SUBJECT: City of San Luis Obispo Affirmative Action Plan
CAO RECOMMENDATION:
Adopt a resolution updating the Affirmative Action Plan of the City of San Luis Obispo
DISCUSSION:
Background
The City of San Luis Obispo is committed to the concept of Equal Employment
Opportunity as a basic principle that all persons shall be given equal access and
consideration to positions in the public service limited only by their ability and
qualifications to the job. Affirmative Action is a commitment to achieving the intent
of the equal opportunity laws, through a detailed set of objectives and programs.
designed to achieve prompt and full utilization of minorities, women, and other
protected classes of individuals at all levels and in all areas of the work force.
In 1978, the Equal Employment Opportunity Commission (EEOC) developed guidelines
that public agencies and educational institutions, who were recipients of certain
federal grant funding, must have equal opportunity programs. In 1979, the City
Council of San Luis Obispo adopted its first Affirmative Action Program. Since that
time, the program has undergone periodic review and modification. In 1991, the Plan
was updated by the Affirmative Action Committee and adopted by the City Council.
The revised plan that has been developed by the Committee is intended to not only
meet the legal requirements and intent of the EEO, American with Disabilities Act
(ADA), and Fair Employment and Housing Act" (FEHA), but also promote the basic
principles of fairness and equitable treatment.
The City Council is required to review the updated Affirmative Action Plan by February
1 of every odd-numbered year. Please note that this report has been delayed because
of the non-receipt of census information regarding the race/ethnicity and disability
status of our local labor force. This information was supposed to be available by the
Spring of 1993 and is still unavailable. When these statistics do arrive, an updated
labor market information chart will be replaced in the Affirmative Action Plan.
The City Council is being asked to review and approve the City's updated Affirmative
Action Plan that contains a policy statement reaffirming the Council's ongoing
commitment to equal employment opportunities.

Overview
The updated Affirmative Action Plan is much like the Plan the Council adopted before
in 1979. However, the American with Disabilities Act of 1990 was incorporated into
the document, and sexual orientation has been added as a protected class. The ADA
prohibits discrimination in employment and requires equal access to City programs and
services for the mentally and physically disabled.
The Affirmative Action Plan in your reading file contains all the elements necessary
for a legal plan plus additional personnel policies designed to resolve any complaints
that may arise from violations of the policies. The minor additions are indicated by
shaded areas and the minor deletions are indicated by lining out.
Conclusion

The updated Affirmative Action Plan that is recommended for adoption has been
developed by the Affirmative Action Committee which represents a cross-section of
City departments. The Plan is comprehensive. It sets realistic goals and timetables,
meets legal requirements and reinforces the principles of fair and equitable treatment
of our employees. The effort expended by the many individuals who have participated
in the update of this important policy document has served to renew our commitment
to achieving affirmative action goals.
CONCURRENCES:
The updated plan has been reviewed by the Affirmative Action Committee and has
been found to be satisfactory.
FISCAL IMPACT:
The updated Affirmative Action Plan is funded through the Personnel Department's
operating budget. The cost for reprinting the updated copy of the Affirmative Action
Plan has been budgeted in Personnel's 93-94 fiscal budget year. There is no
additional funding being requested at this time.
ALTERNATIVES:
1. Rewrite the proposed plan. The Affirmative Action Committee has thoroughly
reviewed the revisions and feels that the plan as presented fully complies with
the City's Affirmative Action Policy. Rewriting would result in a significant
work effort for staff and the Committee, which would significantly delay the
update.

_ 2. Do not adopt the updated Affirmative Action Plan. This is not recommended
because it conflicts with previous policy decisions to maintain a current plan.
It is a legal requirement to update the plan.

A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO
UPDATING THE CITY'S AFFIRMATIVE ACTION PLAN
WHEREAS,the City of San Luis Obispo is committed to the concept of Equal
Employment Opportunity as a basic principle that all persons shall be given equal
access and consideration to positions in the public service limited only by their ability
and qualifications to do the job, and
WHEREAS, Equal Employment Opportunity can best be achieved through
definitive programmed affirmative action, and
WHEREAS, it is the City Council's responsibility to review the updated
Affirmative Action Plan every odd-numbered year, and
WHEREAS, the City of San Luis Obispo has had an Affirmative Action Program
since 1979,
NOW, THEREFORE, BE IT RESOLVED, the City Council of the City of San Luis
Obispo hereby adopts the updated Affirmative Action Plan, attached hereto marked
Exhibit A and incorporated herein by reference, and rescinds Resolution No. 6987
(1991 Series).
