RECOMMENDATION :
As recommended by the Cultural Heritage Committee (CHC), adopt a resolution adding th e
property located at 868 Upham Street to the Master List of Historic Resources .
DISCUSSION
Previous Review
OnJuly 25, 2011, the CHC reviewed the applicant's request to add the property located at 86 8
Upham to the Master List of Historic Resources . The CHC found the property eligible for th e
Master List of Historic Resources based on several criteria of the Historic Preservation Progra m
Ordinance, and recommended the Council add the property to the Master List as the histori c
"Harry E . Lyman House ."
During Council review on September 6, 2011, concerns were raised in public comment tha t
previous building alterations were significant enough to preclude its inclusion in the Master Lis t
of Historic Resources . It was noted that the front porch had been enclosed and the window on th e
upper gable facing the street had been modified. The Council referred the project back to the
CHC to consider whether the modifications to the structure compromised the integrity findin g
(Attachment 2, City Council meeting minutes), thus compromising the structure's eligibility fo r
the Master List .
On October 24, 2011, the CHC re-evaluated the structure's integrity per Council direction . Staff
provided additional details regarding the National Register's seven aspects, or qualities, whic h
should be used to recognize a property's integrity (Attachment 3, October 24, 2011, CHC Staf f
Report). After reviewing the project and information, the CHC found the porch enclosure an d
upper gable window modification did not impact the structure's ability to convey its histori c
significance . It was discussed that the porch enclosure and window modification occurred earl y
in the building's history, and the enclosure likely occurred while the Lymans lived in th e
structure . The window modification on the upper gable facing the street was discussed in mor e
detail, and one committee member presented pictures of various Craftsman Bungalow home s
with upper windows similar to the upper level windows at 868 Upham Street (Attachment 4 ,
October 24, 2011, CHC Minutes). Staff evaluation of the window modification include d
discussion that the windows on the upper level gable are consistent with the Craftsman style and

are not out of character with other structures of the era . The CHC also discussed that change s
from the initial construction should not necessarily disqualify a building from being recognize d
as historically significant and can serve as a record for how the building was used over time . The
CHC voted 4 :1 to recommend the City Council add the property to the Master List of Histori c
Resources . Committee member Costello cast the dissenting vote because the motion did no t
include a condition to return the window on the upper gable to the same configuration as th e
initial construction . The resolution adopted by the CHC includes additional findings pertainin g
to integrity of the structure and establishes the timeframe of significance for the structur e
between finished construction in 1913 to the date of Harry E . Lyman's death in 1931 (CH C
Resolution recommending addition to the Master List, Attachment 6).
CONCLUSIO N
As discussed in detail in the attached CHC staff report, the structure at 868 Upham Stree t
demonstrates excellent overall integrity with nearly all original building features intact-inside an d
out . The porch enclosure occurred early in the building's history while the Lymans lived in th e
house and may have even been constructed by Harry Lyman himself The porch enclosure wor k
represents quality craftsmanship and blends with the architectural style and details of the house .
The original wall and windows still remain inside the porch enclosure . In addition to findings o f
integrity, the property is also recommended for listing based on three architectural criteri a
(Architecture Criteria : Style, Design, and Architect).
The building is an example of a finer Craftsman Style Home with eclectic features and exhibit s
notable attractiveness because of artistic merit, details, and craftsmanship . Harry E . Lyman made
significant contributions to San Luis Obispo by constructing many of the finer historic homes i n
the City of San Luis Obispo and several of the homes he constructed are currently on the Maste r
List of Historic Resources . He also constructed many other homes in the Old Town Histori c
District and in the Upham Street neighborhood area (Attachment 5, July 25, 2011, CHC staff
report). The physical features of the building convey the property's historic character and expres s
the historic importance of the original owner and builder . The addition of 868 Upham Street t o
the City's Master List of Historic Resources would assure the long-term preservation of thi s
important historic resource of San Luis Obispo .
FISCAL IMPAC T
Adding the property to the Master List will have no fiscal impact on the City .
If the property is added to the Master List, the applicants will have the ability to apply for a Mill s
Act Historic Preservation Contract . To qualify for the Mills Act program, the property must be
on the Master List of Historic Resources . Mills Act contracts require an application and fee o f
$3,691, commitment to specific improvements, and/or maintenance of the property, review b y
the CHC, and final approval by the City Council . Fiscal impact analysis is included in the
Council agenda reports for Mills Act contracts .

