SUBJECT: Memorandum of Agreement
CAO RECOMMENDATION:
Adopt resolution approving the Memorandum of Agreement
between the City of San Luis Obispo Fire Battalion Chiefs'
Association for the period 7/1/93 - 6/30/94.
DISCUSSION: The Memorandum of Agreement (MOA) between the City of San
Luis Obispo and the San Luis Obispo Fire Battalion Chiefs'
Association expired on June 30, 1993, after a term of five years.
As provided for in that agreement, the City entered into
negotiations with the Association in May, 1993, to develop a
successor agreement. The City's negotiators, Wendy George,
Acting Personnel Director, and Ken Hampian, Assistant City
Administrator, met for several sessions with the Association
members, Battalion Chiefs Steve Smith, Ken McCool, Jerry Arnett
and Lew Schmutz. The following agreement was reached which
basically parallels that reached earlier with the San Luis Obispo
Police Staff Officers' Association.
The Significant Issues:
TERM - One Year
SALARY - No increase
INSURANCE CONTRIBUTION - Effective the first full pay
period in July, 1993, an increase of$25.00 per month, from $350
to $375 per month to be applied toward health insurance
premiums.
UNIFORM ALLOWANCE - Effective July 1, 1993, the annual
uniform allowance shall be increased $100 from $600 to $700.
LANGUAGE CLARIFICATION - Language was changed in
Article 24, Full Agreement, to provide better clarification of
what the article means. The existing language was contradictory
and use of the same language in the Firefighters' Association
agreement led to a grievance last year.

FISCAL IMPACT: Estimated costs in this agreement are approximately $1700. Due
to the minor changes to the prior agreement, we have decided not
to reprint an entire MOA. Therefore, the normal printing costs
associated with a new agreement will be avoided.
ALTERNATIVES: (1) Do not approve the resolution and direct staff to negotiate
a different successor agreement. This action is not
recommended as the agreement presented is consistent with i
the previously approved Police Staff Officers' MOA and
the City's employer-employee relations policies.

(2) Defer adoption of the resolution. Likewise, this alternative
is not recommended since the current agreement has
expired.

A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO
ADOPTING AND RATIFYING THE MEMORANDUM OF AGREEMENT
BETWEEN THE CITY OF SAN LUIS OBISPO AND THE SAN LUIS OBISPO
FIRE BATTALION CHIEFS' ASSOCIATION FOR THE PERIOD OF JULY 1,
1993 - JUNE 30, 1994.
BE IT RESOLVED by the Council of the City of San Luis Obispo as follows:
Section 1. The Memorandum of Agreement between the City of San Luis Obispo and
the San Luis Obispo Fire Battalion Chiefs' Association, attached hereto as Exhibit "A" and
incorporated herein by this reference, is hereby adopted and ratified.
Section 2. The Finance Director shall increase the Personnel Services appropriation
accounts to reflect the negotiated compensation changes.
Section 3. The City Clerk shall furnish a copy of the Resolution and a copy of the
executed Memorandum of Agreement approved by it to: Steve Smith, President of the SLO Fire
Battalion Chiefs' Association; Wendy George, Acting Personnel Director; William Statler,
Finance Director.

MEMORANDUM OF AGREEMENT
BETWEEN
THE CITY OF SAN LUIS OBISPO
AND THE
SAN LUIS OBISPO FIRE BATTALION CHIEFS' ASSOCIATION
JULY 1, 1993 - JUNE 30, 1994
This agreement is made and entered into this 5th day of October, 1993 by and
between the City of San Luis Obispo, hereinafter referred to as the City,.and the San
Luis Obispo Fire Battalion Chiefs' Association, hereinafter referred to as Association,
as follows:
1 . The term of the agreement shall be one year, July 1, 1993 - June 30,
1994.
2. There will be no salary increases.
3. The annual uniform allowance shall be $700.00.
4. Effective July 1, 1993, the City's Cafeteria Plan contribution will be
increased to $375.00 per month.
5. Article 24, Full Agreement, will be changed to read as follows:
It is understood this Agreement represents a complete and final
understanding on all negotiable issues between the City and the
Association. This Agreement supersedes all previous Memoranda of
Understanding or Memoranda of Agreement between the City and the
Association except as specifically referred to in this Agreement. During
the life of this Memorandum of Agreement, should either party desire to
modify its terms or to meet and confer with respect to matters within
the scope of representation, such party shall request in writing to meet
and confer on such item(s), which item(s) shall be specified in writing.
During the life of this Memorandum of Agreement, either party may
refuse such a request without explanation, and no unilateral action may
be taken on the matter within the scope of representation during the

term of this agreement.
6. All other terms and conditions provided in the Memorandum of
Agreement between the City and the Association, July 1, 1988 - June
30, 1993, shall continue in full force and effect until expiration at
midnight, June 30, 1994.
This agreement was executed on October 5, 1993 by the following parties:
