SUBJECT: Request to expand and modify existing preferential parking district.
CAO RECOMMENDATION:
A) Adopt by resolution, expansion of preferential parking district to conform with Exhibit A to
include Fredericks Street and staff recommended modifications.
B) By motion, deny request to expand hours of parking restriction, 2:00 A.M. to 6:00 A.M.; to limit
new permits to only those who currently reside in the district; to make further changes to parking
regulations to provide special permits for those without off-street parking.
BACKGROUND
In 1979 a preferential parking district was established in the residential area south of the Cal Poly
campus (boundaries as shown in Exhibit D). The parking district established a residential permit
parking system during daylight hours (8:00 A.M. to 5:00 P.M.), Monday through Friday. The current
district rules prohibit parking on the streets by non-permitted cars. Residents may obtain a permit
for each vehicle registered at the address for a small fee. In addition each resident may obtain 2
guest parking permits.
Council received a request to modify the parameters of that District on May 11, 1993. The request
(Exhibit.B) is proposed by Residents for Quality Neighborhoods (RQN). The expanded area is
shown on Exhibit C and the final Proposed District on Exhibit A.
The request proposes:
■ to prohibit cars without a valid permit from parking on streets throughout the entire district
between 2:00 A.M. and 6:00 AM.;
■ to expand the existing parking district to include portions of Fredericks Street (Grand Avenue
west to 1400 Fredericks);
■ to allow all current residents to obtain permits during the first 60 days after the district is
modified and to only renew permits obtained during that time and only to the original permittee.
■ to make available 4 day nonresident guest placards for the current fee.
■ allow special need parking to occur by arrangement. This would include older properties that
do not meet current standards for off-street parking and live-in health care workers if adequate
off-street parking is not available.
■ enforcement by complaint or random patrol.

The stated goal of the RQN is to discourage parking after 2:00 A.M., however the apparent result
would be to discourage the change of the neighborhood from owner-occupied residents to rentals.
The proposal discourages the use of the homes as rentals by limiting parking to only off-street spaces
whenever the occupants change. The RQN is also interested in enforcing zoning regulations which
prohibit parking on lawns in set back areas.
The Parking Management Plan (PMP) (Exhibit E) and the parking district's enabling ordinance
(MC) (Exhibit F) establish criteria by which new districts can be formed and existing districts !
modified. Staff used this criteria and developed guidelines for the development of districts. The
guidelines include a procedure (Exhibit G) for requesting formation of, or changes to, a district 1
including the appropriate techniques for collecting majority support (more than 50%) of the property
owners in a proposed district. The subject request has such a petition. The applicant's
representatives, Henry Case and Tom Kay, will be presenting a larger petition at the City Council
meeting. Staff has been told that the petition contains signatures representing more that half of all 1
the residents in the district, and more than half of all the residents that would be brought into the
district. The portion of the petition which staff has received is on file in the City Clerk's office. It
represents the signatures of 126 individuals representing 73 residential properties out of a potential
of 185 properties.
DISCUSSION
i
District Expansion:
The request asks to expand the district to include both sides of Fredericks Street. The only
implication is the need to install more new signs. Residents in the expanded area did sign the
petition. The two churches included in the district would not normally be impacted, as the
regulations are not in effect during weekends or early mornings. Eleven of 23 properties benefitting
from the addition of Fredericks Street have signed the initial petition. Expansion of the current
district is not a problem. If Council wishes to expand .the district it can do so by adopting a
resolution.

Additional Restricted Hours:
The request also-asks for the prohibition of parking between the hours of 2:00 A.M. and 6:00 A.M.
Monday through Friday. This request does not appear to fall within the guidelines established for
preferential parking districts. Prior to implementing this portion of the petition the Parking Policy
and Municipal Code would need to be revised. In addition, the Police Department would have
primary responsibility for enforcement of this proposed regulation. However,because of limited staff
available during those particular hours and other high priorities, the Police Department has indicated
they will not be able to give the parking prohibition significant attention. The Public Works
Department does not have staff available at that time of night to enforce any parking regulations.
Therefore, this provision would normally only be enforced on a complaint basis. The petitioners
understand this and are willing to accept the fact that aggressive enforcement may not be possible.