BACKGROUN D
On July 25, 2011, The CHC recommended the City Council nominate the property at 868 Upha m
Street to the Master List of Historic Resources with the Historic name : Harry E . Lyman House .
On September 6,2011, the City Council received public testimony that questioned whether th e
changes made to the building were significant enough to prevent its inclusion on the Master Lis t
of Historic Resources ; specifically, that the front porch had been enclosed and that the windo w
on the upper gable facing the street had been modified . The Council voted to refer the projec t
back to the CHC to consider whether these changes could remain and still make the finding o f
Integrity (Attachment 2, City Council meeting minutes).
DISCUSSION
Previous Cultural Heritage Committee meetin g
On July 25, 2011, the CHC found the property was eligible for the Master List of Histori c
Resources based on several criteria, including the Integrity criteria (for more detail see July 25 ,
2011, CHC Staff Report Attachment 3). At the CHC meeting, one public speaker raised concern s
the building did not have adequate integrity to support master listing due to the porch enclosur e
and modification of a window on the upper gable facing the street . The CHC discussed th e
modifications and two other structures on the property (CHC meeting minutes, Attachment 4).
The CHC found the modifications did not impact the historic significance of the property an d
recommended the Council add the property to the Master List of Historic Resources based on th e
criteria recommended by staff.
The CHC also added a condition of approval that any proposed application for a Mills Ac t
Contract shall include separate evaluation of the structures on the property and backgroun d
information on the enclosed porch (Attachment 5, Resolution No . CHC 1006-11). The intent o f

the CHC's action was that if either or both of the two accessory structures were to be propose d
for coverage under a Mills Act contract, their inclusion would have to be justified through a
subsequent request to include them on the Master List of Historic Resources and the Mills Ac t
review process as important historical features of the property . While the Master List designatio n
affects the property, the resource being designated at this time is the house only. If significan t
modifications or demolitions were proposed to the two accessory structures, the proposal woul d
have to be evaluated for consistency with a designated resource on the property .
EVALUATIO N
Evaluation of Integrity
Integrity is one of the key components that may be utilized to determine whether a property may
be eligible for listing . The National Register traditionally recognizes a property's integrit y
through seven aspects or qualities : location, design, setting, materials, workmanship, feeling, an d
association . These seven aspects or qualities, in various combinations, define integrity . To retain
integrity, a property will possess several, and usually most, of the aspects .
Location is the place where the historic property was constructed or the place where the histori c
event occurred . The location of a historic property, complemented by its setting, is important in
recapturing the sense of historic events and persons. A property can have integrity even if th e
resouece was moved before or during its period of significance .
Staff Analysis :.The location and setting of the building is intact and the building has never bee n
moved . The property is complemented by its setting since many of the residences built by Harr y
E . Lyman in the area maintain their association with the property and recapture the sense o f
historic events and persons . The porch enclosure and window modification do not impact thi s
criterion.
Design is the composition of elements that constitute the form, plan,space,structure, and style of
a property. All properties change through time. It is not necessary for a property to retain all of it s
historic physical features or characteristics . The property must retain the essential physica l
features that enable it to convey its historic identity . Changes made to continue the function of a
structure during its career may acquire significance in their own right . These changes do not
necessarily constitute a loss of integrity .
Staff Analysis :868 Upham Street has retained the essential physical features that enable it t o
convey its historic significance . The two modifications to the structure since its construction
appear to consist of the addition of two small windows on both sides of the original main doubl e
hung window on the upper gable and the porch enclosure on one side of the front elevation of th e
structure . The building retains the compositional elements that reflect the original planning an d
conception of the property and the porch enclosure and added windows on the upper gable do no t
impact the buildings ability to convey the property 's design elements, such as organization o f
space, proportion, scale, technology, ornamentation, and materials . The upper level windows and

