CAO RECOMMENDATION: Adopt resolutions supporting the following transportation enhancement projects: Phase I: Railroad Bicycle Path Garden Street Pedestrian Bicycle Project Downtown Bicycle Parking Program Phase II: Railroad Bicycle Path I. BACKGROUND A. Previous TEA Grant Applications. In 1992, the City Council authorized staff to submit grant applications to SLOCOG for the following enhancement projects: Phase I Railroad Bicycle Path (Acquisition and Construction) Railroad Water Tower Rehabilitation Downtown Bicycle Parking Program Rubberized Railroad Crossing Improvements The City was not successful in receiving federal funding as part of the first funding cycle of the TEA program. B. Current TEA Grant Applications. In August, 1993, the Public Works Staff submitted six applications for the next funding cycle. There is about 2 million available to support TEA projects throughout the County. The City's grant applications included: 1. Phase I Railroad Bicycle Path Construction: The original application was modified to include only the costs of construction. Land acquisition will utilize local funding consistent with the City budget. 2. Railroad Water Tower Rehabilitation: This application remains unchanged. The resolution adopted by the City Council in 1992 is still in effect and no additional action is required by the Council. 3. Downtown Bicycle Parking Program: This application also was unchanged but a clarification of the State guidelines indicates that a 20% local match (as compared with a 12% match for other TEA projects) is required for bicycle and pedestrian projects. The City budget anticipated that this project be funded using State Highway Account (SHA) funding which covers 100% of the cost. The City's application to SLOCOG for use of regional SHA funding was not successful. Therefore, staff submitted a TEA grant application which has a 20% local funding match requirement. Staff will be evaluating other public and private funding sources to cover the match requirement, including participation from area merchants and business organizations. 5. Phase H Railroad Bicycle Path Acquisition and Construction. The segment • of the railroad bike path would run between Bushnell Street and Jennifer Street and link the Phase I segment of the path with the pedestrian/bicycle bridge at Jennifer. (Note: the bridge project is fully funded through a Proposition 116 grant.) 6. Rubberized Railroad Grade Crossing Improvements: This application was unchanged but a clarification of the State guidelines indicates that a 20% local match (as compared with a 12% match for other TEA projects) is required for bicycle and pedestrian projects. (A copy of each grant application is available in the Council Office for inspection by Council members.) C. SLOCOG Action on TEA Grant Applications. On October 6, 1993, the SLOCOG Board met to review and rank all TEA Grant applications. Eighteen projects were considered. The Board supported the ranking as recommended by their Staff. Projects 1 through 15 fall within the $2 million "bid target'.' established by the State. Projects 16 through 18 significantly exceed the bid target and therefore will not be considered by the State for this funding cycle. The City's projects ranked as follows: Phase I Railroad Bicycle Path 6th Historic Railroad Water Tower Rehabilitation 9th Garden Street Pedestrian Improvements 11th Downtown Bicycle Parking Program 14th Phase II Railroad Bicycle Path 15th Railroad Rubberized Grade Crossing Program 17th The first five City projects shown above have received support from the SLOCOG Board and will be forwarded to the State with a recommendation for funding. The sixth project (ranked 17th) will not be considered for funding by the State unless other projects drop out of the program or more money becomes available. C-lv-z. �����►�►�N►�IIIIIIgIi 818111 MY Of San La1S OBISpo COUNCIL. AGENDA REPORT SLOCOG's action on October 6th represented a preliminary approval of the project ranking. All agencies are required to submit resolutions approved by the legislative bodies that support the projects including funding matches. It should be noted that SLOCOG supported the Garden Street project at a lower funding level than requested by the City ($215,000 v. $265,000). The difference represents the elimination of costs for mission style sidewalk and tile along Garden Street. The SLOCOG Board is scheduled to take a final action on the projects at its meeting on November 3. D. State Action on Recommended TEA Applications. SLOCOG's ranking will be forwarded to the California Transportation Commission (CTC). The CTC is scheduled to approve a final project listing in April, 1994. The State is not required to fund all projects recommended by SLOCOG. In the last funding cycle, two of the four projects submitted by SLOCOG actually received state funding. City staff believes that the first three City projects listed above have a reasonably good change in receiving State funding approval. II. Staff's refined estimate of actual match requirements is$44,000. 11114111%1111U1110►���d��l City of san Luis 0131 SPO i COUNCIL AGENDA REPORT Of the projects listed above, the local funding match requirements for Phase I Bike Path Construction ($70,000) and Garden Street Improvements ($43,000)are not accounted for within the City's adopted 2-year budget. However, the budget did earmark $26,000 of Capital Outlay funds to support the Rubberized Grade Crossing project that is not recommended for approval by SLOCOG. Therefore, if all of these projects are approved by the State, the City must allocate $87,000 of its general fund balances ($70K + $43K - $26K = $87K) to fully fund all of these projects. RECOMW NDED ACTION The City Council should approved the attached resolutions supporting the five TEA grant project previously listed. ATTACE31ENTS City Council Resolutions RESOLUTION NO. (1993 Series) A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO APPROVING THE APPLICATION FOR FUNDS FOR THE TRANSPORTATION ENHANCEMENT ACTIVITIES PROGRAM UNDER THE INTERMODAL SURFACE TRANSPORTATION EFFICIENCY ACT OF 1991 FOR THE PHASE I RAILROAD BICYCLE PATH WHEREAS, the United States Congress has enacted the Intermodal Surface Transportation Efficiency Act of 1991, which is intended to provide over$200 million in federal dollars over a 6 year period as matching funds to local, state and federal agencies and non-profit entities for transportation enhancement activities, and WHEREAS, the Department of Transportation has established the procedures and criteria for reviewing proposals and is required to submit to the California Transportation Commission a list of recommended projects from which the recipients will be selected; and WHEREAS, said procedures and criteria established by the California Department of Transportation resolution certifying the approval of application by the applicants governing body before submission of said application to the California Transportation Commission and the State of California; and WHEREAS, the application contains assurances that the applicant must comply with; and WHEREAS, the applicant, if selected, will enter into an agreement with the State of California to carry out the transportation enhancement activities project. NOW THEREFORE BE IT RESOLVED BY the Council of the City of San Luis Obispo, California the following: 1. Approves the filing of an application for the Transportation Enhancement Activities Program for consideration of funding. 2. Estimates that the total cost of the project is $350,000. The City will commit to using local fund to support 20% of the total project cost. 3. Certifies that the City of San Luis Obispo will make adequate provisions for the operation and maintenance of the project. 4. Appoints John Dunn, City Administrative Officer as agent of the City of San Luis Obispo to conduct all negotiations, execute and submit all documents, including but not limited to application, agreements, amendments, payment requests and so on, which may be necessary for the completion of the aforementioned project.