Private Property Restrictions:
Another portion of the request asks for parking restrictions on private property. The existing parking
district includes properties exclusively zoned residential, either R-1 or R-2. In both zones, the
minimum requirement for the street yard setback is 20 feet, measured from the front property line.
Structures and required parking spaces are already prohibited from being located within the required
street yards unless an exception is approved. Access to areas for required parking is permitted in
a street yard, which in an R-1 zone generally consists of a driveway approximately 20 feet in width
serving a two-car garage. Additional paving of properties for parking that is visible from the street
would only be permitted if the area was outside of the street yard (i.e. more than 20 feet back from
the front property line). Enforcement of parking restrictions in the set back area by the Community
Development Department is difficult under the terms of our current ordinances, and will be
addressed more fully in the proposed.Property Maintenance Ordinance. Therefore, existing zoning
regulations do address the creation of formal parking spaces in street yards.
Existing vs. New Residents:
The most significant issue in the petition is the limitation on the number of permits that may be
issued. In essence, it requests that all current residents be given 60 days to apply for permits 'for
each vehicle they own, keep at the residence, and wish to park on the street. After 60 days no new
permits would be issued. ever. The issued permits would only be renewed to the current resident.
Should the resident move or fail to renew the permit, it would be voided. It is assumed that
replacement vehicles would be permitted, but additional vehicles would not (although the issue is
not addressed). New residents, whether owners or renters could not obtain a permit.
The limitation on future residents may raise potential legal or fairness questions. It is not
compatible with the current Parking Policy or Municipal Code. Under both of these documents all
residents of the area are treated equally. At some point in time there will be more new residents
than old, with significant portions of the district void of parked cars. Assuming the new property
owners do not agree with the restriction they will most likely petition for relief.
Proponents of the change feel there is precedence for the restriction on future residents referencing
Proposition 13, property tax, and zoning changes which affect only new applications.
Parking Permits:
The petition proposes a 4-day placard. The current provision of two guest parking permits per
residential property appears to work satisfactorily. However, special parking for live-in health care
workers would be handled using the existing visitor permit system. Guest permits or resident
permits, if the healthcare worker is truly living in full time, would be used for health care workers.
Special Circumstances:
The issue of providing parking permits for those properties that do not have sufficient off-street
parking is more difficult to address. Special guidelines and standards would need to be developed
identifying what constituted special circumstances and a unique parking problem that could be easily
administered. Most properties have at least some off-street parking, although perhaps not to the

current standard, i.e. number of spaces or covered. Some off-street spaces, due to building
modifications, are not available for off-street parking.
Other Issues•
In addition to the requests in the petition, staff notes that the original district was set up with a map
showing the boundaries of the district and the rules which allowed residents of R-1 property (whose
street frontage was in the district, but not the property itself) to buy a permit. This has led to some
confusion in administration of the District since 1979. If the district boundaries are to be changed,
staff recommends that the district boundaries be modified to include all streets that have parking
restrictions and the lots containing residents that are eligible to buy permits.
FISCAL IMPACT
There is a small fiscal impact that will result from approving this request. First, all the signs in the
current district would need to be replaced if the hours of operation are changed. Second, new signs
and posts would need to be installed in the expanded area. Third, the city would have to go through
a process of issuing new permits. Current permits were issued in September. There is an implied
additional cost to expand the enforcement of the restrictions during the early morning hours. This
may not be a significant additional cost if it is of a low priority and only occurs on a complaint basis
and on an availability basis. No new resources would be involved.
Estimated costs:
New signs in current district $1700
Additional signs in expanded district $1900
ALTERNATIVES
Alternative 1 - Do nothing. The existing district works well and accomplishes what it was originally
intended to do. Residents and visitors of residents in the neighborhood can park on the street.
Overflow parking from the adjacent campus during the hours designated no longer is impacting this
neighborhood. All residents, owners or renters, have an equal opportunity to park on or off the
street. This alternative is consistent with the Parking Management Plan (PMP) policy which says
that "Special Parking Districts should be established as necessary, in residential areas which are
congested with vehicles parked by persons not residing in the area, to restrict parking to preserve
the quality of life of area residents." The Municipal Code (MC) also sets guidelines for the
establishment of parking districts in section 10.36.170. It requires a finding that the parking problem
relates to non residents.
Alternative 2 - Add the 1400, 1500, 1600 and 1700 blocks of Fredericks Drive to the district. Slightly
less than 50% of the residents have signed the initial petition. More may sign the petition that the
RQN is bringing to the Council Meeting. If this alternative is pursued, all the residents in the
affected area should be noticed and given an opportunity to speak at a public hearing prior to
adoption. This alternative is also consistent with the PMP policy and the MC and is the staff
recommendation.