porch enclosure were added during the period of significance of the structure and reflec t
modifications which would have been intended to enhance the functionality of the structure fo r
the family. The window configuration on the upper level gable is consistent withthe Craftsma n
style and is not out of character with other structures of the era . Exterior character definin g
features which have been retained, include : bay windows, cornices and dentils at the top of th e
first story, clapboard siding, deep overhangs, projecting gable dormers, knee brace supports ,
exposed rafters with decorative cuts, and double hung sash windows most of which have origina l
glass . The interior of the building has retained built-in cabinetry, beamed ceilings, tapere d
columns, dark wood wainscoting, original fixtures, and fireplace with built in benches . Th e
building is very recognizable as a Craftsman style home with eclectic features of the Neo -
classical and Victorian era . The exterior character defining features described here are intact an d
in excellent original condition all the way around the structure and the interior features of th e
living and dining area described here are in excellent original condition . (During the presentation ,
staff will provide numerous photos documenting the integrity of the all elevations of the buildin g
and interior features).
Setting is the physical environment of a historic property . Whereas location refers to the specifi c
place where a property was built or an event occurred, setting refers to the character of the plac e
in which the property played its historical role . It involves how, not just where, the property i s
situated and its relationship to surrounding features and open space :
Staff Analysis :868 Upham Street is located in a setting that reflects the residential character o f
the building and its surroundings (a number of structures also built by Harry E . Lyman) when i t

structure during a period in the past . Integrity of materials determines whether or not an authenti c
historic resource still exists . The choice and combination of materials reveal the preferences o f
those who created the property and indicate the availability of particular types of materials an d
technologies .
Staff Analysis :The property maintains its key exterior materials dating from the period of it s
significance . The porch enclosure and window modification also appear to date from the perio d
of significance of the structure and it reflects the way the Lyman's lived in and used the property .
Workmanship is the physical evidence of the crafts of a particular culture or people during any
given period of history. Workmanship is important because it can furnish evidence of th e
technology of the craft, illustrate the aesthetic principles of a historic period, and revea l
individual, local, regional, or national applications of both technological practices and aestheti c
principles .
Staff Analysis :The property is an excellent representation of craftsmanship of the time . The
workmanship of the property is expressed in detailing and materials around the exterior of the

building and interior . 868 Upham Street is evidence of Harry Lyman's labor and skill i n
residential construction and representative of the high quality construction apparent in many o f
the historic homes built by Mr . Lyman in the neighborhood and around San Luis Obispo .
Feeling is the quality that a historic property has in evoking the aesthetic or historic sense of a
past period of time . Although it is itself intangible, feeling is dependent upon the structure's
significant physical characteristics that convey its historic qualities .
Staff Analysis :The buildings significant physical characteristics both exterior and in the interio r
have been well preserved and the structure evokes the historic sense of the period of time in
which it was built and the ensuing years when the Lyman family lived in the structure . The porch
enclosure left original walls, windows, and other features intact and has similar details whic h
blend with the rest of the structure . The porch enclosure even reflects how it was used and i s
currently used as functional space for the residence with desk space and storage areas . The porch
enclosure does not detract from the feeling of the property and may even be a part of the histori c
fabric of the building .
Association is the direct link between an important historic event or person and a histori c
property . A property retains association if it is the place where the event or activity occurred an d
is sufficiently intact to convey that relationship to an observer .
Staff Analysis:Taken together, the physical features of the building convey the property's
historic character. The property effectively expresses the historic person (Harry E . Lyman) an d
historic period of time in which it was constructed.

Conclusio n
The enclosed porch and altered dormer window at 868 Upham do not alter the integrity of th e
resource . The porch enclosure appears to have been constructed during the era of significance o f
the residence (more than 75 years ago) and secondly it did not alter significantly the origina l
fabric of the residence . The porch enclosure work represents quality craftsmanship and blends
with the architectural style and details of the house (Figure 2, below). The trim and paneling
details were built with care to match up with the existing bead-board and molding details tha t
extend all the way around the house . The porch enclosure could be considered to have acquire d
significance in its own right . The materials, workmanship and feeling of the residence are stil l
very much intact . The windows added to the dormer also fit this same description .

on the upper gable were added to the structure . Brian Leveille responded that the exact
date is not known but, based on the glass and details of the installation, the wor k
appears to have occurred early in the building's history .
Vice-Chair Costello commented that, at the back elevation, there was one set o f
windows where the trim details may suggest some windows have been altered and ma y
not be original .

