Gladwell, City Clerk :.I,' SUBJECT: Council Subcommittee to Review Legislation CAO RECOMMENDATION: 1. Appoint Council Members Rappa and Settle to serve on a Subcommittee for purposes of monitoring and preparing responses to Federal and State Legislative activities. 2. Appropriate $1,440 from the General Fund balance to allow access to Citylink services. DISCUSSION: Background During the Council meeting of July 20, 1993, Councilmember Rappa asked the Council to appoint a subcommittee for purposes of responding to high priority legislative activities. Council directed staff to place an item on the consent agenda so that Council Members Rappa and Settle could be formally appointed to serve on the Subcommittee. By way of background, on January 19, 1993, the City Council approved a legislative action program, including the adoption of a resolution establishing "City Legislative Action Priorities for 1993". It was the City's intention to be far more aggressive in the area of legislative advocacy. However, as set forth during the Budget process, reductions in Administration Department staffing (25%) has severely curtailed the amount of staff time that can be invested in this area. Although staff continues to monitor legislation and prepare letters for signature by the Mayor for the most high priority issues, there are undoubtedly a number of other legislative matters that would benefit from a City response. The Council Subcommittee can help fill this void, and staff appreciates the Council for taking the initiative in this area. The Process It is recommended that the Subcommittee follow the adopted legislative action process (Attachment 1). This includes receiving copies of League communications, identifying key issues with official League positions and as specified in Exhibit A to the policy, then drafting responses. The draft would be typed by the Council Secretary, reviewed by the CAO, signed by the Mayor (or Vice-Mayor, in her absence) and subsequently distributed to appropriate legislators and the Council by the Council Secretary. The adopted policy also states that where Council position is not clear, a position will not be taken unless there is time to bring the matter to the Council for determination. ����►�►bN�IUIIIIIIIII�I�►��I��U�II city of San 1U.5 OBISpo Nii% COUNCIL AGENDA REPORT Unfortunately, the current workload combined with reduced staff resources does not permit a complement of management staff to the Subcommittee effort (at least not without altering other major priorities). However, staff will be available for consultation, and appropriate communication between staff and the Subcommittee should occur to assure that there is no duplication of effort (since staff will continue to monitor and prepare responses for high priority legislative matters). Deb Hossli in Administration has been appointed as the contact person to the Subcommittee. Use of Citylink Council expressed an interest in "Citylink", an on-line service provided through the League of California Cities that allows research into pending legislation and programs in other municipalities pertaining to a broad spectrum of issues. This service would allow the subcommittee access to timely and complete information regarding legislative issues. The subscription rates are based upon hours used, and start at $1,380 for 24 hours; the highest range is $3,903 for 108 hours (see attachment). One logon is included in the base fee, each logon is an additional $60.00 annually. If the Subcommittee wishes to use this service, staff recommends subscribing at the minimum fee level (a total of $1,440). ATTACHMENTS: 1. Citylink Subscription Form(additional material will be distributed after League staff returns from vacation) kh\leg.rpt MY Of San LUIS OBISPO Nii% COUNCIL AGENDA REPORT Recommended Process The Council's role in the past legislative process can be enhanced through the formal adoption of a resolution establishing the City's Legislative Action Program. The recommended program will: 1. Formalize a process for taking timely action on key Federal and State legislative activities; 2. Establish City legislative priorities so that actions can be better focused; and 3. Assure regular face-to-face contact with other elected officials. To assure that these efforts are consistent with Council policy and priorities, the resolution authorizes actions which conform with: Recommendations of the League's weekly Legislative Bulletin and the occasional League Legislative Alert for State and Federal legislation; resolutions supported by the Council and adopted by the League at the Annual Conference (Council Reading File); and the legislative priorities adopted by Council resolution (Attachment 2, Exhibit °Al. Within these parameters, the process is intended to work as outlined below: Process for Action on State/Federal Legislative Activities. Upon receipt of a communication from the League, the Administrative Analyst assigned by the City Administrative Officer will review the information and identify a few key items for quick action consistent with City legislative priorities. City departmental staff knowledgeable on the issues will be asked to provide draft response letters with supporting information by a date or time certain. The draft responses will be reviewed by the Administrative Analyst and approved by the City Administrative Officer. Following CAO approval, each letter will be prepared for signature by the Mayor or, in her absence, the Vice-Mayor. The signed letter will then be faxed,to the appropriate elected officials as indicated by the League. Copies of the letters will be provided to each Council member, to the League Sacramento office, and to regional departmental policy committee representatives as recommended by the League. Replies received by the Mayor will be copied for distribution to the recipients indicated above. As noted above, legislative action will be limited to official League positions and as specified in Attachment 2, Exhibit A. Any important issue clearly outside those parameters will be brought to the full Council for consideration prior to providing a response. Where the Council position is not clear, a position will not be taken unless there is time to bring the matter to the City Council for the determination of a City position. If individual Council Members become aware of other issues, then they should bring these matters to the attention of the full Council, which can direct staff to either prepare a letter of response or a staff analysis for further consideration.