Alternative 3 - Add the new hours of parking restriction requested. This will initiallymake little
change in the existing situation. This alternative is inconsistent with the PMP policy and MC in that
no finding can be made that non-residents are impacting the area between 2:00 A.M. and 6:00 A.M.
weekdays.
Alternative 4 - Restrict the issuance of permits to new residents or those who do not obtain one
during a 60-day period of time as requested by RQN. Over a period of time fewer cars will be
parked on the street as the current residents leave the area and new ones move in. This alternative
is inconsistent with the PMP policy and MC.
If the Council wishes to proceed with either Alternate 3 or 4, it should direct staff to return with
recommended change to the Parking Management Plan, the Municipal Code, and appropriate
ordinances.
CONCURRENCES
The Police Department concurs that it does not have sufficient manpower necessary to regularly
enforce the expanded hours of the parking district effectively, and that it would provide enforcement
on an availability basis. The Community Development Department concurs that existing regulations
are in place to regulate parking in street yards. The City Attorney concurs that potentially significant
legal issues may be raised by the disparate treatment of current residents vs. future residents.

ESTABLISHING AN AREA OF THE CITY AS A RESIDENTIAL PARKING
PERMIT AREA, ESTABLISHING DAYS AND HOURS OF OPERATION OF
SAID AREA AND SETTING FEES FOR APPLICATION FOR A PARKING PERMIT
WHEREAS, the Council of the City of San Luis Obispo has received
a petition from a majority of the residents living within the
neighborhood shown on "Exhibit "A" , and,
WHEREAS, the Council of the City of San Luis Obispo has
determined that the quality of life for the residents of this area
has been adversely affected by non-residents using the neighborhood
streets for parking and,
WHEREAS, the Council of the City of San Luis Obispo has
determined that the elimination of non-resident parked cars from
the district will decrease the ambient noise level, lower air
pollution levels, and improve other environmental characteristics
of the neighborhood and,
WHEREAS, the Council of the City of San Luis Obispo has
determined that the elimination of the non-resident parked cars
will improve pedestrian and vehicular safety and allow residents to
gain proper access to their residences and,
WHEREAS, the Council of the City of San Luis Obispo has
determined that there is appropriate alternative parking for non-
resident cars on the Cal Poly Campus, and
WHEREAS, the Council has previously established a Residential
Parking Permit District within the neighborhood,
BE IT RESOLVED by the Council of the City of San Luis Obispo as

SECTION 1. Pursuant to Section 10.36. 170 et seq. of the San
Luis Obispo Municipal Code the residential parking permit area
established by Resolution No. 3932 (1979 Series) is enlarged to
include all areas shown on the attached Exhibit "A" .
SECTION 2. No vehicle other than vehicles providing services to
the area or having a permit attached to it or a visitor's permit in
the driver's side window may park on any street in the area between
the hours of 8: 00 A.M. and 5:00 P.M. , Monday through Friday, except
for holidays.
SECTION 3 . The Public Works Department is directed to post the
area with signs that clearly indicate these restrictions.
SECTION 4. The Public Works Director shall issue residential
parking permits and guest parking permits on demand as permitted in
Section 10.36. 210 and 10.36.220 of the Municipal Code. Permits
shall be issued for a year beginning September 16 and shall be
prorated if issued during the year.
SECTION 5. Fee for each residential permit shall be $5. 00.
SECTION 6. Fee for guest parking permits shall be $5. 00. Guest
permits shall be issued annually as are residential parking
permits.
SECTION 7. Fee for replacement of mutilated or lost permits
shall be $5. 00.
SECTION 8. Residential parking permits shall become void if
either the owner of the vehicle moves out of the area shown on
Exhibit "A" or the owner of the vehicle sells the vehicle to an
individual living outside the area shown in Exhibit "A" .

PROPOSED R-1 STREET PARKING DISTRICT REVISION
AMENDMENT TO THE
PARKING ORDINANCE OF THE CITY OF SAN LUIS OBISPO
In recent years there has been a marked increase in the numbers of automobiles stored on
R-1 zone residential streets in the city.
Residential streets have been designed, built and intended to support local traffic and
incidental, as opposed to permanent, parking for visitors and residents.
Of particular interest is the existing preferential parking district roughly bounded by Slack
Street, Grand Avenue, Fredericks Street, Longview Lane, Bond Street and Hathway
Street. This parking district is characterized by curved streets with restricted visibility
causing concern for children, pedestrians and bike riders. Many streets are very narrow
and some have no curbs. Multiple parked vehicles restricts space for passing of vehicles
traveling in opposite directions and for emergency vehicles.
To mitigate this problem we propose that the parking district be amended such that
parking between 2 AM and 6 AM and between 8 AM and 5 PM, Monday through Friday
would be allowed by permit only. All other hours no permit would be required.
• During the two months after the effective date of the ordinance, all residents
could obtain permits for street parking of their vehicles for the current fee .
Thereafter, only renewal of previous permits would be issued. This would
provide for a gradual phase in so as not to create a hardship.
• Four day nonresident guest placards would be available for the current fee.
This would be a continuation of the present practice, except the same
placard would be used day or night.
• Special need parking would be available by arrangement. This would
include older properties that do not meet current standards for off street
parking and live in health care workers if adequate off street parking is not
available.
• Enforcement by complaint or random patrol.

