Adopt a resolution authorizing the City Manager to enter into a contract with the State i f funding is awarded . 3 Authorize the City Manager to execute the necessary grant documents upon grant award . DISCUSSIO N Background In prior years, the Police Department has been awarded grant funds from the California Department o f Alcoholic Beverage Control (ABC) to conduct education and compliance activities related t o businesses that hold alcohol licenses . In January 2012, staff received notification that the ABC ha d opened its FY 2012-13 grant solicitation to local governments . The purpose of the grant funding is to enable agencies to expand their present efforts in addressing alcohol related problems through a comprehensive ABC program that encompasses various strategies . The goals of the ABC grant program include : 1.Achieving the goals and objectives of the local enforcement agency's grant agreements . 2.Establishing a close working relationship between ABC district offices and the grant agencies . 3.Prioritizing law enforcement efforts and targeting those licensed outlets that cause alcoho l related crimes . 4.Reduce the sales of alcoholic beverages to underage persons . 5.Assisting in the training of local law enforcement . Proposal for Fundin g In keeping with prior Council direction to reduce alcohol-related crime, staff is seekin g authorization to submit a grant application that focuses efforts on reducing access and consumptio n of alcohol of underage persons and taking enforcement action against individuals and businesse s that provide alcohol to minors . Grant activities, if approved, would include : Off-Sale Surveillance/Minor Decoy Operations : During the 12-month grant period , licensed off-sale establishments (liquor and retail stores that sell alcohol)will be checked for compliance with laws and alcohol license/use permit conditions regardin g sales of alcohol . On-Sale Surveillance/Minor Decoy Operations : During the 12-month grant period, licensed on-sale establishments (bars, nightclub and restaurants) will be checked fo r compliance with laws and alcohol license/use permit conditions regarding sales an d service of alcohol . 3 IMPACT Education Activities : In collaboration with outlet operators, officers wil l conduct prevention and education programs for employees of on-sale establishments tha t tend to generate the most alcohol- related police responses . The City's application will seek funding for overtime reimbursement for existing officers to conduc t the grant-related activities . The grant application requires the Council adopt a resolutio n memorializing its action and authorizing the City Manager to execute the appropriate contract an d other grant-related documents . The State requires that the grant funding be used for activities abov e and beyond those currently funded through the City budget . Supplanting general fund allocation s with grant funds is strictly prohibited . FISCAL IMPACT There is no impact on the City's General Fund associated with this action . City matching funds ar e not required for this grant, and all grant related activities will be conducted using existing officer s on overtime . ALTERNATIVE S 1.Council may direct staff to not submit an application for ABC grant funding . Staff does no t recommend this alternative as the funding will enhance the Police Department's efforts i n addressing alcohol-related problems and reducing under age and high-risk drinking . 2.Council may direct staff to apply for grant funds for a different purpose than those suggested b y staff As long as the purpose is within the scope of the allowable grant activities, staff woul d adjust the application accordingly . The activities suggested were identified based on the mos t common violations associated with licensed establishments . (2012 Series ) A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO T O INCREASE EDUCATION AND . ENFORCEMENT PROGRAMS FOCUSING O N REGULATING RETAIL ALCOHOL OUTLETS WITH GRANT FUNDING PROVIDE D THROUGH THE DEPARTMENT OF ALCOHOLIC BEVERAGE CONTRO L WHEREAS,the San Luis Obispo Police Department through the City of San Lui s Obispo desires to undertake programs to increase education and enforcement to focus o n regulating retail alcohol outlets in the community ; an d WHEREAS,grant funds are available through the Grant Assistance Program (GAP ) administered by the Department of Alcoholic Beverage Control (ABC). NOW, THEREFORE, BE IT RESOLVED by the Council of the City of San Luis Obispo as follows : SECTION 1 . The Chief of Police or his designee is hereby authorized to submit gran t applications consistent with program requirements to pursued a GAP grant administered b y ABC . SECTION 2 . The City Manager of the City of San Luis Obispo is authorized to execut e all grant related documents, including the State of California Standard Agreement contract, an y extensions or amendments thereof, and any subsequent contract with the State in relation thereto . SECTION 3 . The City agrees that any liability arising out of the performance of thi s contract, including civil court actions for damages,shall be the responsibility of the grant recipient and the authorizing agency and acknowledges that the State of California and AB C disclaim responsibility for any such liability . SECTION 4 . Grant funds received hereunder shall not be used to supplant expenditure s controlled by this body . SECTION S . This award is not subject to local hiring freezes .
