CAO RECOMMENDATION Grant final passage to Ordinance No. 1246 (1993 Series), approving a negative declaration and rezoning the parcel from C-S to C-S MU. DISCUSSION The attached ordinance was passed to print on September 7, 1993, as recommended by the Planning Commission. A use permit was simultaneously reviewed, which establishes commercial and residential uses for the site, approves a reduction in the parking requirement, and allows a wall height higher than normally allowed. Significant Impacts A mitigated negative declaration of environmental impact was granted by the Community Development Director. The environmental initial study(ER 72-93)recommends the project include measures to ensure consistency with community plans and goals; compensate for loss of affordable housing; encourage alternative transportation; minimize on- and off-site noise impacts; retain mature trees; and encourage efficient use of energy and natural resources. Environmental mitigation measures have been incorporated into the use permit conditions of approval (R/U 72-93). Consequences of Not Taking the Recommended Action If the ordinance is not passed, no change will be made to the official zoning map. The use permit for the project would not be valid because it is contingent upon Council approval of the rezoning. Attachments: Ordinance No. 1246 (1993 Series) Project site plan Ordinance Summary ORDINANCE NO. 1246 (1993 Series) AN ORDINANCE OF THE CITY OF SAN LUIS OBISPO TO AMEND THE OFFICIAL ZONE MAP FROM C-S TO CS-MU FOR PROPERTY LOCATED AT 3053, 3071, & 3085 SOUTH HIGUERA STREET (R 72-93) WHEREAS, the Planning Commission and the City Council have held hearings to consider appropriate zoning for the subject site in accordance with Section 65800 et. seq. of the California Government Code, BE IT ORDAINED by the Council of the City of San Luis Obispo as follows: , . SECTION 1. Environmental Determination, The City Council finds and determines that the mitigation measures listed in the project's Negative Declaration (ER 72-93) adequately address the potential significant environmental impacts of the rezoning, and reflect the independent judgement of the City Council. The Council hereby adopts said Negative Declaration. SECTION 2. Zoning Man Designation. That the site be rezoned C-S MU(Service- Commercial Mixed Use) as shown on the attached map marked Exhibit "B" and included herein.by reference. SECTION 3. Findings 1. The proposed rezoning will not be detrimental to the health safety and welfare of persons living or working in the area or at the site. 2. The proposed rezoning is consistent with the General Plan. 3. The proposed rezoning is appropriate at the proposed location and will be compatible with surrounding land uses. 4. The rezoning will not have a significant adverse impact on the environment, and the City Council hereby adopts the project's Negative Declaration (ER 72-93). A summary of this ordinance, together with the ayes and noes, shall be published, at least three (3) days prior to its final passage, in the Telegram Tribune, a newspaper published and circulated in said city, and the same shall go into effect at the expiration of thirty (30) days after its passage. INTRODUCED AND PASSED TO PRINT by the Council of the City of San Luis Obispo, at its meeting held on the day of 1993, on motion of seconded by and on the following roll call vote: AYES: NOES: ABSENT: Mayor ATTEST: City Clerk APPROVED: City Alttorpiey SUMMARY ORDINANCE NO. 1246 (1993 Series) AN ORDINANCE OF THE CITY OF SAN LUIS OBISPO TO AMEND THE OFFICIAL ZONE MAP FROM C-S TO CS-MU FOR PROPERTY LOCATED AT 3053, 3071, & 3085 SOUTH HIGUERA STREET (File Number: R 72-93) On September 7, 1993, the City Council voted 5 to 0 to introduce Ordinance No. 1246, which approves a proposal to rezone a 1.61 acre site, on the west side of South Higuera Street between Chumash Drive and Margarita Avenue, from C-S (Service- Commercial)to C-S MU(Service-Commercial Mixed-Use). The rezoning is being requested to accommodate construction of two new buildings on the site, both containing a mix of commercial and residential uses. Existing buildings would be demolished. If the City Council grants final passage to the rezoning request, the Architectural Review Commission will hold a public hearing to review final development plans. The ordinance determines that there will be no significant adverse environmental impacts as a result of amending the zoning map. The Council must vote again to approve the rezoning before it can take effect. That action is scheduled for September 21, 1993, at a regular meeting of the City Council to begin at 7:00 p.m. in the Council Chamber at City Hall, 990 Palm Street.