The Parking Management Plan and Municipal Code Sections 10.36. 170-190
provide guidance to staff as to how and when preferential parking areas
should be established.
1: Preferential Parking districts should be established when necessary, in
residential areas congested by parked vehicles owned by non residents.
2. Preferential Parking districts should be established to preserve the
quality of life of area residents.
3. Preferential Parking districts can be initiated by residents, staff or
council .
4. Council must consider the effect of non resident parked vehicles. on
ambient noise levels, air pollution, pedestrian and vehicle safety and the
burden on persons residing in the area in gaining access to their
residences.
Staff interpretation of these guidelines is as follows;
1 . Preferential Parking districts should only be considered for
residential areas where the residents want them.
Determination of the desire to have a district should be established
by the passing of a petition which describes the district and the type of

3. Staff will activily assist residents prepare the petition to assure
that it is clear and reasonable.
4. Staff will support districts that have reasonable boundaries. They
should not be so small that the problem is moved from one block to the
next. The parking restriction should be easy to enforce. The district

5. Other solutions should be explored.
S. After receipt of a petition staff will study the area and vdrify that
the problem exists and would be solved with the establishment of a
district.
7. Staff will meet with the neighborhood petitioning for a district and
attempt to work out a mutually agreable district.
S. Staff will schedule a public hearing before the Council to take
testimony and assist Council in making a decision as to the formation of a
district.
9. If a district is formed Staff will sign the district as required and
enforce the district restrictions as required on a complaint basis.

A RESOLUTION OF THE. COUNCIL OF THE CITY OF SAN LUIS OBISPO
ESTABLISHING AN AREA OF THE CITY AS A RESIDENTIAL PARKING
PERMIT AREA, ESTABLISHING DAYS AND HOURS OF OPERATION OF
SAID AREA, SETTING FEES FOR APPLICATION AND TIME OF RENEWAL
FOR A PARKING PERMIT, AND RESCINDING RESOLUTION NO. 7008
WHEREAS, the Council of the City of San Luis Obispo has received
a petition from a majority of the residents living within the
neighborhood shown on "Exhibit "A", and
WHEREAS, the Council of the City of San Luis Obispo has
determined that the quality of life for the residents of this area
has been adversely affected by non-residents using the neighborhood
streets for parking, and
WHEREAS, the Council of the City of San Luis Obispo has
determined that the elimination of non-resident parked cars from
the district will decrease the ambient noise level, lower air
pollution levels, and improve other environmental characteristics
of the neighborhood, and
WHEREAS, the Council of the City of San Luis Obispo has
determined that the elimination of the non-resident parked cars
will improve pedestrian and vehicular safety and allow residents to
gain proper access to their residences, and
WHEREAS, the Council of the City of San Luis Obispo has
determined that there is appropriate alternative parking for non-
resident cars on the Cal Poly Campus, and
WHEREAS, the Council has previously established a Residential

BE IT RESOLVED by the Council of the City of San Luis Obispo as
follows:
SECTION 1. Pursuant to Section 10. 36. 170 et seq. of the San
Luis Obispo Municipal Code the residential parking permit area
originally established by Resolution No. 3932 (1979 Series) and•
revised by Resolution No. 7008 (1991 Series) is enlarged to include
all areas shown on the attached. Exhibit "A" .
SECTION 2. No vehicle other than vehicles providing services to
the area or having a permit attached to it or a visitor's permit in
the driver's side window may park on any street in the area between
the hours of 8: 00 A.M. and 5: 00 P.M. , Monday through Friday, except
for holidays honored by the City of San Luis Obispo. .
SECTION 3 . The Public Works Department is directed to post the
area with signs that clearly indicate these restrictions.
SECTION 4 . The Public Works Director shall issue residential
parking permits and guest parking permits on demand as permitted in
Section 10. 36. 210 and 10. 36. 220 of the Municipal Code. Permits
shall be issued for a year beginning September 16 and shall not be
prorated if issued during the year.
SECTION 5: Fee for each residential permit shall be $5. 00.
SECTION 6. Fee for each guest parking permit shall be $5. 00.
Guest permits shall be issued annually as are residential parking
permits. , Guest permits shall only be valid on the block for which
they are issued.
SECTION 7. Fee for replacement of mutilated, lost, or stolen
permits shall be $5.00. Guest permits shall not be replaced.