Dean Miller, San Luis Obispo, stated that he did not support the project because th e
building had been modified from its appearance when it was first constructed . He also
commented that the initial staff report presented for previous CHC review lacked detail .
Mr . Miller presented a photo of the subject structure in 1912-1913 and stated the hous e
does not presently communicate the same structural details as it did originally . H e
suggested the property be listed as a contributing property but not a Master List Histori c
Resource .
Bob Vessely, San Luis Obispo, did not support the . property being placed on the Maste r
List . He had concerns regarding staff interpretation regarding when the porch was built .
He further cited that several City documents show Craftsman Bungalows should includ e
a porch with tapered columns, which the subject property currently does not have . H e
stated the property deserves listing as a contributing property but not as a Master List
Historic Resource .
There were no further comments made from the public .
COMMITTEE COMMENTS :
Committee Member Hill supported staff's recommendation based on several criteria fo r
historic significance . She stated that changes to a building from the origina l
construction does not necessarily disqualify a building from historic significance and ca n
serve as a record for how the building was used over time .
Committee Member Kalkowski spoke in support of staff's recommendation and agree d
with statements made by Committee Member Hill .
Committee Member Kalkowski presented images of Craftsman-style homes notin g
common features of the style that the subject property displays and showed that th e
windows on the upper gable are consistent with the Craftsman styl e
Committee Member Fowler stated support of staffs recommendation based on th e
eligibility criteria which is based mainly on Harry E . Lyman's importance in San Lui s
Obispo .
Committee Member Pavlik supported staffs recommendation .
Vice-Chair Costello expressed concern the variationOf trim details suggest the addition swerenot made by the original builder and stated the porch should be open, M s
Costello asked the applicant if the enclosed porch could be opened to be more

Maggie Browning, applicant, stated she is in possession of photos showing the origina l

The applicants have requested that their property be added to the Master List of Histori c
Resources with the Historic Name : The Harry E . Lyman House (Attachment 2, Applicant lette r
to CHC). The property is currently not listed on either the Contributing or Master List of Histori c
Resources . Historic listing on either the Contributing Properties List or the Master List o f
Historic Resources requires a public hearing before the Cultural Heritage Committee (CHC),
nomination to the City Council and Council approval .
DISCUSSIO N
Site Description
The property is approximately 9,300 square feet and is zoned R-2 (Medium-Density Residential).
The site is developed with the main residence at the front of the property and two accessory
buildings at the rear of the property (Figure 2, aerial photo, below). The main residence was built
by Harry Lyman in 1912 and is described in the Historic Resources inventory as a "1-1/2 stor y
Colonial Revival Style Bungaloid ." The accessory structures include a residence which wa s
originally a shop built in 1908, and there is a garage built in 1940 which was converted into a n
office space in +2005 . The property is located just outside the Railroad Historic District acros s
Upham Street and is two properties removed from the Old Town Historic District to the east .
Though the property is not in a historic district, there are several Master List Historic Propertie s
in the immediate vicinity and other homes which were built in the same time frame (early 20 tn
century) as the Lyman House, some of which were also built by Harry Lyman .

Architectural Backgroun d
The architectural style of the home at 868 Upham Street is described in the Historic Resource s
Inventory as a "1-1/2 story Colonial Revival Style Bungaloi."The home exhibits characteristic s
of both the Craftsman Bungalow style home and other characteristics found on in other histori c
styles . The Craftsman characteristics of the structure include clapboard siding, deep overhangs ,
projecting gable dormers, knee brace supports, exposed rafters with decorative cuts, and doubl e
hung sash windows. The interior of the structure contains the original casework, wood paneling ,
hardwood floors, and hardwood tapered columns, which are also characteristic features of the
arts and crafts movement (Figures 2 &3, below).

The structure also blends architectural styles from different typologies with large bay window s
which are considered a Victorian era transitional element and dentils which reflect neo-classica l
architecture . The structure exhibits excellent overall integrity with almost all original buildin g
features inside and out . The building has all the original double hung sashes, many of which hav e
the original glass panes . It has not been determined when the porch enclosure at the fron t
elevation occurred.
The residence was built by Harry E . Lyman who also lived in the house with his family until hi s
death in 1931 .
Harry E . Lyman and Famil y
Harry E . Lyman was born in Reno, Nevada at the age of 10 . Harry came to San Luis Obispo wit h
his family at the age of 10 . In 1903, he became a journeyman carpenter and in 1908 he was
building homes on his own . Harry E . Lyman built a number of homes for prominent citizens o f
San Luis Obispo which are now on the Master List of Historic Resources . Harry Lyman also buil t
several residences in the immediate vicinity of 868 Upham Street, and dozens of other homes i n
the City (see Attachment 4, excerpts from Lyman Sample Projects 1910-1928, San Luis Obispo).
Harry E . Lyman built the home at 868 Upham Street in the 1912-1913 timeframe . The Lyman
family included his wife, Maggie,son Ellmer, and daughter Mabel . Harry E . Layman became il l
and died in 1931 at the age of 53 . His wife Maggie remained in the house intil the mid 1950's .

