BACKGROUND Situation The adopted General Plan Land Use Element identifies the Margarita area as a major new residential neighborhood. It says the area may be annexed and developed after a specific plan is adopted, and when water and sewer capacity are adequate for the annexed area in addition to existing and potential customers inside the City. (A specific plan shows the design and timing of land uses, roads, and public facilities in more detail than the General Plan, but not so precisely as subdivision maps or construction plans.) The draft Land Use Element update would increase the size and residential capacity of the Margarita planning area. It would also allow the area to be annexed before water and sewer capacity are adequate for development. However, a specific plan would still have to be adopted .before annexation. City water and sewer service would have to be adequate and available before development could proceed. For several years, City staff and a consultant representing property owners have been working on a draft specific plan for the area. Representatives: RRM Design Group; John Wallace & Associates Land Use Element map: adopted: conservation/open space; interim conservation/open space; rural industrial; medium-density residential ��� � ►�iIIII�IIP° �llll City Of San LUIS OBISPO snago COUNCIL AGENDA REPORT proposed: conservation/open space; interim open space; park; recreation; business park; medium-density residential Environmental status: focused EIR to be prepared, draft scope of work prepared Status of Margarita Area Specific Plan: application filed; conceptual land use plan completed Action deadline: none provided by state law Recently, Council has directed staff to proceed with the initial steps of annexing the entire Airport Area, which includes the Margarita area. Staff met recently with the Margarita area property owners and their representatives to discuss the City's program for annexing the Airport Area. After reviewing the pending program for City annexation of the Airport Area, the Margarita area property owners expressed a desire to have their property annexed to the City as a part of the Airport Area annexation. They indicated that they would send a letter to the Council expressing this desire. Annexing the Margarita area as a part of the Airport Area annexation may be necessary for the Airport Area annexation to proceed. The Margarita area is located between the existing City limits and the Airport Area. LAFCO's criteria for annexation direct that a leapfrog annexation of the Airport Area without including the Margarita area would be discouraged. Annexing the Margarita area as a part of the Airport Area would be the most efficient process for the City and the property owners. Many of the materials required to apply to LAFCO for annexation could be combined for the two areas. The Margarita area property owners would not need to prepare or have prepared separately items that could be shared with the larger group of Airport Area property owners. Both the Margarita and Airport Area property owners will experience some savings by being able to spread their planning costs out over more properties. The current requirement in the adopted and draft Land Use Element that a specific plan be approved prior to completion of an annexation poses a significant timing issue for both the Margarita and Dalidio expansion areas. The Council may wish to consider changing this policy to facilitate the Maragrita annexation. Alternatives for addressing this issue will be included in the November report. As a result of that meeting we have concluded that it would be best to have City submit our Rroperly to LAFCO for annexation on the same timeline as the airport area planning and annexation process, now in progress. We also request the council initiate an amendment to the General Plan L.U.E. that would allow the, c plan be adopted after annexation occurs and before construction wog begin: We would hope this could be done at the October 5, 1993 City Council meeting.