SECTION 8. Residential parking permits shall become void if
either the owner of the vehicle moves out of the area shown on
Exhibit "A" or the owner of the vehicle sells the vehicle to an
individual living outside the area shown in Exhibit "A".
SECTION 9 . Enforcement on streets added to the current district
will not begin until February 1, 1994 .
SECTION 10. Resolution No. 7008 (1991 Series) is hereby
rescinded.

Dear City Council Members, MILIE
Because of previous committments, we are unable to attend the
council meeting Tuesday evening and express our views on the
proposed extension of the parking district around the university.
We hope this letter will be added to those voices in favor of the
proposal .
. We have resided on Longview for over six years and intend to
stay in our present home for years to come, so we are naturally
interested in preserving the quality of our neighborhood. Having
so many cars parked on both sides of the street is a problem for
several reasons. First, they restrict visibility on these narrow
streets which were intended to serve quiet neighborhoods. Our
living area windows overlook Longview and Bond St. and we have
witnessed accidents and near-accidents frequently over the years.
Also, streets lined with cars all day and night make maintenance
either difficult or impossible. The mess on Slack St. is a vivid
example--trash, dirt, leaves, dog messes everywhere. Even our end
of Longview is rarely properly swept because of the cars. Thirdly,
the proliferation of cars obliterates the city-lead idea of having
quiet, well-kept residential areas. We, as permanent residents
.and taxpayers, are tired of sitting back and letting street after
street, neighborhood after neighborhood,
become undesirable eyesores.
Not only does this trend make day to day living more difficult, it
also lowers our property values!
We are committed to not parking on our street, even though we
must juggle - cars often, because we feel we are detracting from our
neighborhood by doing so. Please pass this very fair proposal and
return the neighborhood to the neighbors.

Dear Sirs :
My husband and I own a single residence student
rental at 252 Albert Drive in San Luis . We
purchased the property in 1992 with the intention
of moving to San Luis in the near future when my
husband will retire from his medical practice in
Lompoc.
We like the quality of the neighborhood where we
purchased our house and look forward to its being
restored to it former status as a primarily single
family residential neighborhood.
Although the number of cars on the street is reduced
and improving, we still notice quite a few cars ,
which, as we all know, unfortunately tends to indicate
an area in need of improvement , primarily because of
under-maintained rental residences . Since limiting
parking has an impact on restricting the number of
occupants of a--dwelling;-_we .are -asking that our
neighborhood be included in the restricted parking
area.

idiotic parking ordinances- that are the whims of a
few. We live on Albert Dr. . in the center ± If the

Dear Council Members.:
I am writing to raise some qustions and to make some observations regarding
the request to expand and modify the existing preferential parking
district in the residential area south of the Cal Poly campus. Unfortunately,
I am unable to attend your meeting. I know that you will give my letter
your thoughtful attention.
As the owner and resident of my home on Slack Street I have a personal
concern for the quality of life and safety in our neighborhood. I also
have a concern for fair and equable treatment for each person in our
neighborhood, those of us now here and those who will be our neighbors
in the future.
I want you to know that the preferential parking regulations,as it now
exists on our street, serves our needs very well. I can understand the
need of other residential streets to adopt the same plan. This plan
recognizes that between 8 AM and 5 PM on Monday thru Friday there are
nonresidents who would take parking away from the residents of our
neighborhood. After 5 PM on weekdays and on most weekends there is seldom
a parking problem.
My understanding is that, under the proposed parking revision, all current
residents could obtain permits for street parking. Thereafter, only
renewal of previous permits would be issued. Future residents of our
neighborhood would not be able to park on their own street between 2 AM
and 5 PM on weekdays. It certainly does put a new onus on the word
"preferential".
I ask the City Council, is this the kind of city you want to design for
the present and the future ? I realize that double standards are so
pervasive in our society. Does it really have to come home with us ?
How would you feel living in a neighborhood where you can not park on
your own street while your neighbor can ? What kind of livability,
what kind of harmony and security are engendered by such an arrangement ?
I raise these questions for myself and on behalf of all those future
neighbors who have no voice and no vote here and now. What you decide will
severely impact our lives and our neighborly relationships for years to come.
