Librarian has been forced to develop
a plan to balance their budget that calls for, among other significant operational cuts,
reducing the City/County Library service hours by 10% (or 4 hours per week) and all
branch libraries by 20%. Under the Librarian's proposal, the City/County Library's hours
would be reduced by 3 hours on Thursday nights (closing at 5:00 pm as opposed to 8:00 pm)
and 1 hour on Friday mornings (opening at 11:00 am as opposed to 10:00 am) beginning
July 12, 1993 (see attachments 1 and 2 for branch library service hour reductions). The
Librarian's recommended reductions in service hours have been proposed during periods
historically considered "low use" by the community.
Summary of JPA Amendment
Because the Library JPA requires the County to keep the City/County Library open a
minimum of 54 hours per week, six days per week, the City must agree to any reductions
to service hours. As such, the County has prepared an amendment to the Library JPA that
reduces Library hours by 4 hours per week (but maintains the six days per week
requirement) beginning July 12, 1993 and has requested City Council approval. It is
important to note that the Librarian's original proposal called for a more significant
reduction in hours at the Library (e.g., closing one full day). City staff opposition to this
plan, however, resulted in its subsequent withdrawal in favor of the current plan that
recognizes the importance of maintaining a strong central Library.

Recommendation
I
Staff has reviewed the amendment to the JPA and recommends approval. The plan put
forward by the County Librarian is reasonable and, as proposed, will have the least impact
on the community. In addition, discussions with County staff confirm that the Library's
operational budget is "bare bones" and, therefore, reducing staff is the only alternative
available to balance their budget. It is also important to advise the City Council that
current proposals under consideration to balance the State's budget could result in more
severe budget reductions to the Library (and therefore future requests from the County to
amend the JPA).
The Board of Supervisors approved the amendment to the Library JPA at their June 22,
1993 meeting.

AMENDMENT #1
CITY-COUNTY LIBRARY JOINT POWERS AGREEMENT
WHEREAS, the City of San Luis Obispo and the County of San Luis Obispo entered
into a Joint Powers Agreement on October 3, 1989 for the construction and operation
of a City-County Library; and
WHEREAS, the parties desire to amend said agreement to reduce the required days
and hours of operation;
NOW, THEREFORE, the parties hereto agree as follows:
1. Paragraph five of the existing agreement is hereby amended so that the last
sentence thereof reads as follows:
"The Library will be open to the public at least six days per week and
50 hours per week".
In all other respects, the existing agreement between the parties remains in full
force and effect.
Effective on the last day of execution set forth below.