The CRC's determination of whether or not a property is eligible for either the Master List o f
Historic Resources or the Contributing list is based on significance criteria of the Histori c
Preservation Program Guidelines . To qualify for the Master List of Historic resources, the
property is required to meet at least one of the eight significance criteria (Attachment 3).

WHEREAS,the Cultural Heritage Committee of the City of San Luis Obispo at a publi c
hearing held in the Council Meeting Room of City Hall, 990 Palm Street, San Luis Obispo ,
California, on July 25, 2011, and recommended the Council add the property located at 86 8
Upham Street to the Master List of Historic Resources ; and
WHEREAS,the City Council conducted a public hearing on September 6, 2011, for th e
purpose of considering adding the property located at 868 Upham Street to the Master List o f
Historic Resources (CHC 63-11) and referred the project back to the CHC to determine whether th e
porch enclosure can remain and still make findings of integrity ; and
WHEREAS,the Cultural Heritage Committee of the City of San Luis Obispo conducted
a 2nd public hearing in the Council Meeting Room of City Hall, 990 Palm Street, San Lui s
Obispo, California, on October 24, 2011, and determined the porch enclosure can remain and stil l
make findings of integrity ; and
WHEREAS,the City Council conducted a public hearing on March 6, 2012, for th e
purpose of considering adding the property located at 868 Upham Street to the Master List o f
Historic Resources (CHC 63-11); and
WHEREAS,the City Council has duly considered all evidence, including the testimon y
of the applicants, interested parties, the records of the Cultural Heritage Committee hearing, an d
the evaluation and recommendations by staff, presented at said hearing .
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of San Lui s
Obispo as follows :
SECTION 1 . Findings .The Council makes the following findings of consistency wit h
Historic Preservation Program Ordinance eligibility criteria for Master List Historic Resources :
1.The house is eligible for the Master List of Historic Resources because it meets Histori c
Preservation Guidelines Historic Significance criteria for Architectural Criteria Style .
The house is an excellent example of the Craftsman style with eclectic influences ; has
integrity ; purity of style ; and, effectively conveys the historical value of the property .
2.The house is eligible for the Master List of Historic Resources because it meets Histori c
Preservation Guidelines Historic Significance criteria for Architectural Criteria Design .
The structure exhibits notable attractiveness with aesthetic appeal because of artisti c
merit, details and craftsmanship .

3.The house is eligible for the Master List of Historic Resources because it meets Histori c
Preservation Guidelines Historic Significance criteria for Criteria for Buildin g
Evaluations - Architect . The building was designed and built in 1912 by a prominent
architect and builder in the local area and was lived in by Harry E . Lyman until his deat h
in 1931 .
4.The house and associated outbuildings are eligible for the Master List of Histori c
Resources since the property meets Historic Preservation Guidelines Histori c
Significance criteria for Architecture — Architect . Harry E. Lyman made significan t
contributions to San Luis Obispo by constructing many homes within the City of San Lui s
Obispo including several historically designated homes in the City of San Luis Obispo
and many other homes which are now located in the Old Town Historic District and in
the Upham Street neighborhood area in the vicinity of 868 Upham Street .
The house is eligible for the Master List of Historic Resources criteria for Integrity sinc e
is occupies its original site and foundation ; has maintained its historic character an d
appearance to be recognizable as an historic resource and conveys the reasons for it s
significance with intact original building materials and architectural details in the exterio r
and interior ; and, the resource has retained its design, setting, materials, workmanship ,
feeling and association .
6.The enclosed porch does not alter the integrity of the resource since the porch enclosur e
was constructed during the era of significance of the residence, and it did not alter the
original fabric of the residence since the original wall and windows still exist and th e
enclosure was of designed to blend with the architectural style of the building .
7.The enclosed porch does not materially alter the buildings ability to convey its historica l
significance as an excellent example of a Craftsman style home with eclectic influence s
since the building exhibits a high level of integrity of original interior and exterio r
features all the way around the structure and no additions or other alterations hav e
occurred; and, the enclosed porch does not impact the structures ability to convey it s
significance as the home of Harry E . Lyman and his family .
SECTION 2.Action .The Council of the City of San Luis Obispo does hereby add th e
property located at 868 Upham Street to the Master List of Historic Resources as the historic "Harr y
E . Lyman House".
SECTION 3 . Environmental Determination .The City Council has determined tha t
the above actions do not constitute a project, as defined by Section 15308 of the Californi a
Environmental Quality Act and are exempt from environmental review .
