CAO RECOMMENDATION: By Motion: 1) Reject All Bids for the Building Demolition Project at Emerson School; 2) Authorize the Readvertising of the Building Demolition Project at Emerson School and Contract Award by the CAO if the Lowest Responsible Bid is within the Engineer's Estimate; and 3) Secure the Building Site from Entrance if a Contract for Demolition is Further Significantly Delayed (e.g. beyond 60 days) , or if the Alternative to the Staff Recommendation is Chosen. DISCUSSION: On November 10, 1992, the Council authorized staff to hire an asbestos consultant to develop an asbestos abatement program and to then solicit bids for the demolition of Emerson School. In the past months the consultant has been hired, a work scope prepared, and the demolition project advertised. Bids for the demolition were opened on September 9, 1993 . The first and second low bidder did not comply with the requirements set forth in the specifications and the third low bidder was over the estimate. Staff feels the issues with the low bidder cannot be resolved without the City becoming involved in a legal battle, and is recommending all bids be rejected and the project readvertised. Staff will restructure the project Contract Documents to eliminate the situation which led to the disqualification of the low bidder. The issue that could not be resolved related to a requirement of OSHA that the contractors that handle asbestos-containing materials have a particular certification. The two low bid contractors bid to remove portions of the asbestos with certified subcontractors and remaining material with their own crews. They do not agree that they need to provide certification. Another issue that should be considered if the contract is delayed relates to the security of the buildings. Given the nature of the site and the existing buildings, securing them could be costly, and since demolition has always been anticipated, this has not been undertaken. However, if demolition is further delayed as a result of some future unanticipated problem, or if Council chooses to pursue the alternative:- to the CAO recommendation, then staff will take steps to invest in building security. The cost of any security system has not yet been identified, and depending upon the amount, could be an issue that would need to return to Council. MY Of San L--,S OBIS130 COUNCIL AGENDA REPORT CONCURRENCES: The Planning Department has completed an Initial Study of the Environmental Impacts for the construction and operation of the Fire Station. The demolition project has incorporated those mitigations which apply to that portion of the project, including haul routes and preservation of trees and other items. FISCAL IMPACT: The CIP for 1991/93 (page E-6) includes $2,350, 000 for the construction of the new fire station. The actual building demolition will be funded by this account. In the purchase agreement, $50, 000 of the purchase amount was set aside to cover the mitigation cost resulting from. the presence of hazardous materials that may be discovered. The asbestos removal and Asbestos Consultant will be funded by this account. Any funds remaining from the $50, 000 will be paid to the school district. The engineer's estimate for the project is . $80, 000. ALTERNATIVES: We anticipate presenting the Council with a recommended strategy for marketing this site at their November 16 meeting. Under the general I direction of the Assistant CAO and the Director of Finance, an interdepartmental task force has been formed composed of Linda Asprion (Revenue Manager, Finance) , Dave Elliott (Administrative Analyst, Public Works) , and Whitney Mcllvaine (Associate Planner, Community Development) . One of the Task Force's first responsibilities will be to prepare this marketing plan for Council consideration. Rather than proceeding with the demolition at this time, the Council could defer action on this item until the marketing plan is submitted to them on November 16. Although the City has received one unsolicited proposal for the purchase of this site that includes retaining the existing structures, we continue to believe that the marketability of this site in a competitive environment will be enhanced if the site is cleared of these structures. This belief has been confirmed through recent discussions with several local real estate professionals. Attached is a memorandum from the Fre Department which provides two alternative levels of security. With this information, I am now recommending that the Council direct staff to immediately pursue option #2, regardless of the demolition timeframe. TO: John Dunn, CAO FROM: Bob Neumann, Fire Chief DATE: October 1, 1993 SUBJECT: Security at Emerson School In light of further delays for the demolition of Emerson School, it is my recommendation that we install security fencing at the site. Two options are open to the city: 1) Fence the entire building perimeter with a 7' barred wire top chain link fence. Approximate cost - $8,000. 2) Fence the open building ends with a 7' barbed wire top so as to restrict access to the courtyard area of the building. It is my recommendation that we move forward with Option #2. We typically do not suffer vandalism and forced entry problems along the outside exposure of the building. These areas are visible and to some degree illuminated. Funding for Option #2 is available in the current budget. Option #1 would require a special budget action. RFN:vrd M«TING GENDA L. I have been asked to coordinate a Mayor's Task Force for a Safer Community with Don Green and provide the attached for your information. Mr. Green intends to be in touch with all Council Members prior to the October 5th Council meeting to further describe some of his ideas. This is intended to be a community task force rather than an official city endeavor, and most members will be non-government officials (for example,Jeff Fairbanks and Maggie Cox will serve). However, it is requested that one person from the Police, Recreation, and Community Development Departments be allowed to serve on the task force, given their expertise and involvement in the entire issue. I am asking that the City Council endorse their participation, which will involve attending meetings and sharing ideas, but not providing administrative staff support. Such support will be provided by other community volunteers. I will work with the CAO to determine who would be the most appropriate staff members. Goal: To coordinate the community's approach to public safety. Tasks: 1 ) Draft a multi-part "community code", providing voluntary . guidelines for community members in their role as: business persons; parents,:;students and members of public and private agencies 2) Provide methods for community members to implement each of the sections of the "community code". (Example: Lf a line from the "Community code" reads - "Each parent i s encouraged to.COMM it' some.amount:of time to spend with their child in a public service activity.'., Then the task force will find a way to make available a list of existing activities and/or initiate new activities.) 3) Provide,one;'or more education forums on 'Developing Our Sense of Community', featuring successful programs from within California:. Goal: To make our kids "resilient" - no-longer at risk. Tasks: 1 ) Provide stable positive role models for kids by training parents and making available parental 'surrogates'. 2) Provide access..td and support for all community activities, both public service and recreational, that promote self-worth. 3) Promote recognitlon of positive actions within the community. Note: The task--force is an effort to meet the recognition that law enforcement and the educational system cannot overcome the weight of public attitudes and public actions. They work very hard to do the tasks that we say we want done. Even with unlimited funds they couldn't operate as if they were in a vacuum. It is up to private citizens to lead by example, not by criticism.
